The seatpost clamp is missing. You’ll need to find (a replacement) one before you can adjust the height (or ride the bike safely, for that matter).

It’s missing a clamp around the top of the frame. If you’ve just bought it check the box, or ask the manufacturer to send one. Otherwise just google the frame specs and you can order a clamp on amazon.

That seat tube looks like it’s missing a clamp, so it should move freely. Is it aluminum and it’s oxidized or seized up? Take it to a bike shop if it doesn’t move freely.
Also you’ll want to get a clamp to hold it in place once it’s moving freely, and lube the seat stem so you don’t have this problem in the future.

Don’t sit on it. Either your seat post will be resting on the upper bottle cage boss, or it will fold open the back of the seat tube because of the bent shape. Get a seat post clamp before you ride it.
