Well the quick links are usually in a Lil plastic package on their own if I recall. So that’s one sign. Looks sus overall.
Most definitely. That dark circle around the open link shouldn’t be there if it were new unless I’m missing something.
Looks used to me. It could have been a takeoff from a bike with light use, or could be totally knackered.
Hey, definitely not new and installed on a bike in the past. If the chain is used and worn-out, you have to measure it. But anyway – send it back!

Pro tip for a free chain: just buy a new chain and return your old one
Cut and used. The quick link should be in the box at the top of the package. The outer link at the top of picture 2 is not attached to an inner link. There should be two inner links at the ends for a quick link. Return it.
