All vehicles with motors should be legislated as motor vehicles: insurance, registration, tax, licence, ppe etc. asking the police to rule between two very similar contraptions is a stupid waste of police time.
The only wheels with special treatment in law should be limb-powered or disability carriages – ie "pedestrians on wheels". If you're using a motor, you are a motorist.

The officers wording is not correct though. He states "an ebike should not be able to go over 15.5mph". Except that is not the whole law. Law states the bike must not give power over that speed, but you can ride faster by turning the pedals using your own pedal power.
My LEGAL cube ebike, I cycle on average at around 20mph, faster downhill, but crucially the motor stops at 15.5mph. Max continuous wattage is 250w (per the law), but a peak wattage of 750w. I wear a helmet and cycle clothing and have full insurance on the bike.
Considering many of the lycra crowd can exceed these speeds imposed on e-bikes, it should be more about the behaviour of e-bike users. Sure, an e-bike travelling at speed and the rider not wearing the appropriate kit (that the majority of motorcyclists use) is an issue, however an e-bike rated at 500w has twice the "power" of a 250w motor, but at the same speed is likely to have better longevity, and can still be speed restricted (much like motorcycles/mopeds in the 50cc-125cc category), and you can still enhance these smaller bikes to break their power output restrictions. Focus more on the behaviour of the riders (red-light jumpers, riding on pavements, speeders) than on the bikes themselves.
Responsible riders won't break the law. It's the same with car drivers.
