It could be – but it’s so dirty it’s hard to tell.
The first thing I would do is give it all a good clean and then tighten it up to spec and see what happens. If it comes loose again it’s probably damaged. You’d need to use the same type to avoid replacing the complete chainset and bottom bracket.
If you need to replace it Shimano is a decent choice – you can get all of their choices in 165mm.

It’s really strange for these to come off. Tighten the pinch bolts to spec (10–15Nm I think). Alternate between both bolts when you tighten them. I think even if they’ve been ridden loose the pinch bolts should still do their job, so it’s unlikely that the contact surface is damaged too much (unlike with square taper crankarms which rely on a precise fit).
