Definitely don’t ride. TBH, the rust on your seat post clamp bolt indicates improper care of the bike. Did you mess with the saddle height and tighten the bolt yourself?
Someone has truly torqued that to hell and back.
It looks like the seat clamp is also cracked right next to the “C” in cm written on it in the second picture.
I would suggest removing the paint around the apparent crack in the frame to see if it is actually cracked, if its all good then purchase a new seat post AND seat clamp. Place some masking tape in a nice circle around the seat tube and remove some more paint up to the tape to make it look clean. Don’t cut the new seat post for maximum insertion (from an engineering standpoint I presume it might help some amount, but after a certain insertion depth it likely makes no difference on the length). Use carbon paste on the seat post and grease on the bolts – torque correctly.
