Drink-driving in the UK carries serious consequences — from fines and bans to prison sentences, and even life imprisonment in the most severe cases. You could be imprisoned, banned from driving and face a fine if you’re found guilty of drink-driving.
The actual penalty you get is up to the magistrates who hear your case, and depends on your offence.
You may be able to reduce your ban by taking a drink-drive rehabilitation scheme (DDRS) course if you’re banned from driving for 12 months or more. It’s up to the court to offer this.

Causing death by careless driving when under the influence of drink.
You may get:
✅ life imprisonment
✅ an unlimited fine
✅ a ban from driving for at least 5 years
✅ an extended driving test before your licence is returned
👉 You will not automatically get your licence back if you’re a high risk offender.

Every year, thousands of people are caught drink driving in the UK. Drink driving is the offense of driving a vehicle with an excess amount of alcohol in the blood. The consequences of this can really be fatal and life-changing, not just for drivers, but also for everyone around them, including other road users. In this video, I will highlight what penalties you may get if you’re caught drink driving. The penalties you may get for drink driving are broken down under four main categories of offense. One, being in charge of a vehicle while above the legal alcohol limit or when unfit through drink. Two, driving or attempting to drive while above the legal alcohol limit or when unfit through drink. Three, refusing to provide a specimen of breath, blood, or urine for analysis. And four, causing death by careless driving when under the influence of drink. Let’s begin with being in charge of a vehicle. You may not be driving a vehicle to get penalties under this being in charge category of drink driving offense. The court will consider a few factors. These include how far you were from the vehicle, what you were doing at the relevant time, whether you had the ignition key, and whether there is evidence that you drove or were about to drive the vehicle. And the penalties you may get include three months imprisonment, a fine of up to £2,500, or a possible driving ban. Now, let’s see the penalties for driving or attempting to drive. If you’re caught driving or even attempting to drive when you’re over the legal alcohol limit, the penalties are much tougher. You could face up to 6 months in prison. You could get an unlimited fine. And you could get a driving ban of at least 1 year. And if you’re convicted twice in 10 years, that ban rises to a minimum of 3 years. Normally the police would breathalize you if they suspect that you are over the legal alcohol limit for driving. If you refuse to provide a breath, blood or urine sample when asked by the police, you could face up to 6 months in prison. You could get an unlimited fine and you could get a driving ban of at least one year. And if you’re convicted twice in 10 years, that ban rises to a minimum of 3 years. As you would expect, the most serious offense is causing death by careless driving while under the influence of alcohol. The punishment reflects the severity. You could get up to life imprisonment. You could get an unlimited fine. You could also get a driving ban of at least 5 years and an extended driving test before your license can ever be returned to you. But the impact doesn’t stop at the courtroom. You could face other problems if you get a drink driving conviction. First, your insurance costs often rise dramatically. Second, employers may see the conviction on your record, making some jobs impossible. Third, and in some cases, you may be refused entry to countries like the United States, so a single decision to drink and drive can follow you for years to come. Looking ahead, the UK government is now considering lowering the drink drive limit in England and Wales, bringing it closer to the stricter standards in Scotland and much of Europe. This means enforcement is only likely to become tougher in the future. Remember, there’s no safe amount of alcohol when it comes to driving. Even small amounts can affect your reaction time, can affect your judgment, and can affect your ability to drive safely. So, if you plan to drink alcohol, then plan ahead. Use public transport, book a taxi, or get a lift. Keep in mind that one careless choice doesn’t just risk your license. It risks your precious life.
