This is the response and final conclusion from Devon and Cornwall Police, regarding the hit and run incident.
Below is my experience of this incident:
“Whilst travelling along Exeter Road after just entering Cullompton. I was approaching a pedestrian crossing with a queue of stationary traffic ahead of me. (On the B3181)
The silver Renault car overtook but side-swiped into my bike/handlebar/hand which in turn hit his wing mirror with enough force to dislodge it because he then slammed his brakes on immediately after the side-swipe in front of me and closed my path down.
It was an unnecessary and personally, I suspect it was done on purpose as they did not stop to exchange details even though I was obviously injured.
The driver did not engage with me at all, he just shouted through his closed window blaming me for the collision.
I pulled over to side of the road to inspect any damage caused by his actions. I expecting him to exchange details. Instead he drove away whilst the female passenger opened her window and proceeded to gesture rudely by sticking two fingers up at me through her open window.
Later in the day I noticed my hand/fingers & wrist were becoming even more painful with the passing of time.”

A warning as a result of a collision causing an injury to a cyclist is not a proportionate outcome. At the very least, this falls under Careless Driving (Section 3 Road Traffic Act 1988). From the video, I don’t believe his intention was to cause you harm. But the poor overtake and lack of consideration shown to you has resulted in injury. Personally I would be appealing this decision as if officers had attended at the time, it is more than likely he would have been charged for Careless Driving. Just my view, but I wouldn’t be accepting this as a resolution.
That should have been at least 3 points and a healthy fine for the pass. Possibly more for failure to stop and exchange details. Also they should have identified the passenger and charged him with a public order offence.

Harvey, pathetic Police response when it's clear this driver cut you up, passenger was abusive and your suffered physical injury. If nothing else this was an illegal close pass! Recently, a colleague riding in front was cut up in a similar way (but no impact) at a traffic light stop. Just a reminder that both front and rear cameras needed. I was thinking of buying a 'Pass Pixie' sticker, but think I noticed a smaller camera symbol on your rear mudguard. Did you purchase separately, or did it come with the mudguard? Have you looked at 'Ride with Roy' Youtube channel? I think Roy's local Lincolnshire police are proactive in prosecuting close pass drivers.!

In these circumstances, bearing in mind good video evidence, I would request a review of the police decision not to prosecute for the number of offences this driver committed. Thankfully you were not more seriously injured. ATB

The driver didn't even stop to see if you were OK, so should be done for failure to stop at the scene of an accident at the very least. Driving without due care and attention (or whatever the equivalent is theses days) should also apply, as driver was not looking far enough ahead to see the slow moving/stationary traffic ahead of him. You have clear and unequivocal film footage … what is the point of onboard cameras if they don't take any action.
Frigging joke! I've sent evidence to the Police myself on two occasions, both similar incidents to this, although I was uninjured. As yet, I've heard nothing, so this doesn't exactly inspire me with confidence.
Yet my wife got 3 points and a £100 fine recently for travelling 4, yes just 4 mph over the speed limit. Policing in this country has become a complete joke!

I'm disappointed for you and the cycling community mate. Can't see that this would have been a prosecution case but given the fail to stop and attitude offered towards you at the time I very much doubt a written warning is likely to have much effect, and given the force's 'Vision Zero' drive I would have hoped a driver education course would have been considered if possible so they could at least have a cyclists perspective on things for future reference. They offer it to speeding drivers to try and highlight the consequences, so I can't see why that wouldn't work here and would be interested to know what the criteria was. I imagine the argument is that speeding is an absolute offence and that option is seen as a diversion from prosecution/penalty points. All we can hope is that the driver does think twice in future, either through the police warning or any other action you take through insurance etc. All the best.

Unbelievable, what hope is there for pedestrians & cyclists when the police respond like that to a fully video'd hit & run. I'd complain to the police & crime commissioner for your area & your MP.

Ridiculous, a waning letter to a driver like that is basically a conformation that what they did was "no big deal". Make a complaint about the police's handling of the incident, to the IOPC ask for a detailed explanation of why a hit-and-run resulting in injury was not deemed worthy of at least points and a fine.
I would say it’s very much in the public interest to pursue this kind of idiot who shows to regard for others. Either he did it on purpose and should face harsh punishment or he was just totally unaware of his surroundings (like so many of these narcissists are) and should at least have been fined. There are obviously worse crimes going on every day but in this case they had all the evidence given to them by you. The fact that the driver didn’t even accept his bad driving and went on to gesture you just makes it worse. An official warning probably won’t have any effect on this utterly selfish moron. Completely failure by the police I would say.

Should definitely have been prosecuted as careless driving at the least. Idiotic driving causing a collision and injury and leaving the scene.
Not good enough, D & C P. The move over was deliberate. Their response was not to care about the cyclist. Can a claim be made for personal injury through legal means/the courts ?
A ridiculous decision on the part of the police! It was appalling driving. Maybe there’s an option to start a private prosecution?
Need to put a complaint in that’s not good enough careless driving minimum
