Hi guys I’m looking to buy this 4130 all road gravel bike but I’m not sure if the chain stay is damaged? Seller is telling me that’s the design of it and it’s fine. I’ve looked at some others ones and do they appear to have the same appearance. Can anyone confirm?

You’re talking about that small indent behind the chainring? If so, totally normal.
Don’t buy state bikes unless its very very cheap, they are terrible bikes.
Indent behind chainring is normal. The gray marks on the top are from chain slap and are probably mostly chain lube. There might be a clear piece of tape there to protect it. You can probably wipe that clear with a rag and rubbing alcohol.
