I was riding my bike to work on the Contra Costa Canal Trail when I got hit by a car. But I'm a foreigner and it's my first car accident, so I didn't know what to do. I didn't take any pictures of the crash site, and I just had the car owner's insurance, driver's license and phone number. She took the pictures, but I'm worried if she will provide them. I went to the hospital the day after the accident, and two days later I contacted the her insurance company, and tomorrow I'll go to the police station to get help. She says I didn't provide the information at the time and I hit her car. I gave her my phone number obviously, but… as far as I remember, Both are not stopped. And when I saw her, It was so late to do break. If I do break My body would have bounced off from bicycle. I'm not seriously hurt to drive at the usual 11 miles.But My bike is broken.

Am I fault in law? And if there's any witnesses to the bike accident on October 17, at the contra Costa Canal Trail. please comment. For the stupid foreigner who didn't film the scene.

Right after the accident, I told her I had an injury and would go to my company for treatment. Because I'm work in the restaurant So there is a medical box. I was afraid of hospital bills because I didn't know much about visa insurance and I had a medical box there to work at a restaurant. And I don't understand.. but she gave me 27 US dollars and 36 US dollars "Hong Kong money" to take a taxi..? I said I'm from Korea 🥲 and I can't take a Uber with my bike. But she keep gave to me money 😮‍💨

  1. what’s done is done so i wouldn’t dwell on what you can’t change. the most important thing is that you don’t have head trauma or permanent injury. there is nothing criminal, just sounds like an accident. everything else is just a bit of money. if you have car insurance you can see if they have any advice for you or if they can deal with her insurance company. if they will you should provide yours with documentation of your injuries and whatever you can to help your case. what were your hospital bills? do children ever use that crosswalk? what speed was she going? how much did your bike cost? if she provides pictures, do the file names skip numbers, like IMG2308 jumps to IMG2312, or are there large gaps in the time the pictures were taken? there are also a fair number of bicycle lawyers in the bay area. it’s hard to estimate fault just from a description but they could decide you were both at fault and everyone just has to deal with their own costs. legally a pedestrian cannot cross until it is safe to do so, but was she over the speed limit? lastly once you have a plan i would delete this post in case her insurance company might find it and use it against you

    I am not from the US either, so don’t know the best steps to take. If you rode onto the road here and she was not driving recklessly, you probably were at fault. I would try to find someone local to help you, and either fix or replace your bike.
