Bad crash a couple days ago. I came to in an ambulance…being told I was out for 10-15 minutes. Concussion. Broken clavicle. In the ambulance I could not recall anything about the crash or much of the morning. Witnesses said I flew over the handlebars and they didn't know why but suspected bad pavement.

My Garmin watch recorded my ride and detected the incident. I went back to the precise incident location and then had some flashback memories of striking one of these black things (missing the orange tube), losing control, and flying off the bike. The location matches exactly. And I would have been veering over to avoid upcoming construction.

I've contacted the city for any available video footage from street cameras (since this is a busy area on a college campus). I was told there might be footage but it will take 12 weeks to get it to me.

Really bummed I'll be off the bike for 6-8 weeks (assuming no surgery needed). I'm in a lot of pain…rib cage, back, clavicle. My head seems pretty clear so far.

I am kind of pissed at what I think is negligence in these big black things sticking out of the road without the orange poles? Sure a car could have ran them over but then they would be bent down rather than entirely missing? If I can get video evidence, I am considering contacting a bike injury lawyer?

My Bontrager Starvos helmet has two cracks in the outer shell, and the wavecel interior is also crushed a bit. Surely I would have fared far worse not wearing a helmet. While it is a 5-star rated helmet from Virginia Tech testing, looks like there are a couple better models out now that I'll consider getting as a replacement. The POC Cytal is especially highly rated in high-impact crashes.

wow, i actually just rode my bike for the first time in 50 days because of a broken clavicle. Stay patient and heal up!

  2. I’m glad you’re not hurt worse, but I don’t think you’re going to get anywhere alleging negligence. It’s still mostly your responsibility not to run over stuff in the road.

I am glad you are ok, i had a bad accident last spring which kept me off the bike all of last spring, summer, and fall. Take the time and recover properly, i would suggest getting on a trainer as soon as you are able if you are worried about losing fitness and yes, contact a lawyer but don’t wait too long. Sometimes there is a statute of limitations on the amount of time you have to report it.

Cities are pretty well protected from negligence. You mentioned construction in the area so likely those aren’t even the cities. If they are you’ll still have to prove the issue was reported to the city and the city had adequate time to fix the issue since notification. If it’s the construction company I assume the same applies. You’ll also have to show that the negligence is their own, not shared, as in, should you have avoided the situation and would a reasonable person have had the same issue.

I’d sue the living fuck out of the city for not properly maintaining the roads.
