Neither of them need 5nm. It says right there, “MAX torque”.
You can use less (and should) as long as it holds your stem and handlebar securely.

Pedants in the comments so I’ll answer, yes 5Nm on all stem bolts is more than fine, if you don’t have a troque wrench and no carbon parts (fork steerer, handlebar), hand tight, or “wrist tight” is okay,
Of course adjust the stem cap tightness so there is no play on the headset before locking down the stem
