














So guys, I was riding my bike last Tuesday afternoon and I was hit from behind by this truck I fell hard on the ground and had few minor injuries. I went to ER but there was no fracture or any deep injuries except few rashes on my
Leg and my hand, at Er they did a full check up and x-rays but they didn’t found anything broken. On the other hand my bike is completely damaged the frame broke in two pieces and the trek shop said it’s beyond repair, It was a brand new bike, which I purchased literally last week which I have the invoice and the receipts from the trek shop and I have credit card statements showing the date and amount of purchase, Not only my bike broke in this accident but my phone , my apple Apple Watch, helmet and AirPods all took a big hit.
When accident happened the police came on scene and asked me to go make a police report which I already completed.
I called the other person’s insurance company, but they told me this driver had a commercial insurance so I have to email them and someone will call me back in 3-5 days it’s been 4 days and I haven’t heard anything back from them. I tried to contact a few lawyers, but since I don’t have a major injury, they are not too eager to help me unless I wanna retain them on my own expenses, so if someone had a similar experience Please let me know how can I claim property damage Since I don’t have my insurance on the bike.
Any advice would be very helpful.
I just wana say I am located in Toronto, Ontario , Canada so any advise from local residents will be very helpful because as of right now I’m a total mess emotionally I can’t stop thinking about the worst outcome if I dnt get paid anything for my bike or my other property damage…!

Be persistent with the insurance company. Can you take the driver to small claims court in Canada?

It’s the weekend, so don’t expect to hear anything until Monday at the earliest.
As for lawyers, look for bicycle-specific lawyers instead of personal injury ones. Keep searching, because depending on your local laws, you may be under some tight timelines to be entitled to compensation. If you don’t hear back from this commercial insurance, call the info you got from the driver again. If you have homeowner or renter’s insurance, you may reach out to them for advice as well. Have you gone to the bike shop to ask for advice from them? They may have a better idea of your local resources.

I would also advise you to contact the police again and let them know that you’ve tried to contact the driver’s insurance company unsuccessfully. I’m sure a call from the police will encourage them to get back to you.
Document EVERYTHING, including all calls made.
