I wouldn’t think twice about that. I think it’s fine. Check how it sits when it’s fully loaded, they are trying to avoid abraision against the seatpost collar I believe. So if it’s not going to be significantly rubbed, then you are fine.

As other commenter said, I think the figure in the manual is about abrasion risks. Do some tests, fully loaded, in bumpy paths, and check regularly the distance.
You can even think about fiddling with a small foam piece or a reinforced tape piece to get some peace of mind.
