My Nicasio+ is listed with a clearance up to 700×40, however the front fork clearance is pretty tight @ about 3mm.
Is it gonna be okay, or should I run 700×38 to be safe?

you’ll be fine that’s a lot of clearance
I have ridden worse. I would ride it and maybe get smaller tires once I need new ones.
I’d want more clearance for anything not paved
You’ll probably be fine but dust and dirt will really slowly sand your fork down. I would choose a smaller tire but it’s not needed immediately.
