Get a seatpost clamp with eyelets. You can attach the stays to this instead of the seatstays and this will also avoid the rack stays fouling the rear brake (which looks to be the case in the second photo).

Does it need to be more level? This is sometimes intentionally done to give more heel clearance to panniers, if/when mounted.
It can absolutely be changed but the stays are too short to resuse with the same frame mounting point so you either need to replace those or use a seatpost mount as others have suggested.
If it’s just an aesthetic thing, I’d personally leave it as it is.
It should be level or slightly forward. Ideally the center of the load is in front of the rear axle.
A backwards tilting rack can shift the center of load behind the rear axle which enables the load to negatively affect handling especially at lower speeds. I have seen one person load up their bike such that it was necessary to actively push down on the handle bars to keep the front wheel on the groun when stopped. Or you may have trouble going in a straight line until about 10km/h.

look like the top struts bottomed out or were cut. you’d need longer ones.

Longer rods? Also you can try fitting those upside down, if it does not impact the operation of the brake arms.
there are universal adapters to relocate the arms, but i’m a fan of the ones that are integrated into the seatpost clamp.. it justs looks cleaner
