After closely inspecting the paint of my Trek FX Sport 6 with a flashlight I realized that one side was faded, had white speckles under the clear, and also had a fingerprint left behind by the painter. My warranty expired 40 days ago and trek does not want to replace the frame because it’s 40 days past the warranty period. They said I should have brought it in earlier but It is difficult to see since the bike looks black or a really dark blue when not exposed to the flashlight. It is so hard to see that the quality control at Trek did not catch it on the way out.

I’m considering cutting my loses and removing the groupset and selling it and then try to sell the frame to someone else locally. They offered me a discount off the frame but it will still cost me $540 to get a new frame and then another $300 the bike shop is charging to swap over the parts.

I also have a trek fx 3 disc that I can use in the mean time since I can’t afford to get a new carbon bike right now and just save up for another carbon bike when I have the money.

What would you guys do?

Paint issues are not covered under warranty through Trek. Warranties on Trek frames are for the life of the bike. Not sure who told you that the warranty period has passed but that is wrong.
