Quite a long complain from this driver. Court Result – this driver was found guilty, given 6 points and a £620 fine+costs+surcharge, and as he already had 6 points, was then considered for disqualification. He succeeded in his application for an exceptional hardship exemption.
I felt glad that the Judge made it clear to the defendant that he had only himself to blame for using his phone and ending up in court. I felt the Judge was fair and gave the defendant every chance to defend himself. He even allowed the defendant’s wife to speak and to examine me on the witness stand as the defendant was very nervous about speaking. She would not normally have a right of audience. She hadn’t prepared her questions and was stopped by the judge a couple of times for making statements and not asking me questions.

Is going to go one of three ways um number one he is hoping it won’t turn up and that the case will then be dismissed number two it may be that he has almost more than six points and is therefore being considered for disqualification or number three is he
Just wants to defend his case and thinks that he didn’t do anything wrong maybe I’m not sure I’ll let you know when I I come out again thanks and bye yeah I’m out of court now result is the driver was found guilty um unsurprisingly I mean the it was a judge
Sitting not three magistrates and the judge found it like it almost couldn’t be a more clearly proven case um the driver tried to say that he dropped his phone and was just picking it up to put it down uh which I don’t believe to be
True um yeah he also the driver got and his wife his wife was there supporting him and was really quite angry about me I think uh one of the things he really wanted to tell the judge was that I was overtaking on the wrong side of the road
Um and the judges simply shut that down said that’s completely irrelevant um which it is and besides which if if you know much about motorcycling and cycling it’s actually usually slightly safer to overtake on the offside where I was overtaking as you’ll see and less safe
To overtake on the near side in the gutter when you’re filtering so uh um yeah that’s just a bit of misunderstanding that many drivers in the UK have not just this guy so the chap I believe had two endorsements for speeding from I think it was 2021 so
Those that added up to six points on his license so um the the further six points from this mobile phone conviction make him a totter meaning that he’s got 12 points and is automatically being considered for disqual ification anyway um he successfully made a case to the district judge that
Disqualification would mean exceptional hardship so he was given exceptional hardship and I’m kind of okay with that cuz I felt a bit sorry for the chap hearing his his personal situation um yeah so um I’m all right with it even though probably in the light of what me
What many people think that should not have been uh given as an exceptional hardship anyway it’s the judges choice not mine um coming out of the Court his wife was well not happy with me really angry and unfortunately I don’t think she realizes that I do this not just for
Myself but for everybody so that we don’t get people running her children over or her grandchildren and that kind of thing so anyway the judge did mention to the driver that his exceptional hardship argument can be used only once so if he gets another endorsement while dve he’ll almost certainly lose his
License um let’s hope he Hees it let’s hope he he does better in future and then that’ll be good I suspect his insurance is going to become exceptionally expensive though all righty see you [Applause] around I’ll be one to dyp I think hi I’m going to be reporting
That to the police I said I’m going to report your phone news to the police why cuz you’re not allowed to do it in your car sitting in the traffic is your engine running is your engine running no it’s not running guess you parked

What I don't understand is why don't these drivers, with points already on their licence, take a great deal more care about not getting more points? Is it arrogance or do they think they're doing nothing wrong? The Judge told this driver that he has only himself to blame for being here in court. The driver said, whilst applying for exceptional hardship, that he was very sorry for holding his phone. I think he was only sorry that he got caught, personally.

I feel zero sympathy and not one bit sorry for those morons. Exceptional hardship my arse. Thousands of people have to live their lives having no car and just relying on public transport or simply the shoe lace express and they manage fine. Way too many people in this country can't imagine not being able to drive a car for one day and for even one time being outside their house.

This exceptional hardship nonsense means (I’m certain) that 5,000 + drivers a year get away with not being banned – needs vehicle seizure as well

The exceptional hardship is BS. That's why we have points and totting. Him getting 12 points was completely unavoidable by his own behaviour. 2 speeding fines and playing a game at the wheel of a could of tonnes of metal are not honest mistakes.
Good work. You take the right view about the disqualification, i.e,. that is not relevant to the offence for which he was rightly found guilty and appropriately sentenced. The fact that the sentence, when added to his accumulated points, meant he would be disqualified is quite a separate matter. It's pretty hard to persuade a bench to agree that losing the licence would cause 'exceptional hardship'. Losing a job isn't enough, but hardship to others, such as employees or relatives, carries weight.

Just seen you (2/11) on the French TV news (TF 1) Mike …. your fame has now officially crossed the channel! The French news item was about the growing number of video clips of dangerous drivers taken and submitted, by members of the UK public, to the police. According to the TV news, the UK police are increasingly resorting to this source of video evidence to successfully prosecute bad drivers. You were featured as a "trend-setter". If you had been riding naked up the wrong side of the road, screaming expletives, you still witnessed this crime and caught it on camera. You might have a case to answer yourself but, as the judge said, it's irrelevant because that wasn't the case that was being heard. If he had driven dangerously and claimed it was due to your actions then it's something to discuss. He was just trying to deflect responsiblity. Terrible behaviour. At least own it when you do something wrong.
And, yes, we can filter (I drive a car and ride a motorbike myself but have cycled on the road in the past). I do have to laugh when drivers get upset about filtering. I know some cyclists bahave appallingly and give everyone else a bad name, but that's the person not the mode of transport. They would be equally idiotic in a car.

The ‘traffic is stationary’ excuse.. ok, the risk is perhaps lower or perhaps not. But I still think it’s worth what you do because as we see time and again in these videos the people who you catch often have points from other offences and the phone use, even if it is only ever in stationary traffic, is just a pattern of behaviour that signifies OTHER illegal driving habits and a general lack of care and attention whilst driving. I’d be happy if they were ALL off the road. There’s too many drivers who go out every day and drive without giving it enough thought, who have no desire to improve their skills, and who do not take heed of their responsibility to keep everyone else safe.

If losing your licence will cause exceptional hardship, you'd best follow the rules! I am sure that colliding with someone because you were playing solitaire could potentially cause that person exceptional hardship too! I have zero sympathy for personal circumstances here!
