The shop which sold this bike to my friend doesn’t want to acknowledge any fault and keeps making a refund very difficult. It came out of the box like this. Could I let him ride this with a clean conscience?

Not a safety issue, but for a new bike, it’s an *issue*.

If it is brand new return it as damaged. Depending in which country you are and how you bought it, online or in the shop, you will likely have different protection against this damage.

Definitely should return it if it came out of the box like that.
That being said, that is completely safe. During riding the bottom tube is under tension, so it is not going to buckle. If that was top tube, which is under compression during use, it would increase the chances of buckling and would have an effect on the safety of the frame.
