2024 Momentum Transend E+ The bike is brand new and under warranty so could easily be rectified but I’m just looking to see if I’m worrying about nothing.
The gap surely should be more even than this, this is the headset(?) to the fork.
When riding there’s no movement/play and no noise whatsoever it feels completely fine

Yes. It looks like your headset is loose. Or if not that, your fork (specifically the steerer tube) could be bent.
Look into checking up on loose headsets and correct that. If that doesn’t fix the problem, check for a bent steerer. If you don’t know how to do that, take it to a shop.
Note that this sort of thing can happen from hitting curbs or big potholes and that would be considered damage and generally not covered under warranty.
Yes. Definitely cause for concern, and definitely something to talk to either the shop you purchased from or the manufacturer about.
Two possibilities jump to my mind. First and most likely is the box box was stood up vertically and dropped in shipping or storage. This can easily bent the steer tube of the fork and result in a gap like that. Second and much easier to fix is that the bottom headset race was not installed correctly and is sipping unevenly on the fork crown.
Both of these are relatively simple to remedy but both should be handled by a professional. If it was purchased at a local shop its alarming that made it through assembly without being caught.
Is there any play when not riding? When you just hold the front brake and rock the bike back amd forth? If so the headset is loose. But to me it kinda looks like the fork is bent, which is a major issue and needs to be replaced
Hard to tell exactly. If the headset is not loose, check the crown race on the fork. It looks like it might not be seated correctly.
I’m very much in the “go ride” camp about shipping damage, but this one’s not OK. Figure it out. Bad steer tube weld can kill you.
