I just noticed the the bearing that goes around the axle has a lose fit in the frame, can I do something about it? I couldn't find the replacement chainstay, it's a 2014 trek remedy 8 29er, it's gonna have serious consequences on the frame? For now it only scratched the paint off the seatstay.

Not major scratches but still not ideal
New bearing and torque to spec.
That’s a poor design which relies on a light press fit to keep things right. Some loctite 620 or 690 will help, but it may not be enough. Worth trying
I was a mechanic on the Trek DH team, for that era of ABP we would epoxy the bearings in. They hammer out fine when ready to replace
