It looks like you need to replace the vertical support between the frame and the rack. A piece of flat steel, a drill press, bolts and a some threadlocker I reckon.

Ad hoc fixes like this are a good way to seriously injure or kill yourself. Fix it right…paying what it costs to fix right, or don’t use the rack. Be smart. Don’t be greedy and regret the rest of your life to save a few dollars.

That hose clamp will saw a hole in your stays. make sure that you have a piece of inner tube or something there to keep the sharp edges from cutting into the frame.
