posted on the bulletin board please feel free to view the exhibits at any time during tonight’s meeting you are required to fill out a yellow form to speak before the city commission during the form must be completed and placed in the designated box items on the agenda for first reading usually do not allow for public participation however there are some instances where citizens are allowed beautification tree Advisory Board to [Applause] present hello I’m mayor Henry members of the city Commission Mr Chisum my name is Candy Schram 572 Crooked Stick Drive Zone 4 the beautification tree Advisory board has selected Frank and Betty Jane shook 105 Westwood Drive as the residential beautification Award winner for the month of January 2020 Mr and Mrs schook have been residents of Daytona Beach for 21 years they are enjoying being retired and traveling for a few weeks at a time to visit with their children and grandkids they have a lawn service mow the yard but take pride in pruning weeding and maintenance of their plants and Shrubbery the types of trees shrubs and plants used for beautification include palm trees croin bird of paradise impatience Indian Hawthorne gardinas aelas roses crpe Myrtle mums pentas Dalia and a variety of house plants on porch and pool area City Commissioner Robert gilland Zone 4 will be presenting the [Applause] award the CHS here [Music] yes as they’re coming up uh so this is a home in the Pine Lake subdivision and uh that’s near the corner of Beville and um Clyde Morris and it is a great little community in there um all single family home homes um except right near the the entrance there off of Clyde Morris uh their house is just in you know just in to the right so it it is it’s a beautiful home um and it does stand out in the neighborhood it it is immaculate it looks like they’re out there with the with with a ruler and scissors triming the yard you know in taking care of the plants uh I I I probably need to get you to come next door over to my house and help me a little bit because I got a lot of trouble over there so but uh this is a certificate of achievement may it be known that this certificate has been presented to uh Franken Betty Jane is it shook or shook shook uh for distinguished achievement in residential beautification City Daytona Beach and it’s signed by our mayor Derrick Henry and myself the ocean guarden Condominiums 102 South Peninsula Drive as the commercial beautification Award winner for the month of January 2020 the Condominiums were built in 1972 ocean Gardens is a small 27 unit three-building complex surrounding a lush Key West style Courtyard that is the focal point of the community and its residents the types of trees shrubs and plants used for beautification include queen palms sable palms robolini palms croon bird of paradise L Ria and oak trees Mr Tom arales from Ocean Garden to accept the award mayor Derk Henry will be presenting the award [Applause] [Music] this little place uh is one that you really wouldn’t notice unless you were out on occasion beating the pavement as I have had the pleasure of doing uh coming in to harass some of their residents with hopes that they might vote for me uh but nevertheless uh it is a beautiful uh place and you guys do a magnificent job job and I’m certain your residents must really love and enjoy the way that you maintain the place okay and thank you you it is a certificate of achievement may it be known that this certificate has been uh presented to Ocean Garden condominiums for distinguished achievement in comments by people addressing the city commission during this time citizens have the opportunity to address the city Commission on any item on the consent agenda I have one speaker Mr John Nicholson who speaking on item 8 C [Applause] John nlon 413 North Gran Avenue um 8C regards asphalts uh and the paving of Roads about 12 years ago there was talk about repaving uh Butler uh it was falling into disrepair and getting on to coats you went down about 3 feet and came back up about 8 years ago we did a bonding or whatever for $8 million or so and it was supposed to be paved at that point but they switch it to Aura right next to the um bus terminal which made sense because all the buses and all and it was repaired like 20 times or 40 times down the street it was needed but Butler didn’t get it they switched the funds we got another $2 million and we thought we would get it paved and it didn’t get paved Jimmy Johns was going in and they were going to pave it it took me like six months to find out what they were going to pave and what they were not going to pave and I suggested that we work with them and get that couple hundred feet of coats and uh Butler paved at that time nope now we’re Paving someplace else at what point can we get things that need to be done that are like 10 or 12 or 20 years behind the day to get done when they need to get done all I’m asking you is if this is the worst Street on Beachside there really should be a plan at some point someday some year of planning it I don’t know how you do this system I know it’s supposed to be when you get to a certain point well it hit that point years ago and it’s being missed constantly so I’m asking you to look at the way you do things I don’t know how you do them but those things that need to be done please do those first before you do the ones that don’t need to be done thank you that was my only speaker for the consent agenda motion approve agenda second take a motion from commissioner Gand and second commercial Lots repealing all ordinances or parts of ordinances in Conflict here with and providing an effective date and at the request of the applicant this item is to be continued to the February quick comment um because I I have uh communicated with the engineer on this one and and express my concerns about uh this extension you know this is something that’s been sitting out there for a very long time uh when osil was approved back uh many years ago uh things have changed out there uh we it’s developed as residential or Class A uh uh office uh emry Riddle’s currently building another 20,000 foot office building at the coronal Williamson and bevel and um my what I have told the uh the engineers is that that I don’t believe that uh this extension is in the best interest of the of the city I think that that area has gone in a different direction and that the best path forward at this point is simply the start over um the the clearly the setbacks and the the Landscaping requirements and whatnot uh that that they put into play with the race crack gas station uh created basically in isore and uh you know I just do not believe that extension in this case is warranted so when it does come back that’s a position I’ll be taken okay we have any comments questions regarding this issue all right um we uh have a motion we have a second all those who are in favor let it be first speaker is Alan demaras and on Deck is John Nicholson good evening uh mayor and Commissioners city manager my name is Alan dimerus I live at 208 malali Street here in Daytona Beach Florida I am a uh disabled veteran and um I really truly understand the importance of the transitional housing that uh you have been kindly addressing um because fellow veterans uh that I know live in those in a couple of those homes but I also am a a uh owner property owner in in some of those surrounding areas and a property manager along with many other property managers that are concerned about the situation as an owner and a property manager of several properties in the Daytona area I along with other owners and property managers would first like to thank you for addressing this matter our main concern were for the safety of those who reside in the transitional homes and the financial and personal security of those who live nearby you have covered the many bases and the many questions that we have had and um at this moment we only have one remaining question and possibly we could maybe get an answer today or or steer me in the direction of where we could get that answer the question is uh first of all starting that um you have been covering the amount of people that can live in a particular home our question is is steers to operation Operation mushroom that I started to cover all these houses that are popping up like mushrooms um the question is you’re covering the amount of of folks that can live in a home but how many homes are going to be allowed in a certain particular area that is the the question that we have um but once again you have no idea how thankful we all are of the rapid speed that your team has has been covering this manner we’ve just been mind-boggled on that but thank you very much but we just have that question of how many homes would be permitted in a certain area Mr Jagger did we discuss that it would be handled on a case-by Case basis to answer your question so it’s an application process and each applicant would have to fill out formed by the city and and in there would be a questionnaire of sorts and one of the factors which would be considered would be the um makeup of the community whether or not there are other such recovery residences or transitional homes in the area all that would be a factor to be considered by the magistrate whether or not to uh adopt or agree to the request for the regional accommodation okay there’s no specific number okay um in connection with that answer uh Mr Mr City attorney um ones that are already in place uh perfect example on the on the 3/4 block of of malale street that is right next to Brown and Brown it runs side by side the Brown and Brown facility there are three homes that are on that 3/4 area of a block they they have been in place since you’ve been addressing this matter and that specifically the reason why myself and our team brought it to your attention what do we do about those that are already in place sense of inspection and regulation if this if this were adopted if I may answer the question If This Were adopted they would all have to come in and go through the application process and establish um that they are qualified operators and that each of the participants in the living facility have a disability and then uh the magistrate would consider the community and the impacts on the community whether or not it would be a reasonable fit within that Community um so there would be a homestead exemption for those are place there’s no exemption they would have to come in and go through the application process thank you so Mr attorney is is that feasible that some of the homes that are in play right now could actually no longer be there when everything gets rolling is that possible does that exist they app each would be Case by case it’s hard for me to really uh estimated the outcome of those factors thank you pleasure thank you mayor thank you I have a question I’m sorry well based on his question is that something that we can even regulate how many homes to be so in this discussion about recovery residences um yes that is an area which is difficult to regulate in because it’s protected under federal law so we have to be careful about discriminating against those types of group homes so the regul has adopted is not specific as to any particular type of accommodation in other words it applies evenly across the board um I I know we’ve had one example that came in U several months ago where a gentleman was seeking an accommodation because he was in a wheelchair and needed an additional covering over his carport which was not allowed under the code so that’s an example of how this applies equally across the board regardless of disability thank you welcome speak our next speaker is John Nicholson John Nicholson 413 North crvw Avenue uh we’ve been discussing this for about 40 years uh about 20 years ago or so I think Peabody house do you remember Jim uh beautiful home remodeled uh brought back to its original single family home gentleman buys it and while he’s on supposedly while he’s on his honeymoon his friend moves in a halfway house this is how these things get started the make a tremendous amount of money off these things so we’ve been talking about halfway houses for a long time uh Airbnb is another one uh we’re talking about dorm living was the last thing that we’ve been addressing so this does not necessarily address dorm living it does not address um Airbnb it’s specific I believe just to the um uh reform houses the question that that came up that’s is new is can we determine how many can can we say uh 3/4 of the home can be halfway houses or 90% can we limit the to because they are for a lot of reasons um in acids nimes uh Peabody had an awful lot of problem with the drinking and the drugs in the rehab house uh and they would go to the neighbors drunk and ask if there’s work they can do to buy beer and whatnot so they’re not well regulated and apparently we’re not allowed to regulate them so we’re moving problems into the neighborhoods and we’re not addressing them I think there if we’re going to limit it just to this when are we going to get to Airbnb I live in an area where there’s what four airbnbs it’s a tourist area I don’t really mind it other than the fact that they can’t vote we lose all these houses people that can vote but otherwise it really doesn’t affect me but it does affect other areas people that have homes with children Etc and this constant rotation is not good for a stable neighborhood so I’m asking you I realize this is for one thing but I’m asking you to also go to Airbnb and also go to dorm living those are two things and dorm living I would suggest hopefully per bedroom if you have a three-bedroom house to sit there and say you can only use two bedrooms does not make sense you could have 20 people or 17 people as a neighbor they can have 17 children so there’s 19 people living in a house is okay but three people is not it really doesn’t make sense I would really ask you to go one per if if we are legitimately it was built with three bedrooms and three people should be able to live there thank you that was my final speaker Mr Mayor all right you have any discussion or comments on this item so the the resolution before us includes the uh the new uh functional family definition that you circulated today Bob it’ll be up to your motion uh I would say you have an option of either one hting on your motion Aon this was your baby what do you think well I wanted to make something clear I I someone thought that I was advocating for more more people being able to live in a given unit and that wasn’t my concern at all in fact that and that’s certainly not an outcome that I want and if you think the definition would lead to that then I would I would not be necessarily I wouldn’t be in favor of it I just thought that it was entally problematic to Define family and and parse things off that I thought it could lead to results that were um contrary to what we would want like you know an unlimited number of relatives living in one small apartment and not allowing other outcomes that we would want so I I like the definition of that we got here it’s um I think it’s novel I talked with the attorneys about you know where they came from and how they arrived to this so I think it’s novel and IT addresses some of my concerns which is I think just you know our definition of family is changing and evolving and I I want to be proactive I don’t want to have an archaic definition so that we have to keep coming back and revisiting it um so if we were going to do it based on that and I’d like a more flexible definition of this that goes really if it’s the intent of the people to live together regardless of things like gender um I think that’s probably a better definition for family for our as a government as a governing body I think that’s probably a better definition um so I I like this definition but I I I’m not saying anything about increasing the number of people living together or anything like that um I also think that a pure mathematical model would be fine too but um I definitely I definitely think this is a a more um functional definition if you guys don’t think I mean I don’t think it’s too un I don’t think it’s too unwieldy or anything like that I think it it gets past some of the legal problems I thought might arise from our last definition so I I like it um okay commission may have any concerns regarding I’m all right with Bob we still three people I’m sorry we’re still three people um the ordinance as originally drafted which came through on first reading um had within the definition two categories of persons uh which would qualify as a family the first category is your traditional family of persons related by uh law blood marriage or adoption including foster children in the second category was a Max maximum of two of three rather unrelated persons um and then the the option uh which was provided to commissioner dogado dealt with the functional family which is defined in what was passed out at the day tonight so to to recap then the the first reading just had the first two options as your family traditional family and a maximum of three unrelated persons so your answer is yes the answer is yes I want to be clear that we’re voting then on on that first reading if if that’s your motion so that that so I was motion was the second uh Del I was a second all right so I will amend my motion to add the functional family definition to uh this is an ordinance correct I’ll amend my second all right we have a motion in the second amended um all those in favor changing the future land use designation of 2.9 plus or minus Acres of property located on the east side of Ridgewood Avenue North of International Speedway Boulevard and South of Bay Street from commercial mixed use to high-intensity mixed use amending neighborhood policy e with respect to 6.9 plus or minus Acres of property located within the block bounded by Ridgewood Avenue inter International Speedway Boulevard Palmetto Avenue and Bay Street to allow a maximum density of 150 dwelling units per acre and a maximum floor area ratio of 10 repealing all ordinances are parts of amendment is adding the the beex property be building property all of the same parameters are in the original approved PD we just had an out partial we’ve added that’s what we’re doing here tonight so nothing’s changed cuz I never heard how high the buildings were going I can I can go into that with you if you like um or we can talk offline but it’s nothing’s changing nothing I know I asked this question many many months ago you’re going to have to give me a second all right find the building hype place again the reason why I wasn’t prepared is we weren’t changing it it’s this has been some months ago and yes I know I never we answered it by virtue of f limitation not well I showed a uh so something something that is that is has an F limitation it’s it’s based on the square footage of the property and the and the the total amount of square footage allowed so for instance if it’s an acre and we have a 10 f it means we can do 10 acres of square footage of building which as you stack the square footage up you’ll get to a height but there otherwise is not a height limitation it’s an F limitation only am I right about that that’s correct okay and we talked about this month I know and I never got an answer why I’m asking you again still the answer let me ask something paramet based on F not height but you know the so could you could you determine what the maximum height limit is based on that now you can extrapolate based on it if you were building the entire thing maxing out the F what do we get to 10 stories yeah 10 okay so the maximum but again that’s back our way into it so some things are are measured things are measured different so for instance some things are measured by density how many units or F and sometimes we mix those Concepts in this case the F was the difference uh this year I think you see that result refined even more uh it was amazing uh how little uh discussion we had to have with respect to people having issues with you know needed to clean this up or that up uh and um I think that goes into um uh to their benefit um by getting everyone aware of what was required understanding the uniformity of it and um and just making it happen so my compliments to to Jim and the staff and um happy to address any question questions if there are any we have any questions well we haven’t had any questions but uh obviously a great job by all okay I have two additional speakers for this item our first speaker is Patricia herd and on Deck is John Nicholson good afternoon afternoon my name is Patricia herd a22 Vernon Street I’m here representing 560 Dr Mary MCL Boulevard which is known as the Second Avenue classa I’m concerned about the S Festival during by week first I want was a member of s until I was told after going to court with another member that I I couldn’t be a part of St I have Prime Property on the ab and I am not invited to be a part of festivals given by S and a few others which means that my venders must pay more this is the first time that I have I have been told and received a letter from the city that I would have to pay $1,590 for my vendors s is not on the master plan for vendors because they’re having the festival I thought this was the bite week they’re only on the master plan for RV parking yes I want to know what is going on during bik week and btoba Fest while I’m I’m willing to do what is right but it hurts me too and others to know that I’m spending out money for my vendors to be there yes and uh others around bootlegging and whatever else the case might be the people in the community think that we are having bite weat and S is having s Fest stop time [Music] I’m through speaking but I would like to know what is going on with bike week and sammer Fest and Second Avenue Plaza I just found out the other day the master plan of the map that they have is here they have me all blocked in and okay if you I need to have a meeting with you privately I’m willing to meet with you just a second we’ll let him address it either here or in a meeting and then if that’s not satisfactory I guess you could meet with us um mayor Commissioners good evening Jim Morris Deputy city manager first s has a festival permit they use public property and they’re part of the public property plan which you’ll see in the nextg item that you’re coming to so m heard was once a member of s there was litigation between herself and S and as a result of that the settlement agreement took Mrs herd and Mrs White out of s so they could not become members again I’ve looked at the settlement stipulation in respect to that so Mrs herd is participating as a property owner and she can have itate vendors she has public private property so she’s able to have I vendors her vendors pay the vendor fee so the numbers that she she refers to is she makes an application to be in the master plan she’s done that she has the ability to have I think up to three vendors on her property and there’s a per vendor fee for each of the vendors her charge is the same as any other person with property in dayona beach with iant vendors and they pay per vendor depending on the number of vendors they have in her case she had three during October Fest I think she has three planned for this time to my knowledge her property has not been blocked by the S Festival the plan does show dots in front of her property that’s correct and if you look at it it would show that but to my knowledge her property hasn’t been blocked and I don’t think I know Miss hin is here I don’t think that Sama and their activities will block the view or access to Mrs herd’s property which is access from the street but off the street because it is private property and we did meet uh last week talked quite some time about all the details that she’s asking about now and we she was giving the answers last week she didn’t like the answers but she received the answers last week and we’ve discussed it since and I prepared additional information for you if you need it but I think probably the record tonight is completed in terms of what the answers are and of course if the commission wishes or the manager wishes Mrs herd and I will meet again and I have spoken Miss heimes as well in regard to Sama its membership and Miss herd’s former membership in Sama and a litigation that spoke to that and that’s a matter that’s been settled in the courts between s Miss herd and M Mr White okay your time is up Miss herd no I had about you had about 18 seconds will all right we’ll afford you 18 20 20 seconds well I was about to say that I have not seeing any litigations or anything me meaning that that I am not a member they don’t have meetings so that I can go and ask to be a member again or anything so that’s what I’m saying okay I I would uh I would like to and meeting scholarships and everything else not being given okay okay that that seems to be a matter of uh contention and you know you can take that up with us individually I would like to get some background information on this from you in private it’s not necessary here for me I’ll provide to you as soon as possible okay thank you your time is up M and I would like to meet with uh the Commissioners whenever possible as soon as possible especially on uh Miss May and Miss Reed okay perfect what have a question Mr Mars if you would come back pleas What specifically is the issue is it the fee that she’s having to pay as a private partnership because she’s independent of s the vendor fee yes ma’am she’s being charged the same as every every person in town Main Street second avue Mary McLoud they’re all the same as far as private vendors are concerned s took action quite some time ago and they’ve worked with commissions much prior to the time that I came here to work through a festival fee it uses public property It lines the street and gives the instance of activity on the street so the Sam agreement with the city pursuing the resolutions that yall have adopted is different than the fee paid by a private property owner with vendors coming from wherever they may come and typically the private property owner charges the vendor rent and the vendors also pay the fee that is charged to the property per vendor so there’s an administrative fee for application then you have a per vendor fee depending upon the numbers and how the math works out between the private property owner and their tenants the vendors is really up to them and that’s situation m herges in so she has her land her property which is significantly larger when you look at the map and on the S map you can see Miss herd’s property is her property so she’s got the whole bread of her property to work with that’s a different circumstance and the festival approach that basically uses in sidewalks which are public property I’m very familiar with it yes ma’am question um miss her say she owes $1,500 yes ma’am she does and I heard you say that she was limited to three no I didn’t say she’s limited to three I thought she had applied for three okay and that that was the number I believe she applied for that’s what she applied for at mober Fest so there is really no limit to how many vendors you could have on a site there is in terms of the site plan in the space available and that’s what you see in the master plan for the private property you’ll see that each property has submitted plans detailing their vendors layout all those things which is stuff that Mr morone alluded to we’ve worked hard to have a much more identifiable process so that as you go through the week you see that what the commission approved is in fact what’s there and not some morphing which has happened in years past and it may happen again but the effort is to try and make it so that that doesn’t happen is it possible for Mrs herd and another group of individuals to form another organization uh that is similar to S I I I haven’t looked at the question but I think that it may be possible of course you’ve got limited amounts of public property and how the turf is handled is a question the commission may need to address and I will bring up additional details to you when we address the thing I don’t think know that it’s impossible it’s not a question the City attorney has asked nor have I tried to determine that myself but you did say based on the litigation that she experienced with Sal she cannot go back to Sal yes ma’am I think actually they initiated the litigation but the settlement led to some details and I I know Miss Hees is here but it’s passed things for her and just just soon she’d rather not dredg it up in public of course it can be if necessary understand what you said [Music] is not okay okay any other questions no other question you you can ask that’s supposed to be a part of the normal filing and we let her know about that and we do the best we can to shepher everyone along to get things done that’s just the issue the last year what was she was excluded because she didn’t file in time you remember she was in Europe and her phone wasn’t working and things like that and so and the mayor at that time said be on time next time as I recall a Nicholson where you come from John John Nicholson 413 North grandv Avenue um this has been going on for what 402 years that I’ve been here um they started this master plan with the idea of corralling and helping main because for several reasons uh Disney Etc the malls going out uh on ISB Etc uh the merchants on Main Street were having a hard time meeting their taxes keeping their buildings in repair Etc so they have this festival with the idea of cleaning up and I’ve been before you several times with the idea of cleaning up the street and I thank uh Craig McCree and the police department Cod for going through and doing what they did two years ago uh we still have uh Froggies if you look from A1A you can see the side of their building and all that mold I’m asking you that when they go through with these permits and whatnot that they make sure that they are in compliance because that’s the whole idea they’re getting this money we’re bending the rules we’re allowing them to do the itinerate vendors to gain extra fees so when they tell you that $2 million or so that they’re making is not real money it’s not enough it really is the pain building or the pressure clean it so I’m asking you when they’re coming through to take a look at the buildings make sure that there’s no broken windows because an U ruby made a comment about there’s a problem with one of the buildings I happen to see Froggies from A1A so there are things that are applicable to this and lastly I know there are a lot of people that want to get rid of bik week absolutely not I’m sorry it’s just a money generator we may not see as much of it as we’d like on be side but it is a money generator nobody would ask New Orleans to get rid of martyo nobody would ask he to get rid of fantasy fashion and it is stupid if we thought about getting rid of bike we it is a jewel it is a money maker all I’m asking is that the business owners adhere to what they’ve agreed to all right we hold their feet to the fire and it’s about time we look at the original Bike Week master plan and if anything needs to be tweaked now’s time to TW it it’s been 30 years everything needs a little bit of upgrade so I’m asking you carries 60 thank you thank you all right now move on to item number 11 which is our discussion so it’s a city commission Aaron Delgado First Step shelter Inc discussion kick the Hornets excuse me I think I’ve been excommunicated too I got to call um they did I don’t know my um I think I spelled it all out in my letter Gall was a joke um but what what literally happened was I was in court and there was a gentleman who the judge was trying to refer to the shelter and uh no one had any idea how to do it so I thought I would get involved and um when I went to the website to the shelter I saw the different documents that were required in different procedures and uh you know some of the things that were required I didn’t think were consistent with my vision of what a homeless person might have or not have like a you know and you can see it on the website I think I sent that around and that just got me thinking exactly like I put in the in the in the in the letter that I wrote I thought that this was going to be a 24/7 come as you are shelter that would be a pot in your compliant shelter and I don’t think that that’s what we’ve gotten and I don’t I look back at some of the material I look back at the uh kind of the memorandum of understanding or something that we wrote uh two or three years ago when we kind of began this whole thing it was to have you know 100 bed come as you are 24/7 shelter and that’s not what we’ve got as we sit here right now now maybe things will flet themselves out in the future but I was concerned with all the things that I put in that I put in my letter to y’all um but right now I think it’s at 40 people and you know I I I I think there should not be the barriers to entry that there may be right now um you know I I don’t know that the screen obviously everything will be worked out and things will get smoother as we go but I just thought there was a just looking at the reality of what it was today or that day it just struck me as being really disconnected from what I thought was our goal when we when we did this and maybe I’m wrong maybe I missed when it changed but I I thought that was our I thought that was our move forward I thought we were trying to have a shelter that was uh a poent or compliant place that would take people in any you know that any condition I mean not a disruptive condition um and I’m not going to address any of the comments in the paper or anything like that I’m I support the shelter my goals but to support the shelter I’ve supported it from the beginning um so I I don’t really want to say anything to defend myself against the the comments in the paper um that’s not what this is about I just want to make sure that we’re we’re getting what we thought we were getting and that our involvement is consistent with what I thought our involvement was and if I’m the only one who doesn’t think that it’s consistent then you know so be it but I just didn’t know what you all thought obviously I the only way we can have this discussion is in public so I appreciate you taking the time to talk with me about what everyone else’s Recollections were and what your thoughts are with how things are going on and I will also say I think it’s you know a little bit problematic too you know when we have our our City attorney and some of the Dual occupancies on the on the commission may create some problems and you know I I don’t want to put any M Mr May or Mr Jagger in a hard spot by you know asking you to comment on some of these things but our my focus in this position is as a City Commissioner making sure that we’re doing what we said we were do as far as the city so you know that’s why I asked Mr drer to give me the materials that we had going back and he was he was kind of enough to do that but um you know I’m not trying to put you guys in a difficult spot but as far as your Recollections and as far as the documents we executed I thought that was was our I thought that was our recollection and I want to know what we can do if we need to re uh recorrect course so is anyone else is there you know I uh so this morning we had our transportation board meeting and afterwards I had a chance to talk to Dwight for for a little bit and uh you know I shared with him sort of three three issues that I think I I would like for us to kick back to the to the board uh you know one is what what aon’s talking about with streamlining the ability of getting people into the the shelter um Dwight did did share with me excuse me that uh you know it was kind of the intentions of Catholic Charities to make it very tight in the beginning and then loosen it up over time if it was too loose to start you tried to tighten it up later that would be problematic um so I understand that but certainly uh the situation that Aaron ran across you know was something that was was not the way I envisioned the operations um so I do think that you know we have not given the board an opportunity to respond to this particular incident um so uh one of the things I’d like to to ask them to respond to is you know what accommodations what what considerations can be made so that the you know that intake can be uh done in a more efficient manner than you know something that appears to be somewhat burdensome and and timec consuming um I also would like for them to you know have a discussion and in mayor is this hobby because you’re serve on both of them but uh you know reevaluate whether cital Charities is really the right partner um you know I’ve mentioned before that you know penela Safe Harbor which is really a pure jail diversion program not what we’re doing here you know but there6 or $7,000 per bed per year we’re we’re closing it on $25,000 per bed per year the current structure um you know I think that there are um uh you know I think that Dwight had some reservations as well with the uh the types of of overhead and benefits that are being provided by cathal Charities that uh if it was a different operator you might not see they might add another five bets uh you know just by fixing that piece of it but once again I I I don’t want the city to get involved with the operation of the shelter I think that the board is doing a a a Yan’s job and in a very difficult situation but I think that that’s the second thing I would like to have the board contemplate uh and the third and this is sort of and I’m not I’m not entirely sure that I I’ve thought this all the way through but I don’t I wonder whether that board would operate better if it had no elected officials on it um you know with uh uh Roseanne and and Mike on the board now um you know we’re seeing some non-elected folks on there but you know we we haven’t done any any favors to uh Dr Durham or Mr chis Mr Jagger uh because they’re serving two masters in this and in the mayor uh you know they have responsibilities to the city but they also have responsibilities with their positions with the board and I think that if there were a a clearer dividing line you know in Chase and twight the other people on that board the elected folks that are on that board they have the same thing they’re they’re trying to do the right thing as a member of the board but they’re also tring doing the right thing trying to do the right thing as elected officials in their C cities so I don’t and I don’t like I said I haven’t thought that all the way through but you know it seems to me it’s it’s at least a conversation worth having so where where I would like this to go Aaron is to take you know you know perhaps those three things but at least the streamlining of the of the intake and and having to go back to the board and have them have them talk about it because I have a feeling that that some of them were surprised as well um you know this only happened last week I correct so I I think that we owe it to them uh to to allow an opportunity to to to comment on on what happened and correct me if I’m wrong Mr but I understand that right now it’s kind of like there’s a cap at about 40 or 43 people and if we if to go up from that Catholic Charities wants a significant additional sum of money and I guess Dwight Selby also told me that there’s like a 10% kind of uh overhead on every item so on a million dollars is1 $100,000 right there which is quite a few beds for you know even at the there’s a 401k match there’s there’s a lot of things that that are not in my opinion not really regular in this sort of operation it just seems to me like a place like this the economies of scale require scale and we have to get it up to a certain occupancy to to really start to be efficient so I I don’t know that 40 something beds is the right place and I I understood that we were close to that maximum now like we were at close to that capacity Dwight said this morning they were at 39 okay so we’re awfully close to that and so that that was my you know the the number numbers I think at $25,000 per bed that’s at 100 people right 100 beds well that’s that’s what it is right now yeah the the the million one I think it is 45 beds is 24 and change per bed you know in theory if you got as it would become larger and I I don’t recall what the budget was back when it was you know at 80 or 100 beds but it was still you know two and a half three times what what pelis is running at which you know we’re we’re paying for more because we’re trying to do more but two to three times more two and a half to to three times more seems to be exorbitant as it relates to the cost as their costs go off that is not transferred to the citizens of Daytona Beach correct that is the Board responsibility or do we take the the board and Mr Mayor I I hate to speak in your place here but they they have a fixed amount of dollars and they’re operating within the budget the number of dollars that they have the revenue that that exists so right now what that what that will do is I believe 45 beds they’ve said 40 because they’re they’re still breaking it in out there so um but you know if more money were available they would have more beds um you know uh I have not seen anything to say you know what it would cost to run 60 or 80 or 100 uh recently but I do seem to recall it was um you know eyebrow raising significant number of dollars per bed per year um when when we were talking about 100 BS if I recall I don’t know if remember it’s OB or what document it was but the city of Daytona was also allocated they talked about like two types of uh stays one was a kind of the the attorney will correct me and tell me the right name but it was like a rest fit place or resting place and the city was guaranteed a certain number of spots what’s the what’s the term resting space rest we’re guaranteed I think five four spots four spots and I don’t know if that’s still being if that’s still the case right now and part of that was to and those those spots were supposed to have different criteria those were supposed to be um to ensure our poer compliance and all that I don’t know if that’s still happening right now but that’s also an important part of what we paid for because that was that that was that poer safeguard that we used as a r as a rationale for helping to build this and I think that’s also an important selling point to the other cities to participate is that by participating in the shelter I understood it that we were telling people um chip into this shelter and participate because if you do you will be in compliance with this this case law to avoid liability and uh I don’t know if that’s still the case as it’s currently being operated which is I think part of why other cities may not be as willing to participate but I I thought that was an important part of of what we tried to do and probably an important part of why the county bought into it in the first place but I I don’t know the status of those uh resit places um um resting places are is that something that we still have does anyone know it it’s it is a requirement of Le requirement it’s a requirement and part of the lease so we have it as a city as you Illustrated in your uh document the other cities don’t have it um it’s something that the board could consider entering into an agreement with the other cities to have it I uh certainly don’t think that um I don’t think that’s that’s the role that we want to play I I think we want to let them determine that um much of this will work itself out once the facility uh is able to to develop some sort of a uh resting area for lack of a better word something uh that some of you refer to as a as a safe Zone but a resting area and then once a resting area is established uh policies will be put in place that govern that and it will make everyone uh pottinger compliance but I what I do believe overall about this is that there is uh so much it’s just you know and and and I’m agreeable always to have a discussion with those who are policy makers whether they be on that board or this board um and uh the way that I have tried to manage things as these positions is to do what I have believed is Right regardless sometimes I’ve appeared to be on the side of the city other times I’ve appeared to be on the side of the the board is whatever I believe is is right and congruent with what we’ve agreed to do uh on one way or the other what we have agreed is that they would operate the facility uh and I do believe that at this point in time we’re not in complete compliance with what we signed up for as a city and that is simply two things we’re not currently 24/7 and we are not pottinger compliant but once there is a a a a safe zone or a resting area that is established and I have every reason to believe that that will transpire in a reasonable amount of time uh and for me reasonable amount of time I’m not going to put a date on it but what I will say is that a lot of the hardship that the that it seems to find itself in we have to remember as I said during the last meeting how long it took us to arrive at this space in this place uh and so the shelter has been open uh just slightly more than a month well within the first two weeks people were complaining because there were 13 people or 15 people and it’s it’s it’s growing now there’s 40 people okay yes it is almost at capacity uh in terms of what the budget allows and so the board is not going to do anything other than operate according to the budget that it has that we will not and I would not uh serve if we do anything other than that once we are able to uh Galvanize this community and and and and and bring this community together and they we begin to see the need uh then I believe that we will be able to begin to generate more dollars but one of the things that we all must remember is that that won’t happen as long as we remain uh sort of fractured uh and that doesn’t mean that we can’t have discussion because you know as commissioner Delgado said he’s been one of the top supporters of this effort from day one so I don’t see this dialogue or conversation as a part of the fracture but what uh we must find a way to allow the shelter to evolve and certainly uh being in a Perpetual relationship with Catholic Charities is not uh a necessity and and rather that will transpire or not you know I dare not uh discuss that at this time but what I will say say is that um I think that the shelter is off to an excellent uh start but we have to allow it to work out some of the Kink that when there is a a kink or a problem such as the one that you encountered that it’s not something that can be worked out yes ma’am Just for future discussion uh when you go back to your board I’d like to know about the this resting space concept when people go there I’d like to know um do they require identification to enter into the resting space require what identification or any kind of clearance to enter the resting space once the resting space is established then the policy will be established so there is no resting place uh policy at this particular time but we will have to have a policy right and and the policy’s objective will be to make us all pottinger compliant so it is not not so and and you know um the shelter has aspired and I’m calling it The Shelter having aspirations because so many people have voiced an opinion and participated in it into it coming to fruition but it has tried to be so many things to so many people uh and at some point in time someone has to tighten down what it is and that has has to be those that we charg with operating it at the current moment they’re only out of compliance with two things that we from my perspective and rescue me if I’m wrong uh have required and those are the two things that I have uh acknowledged uh otherwise you know this you know discussion you got to let let someone run it I do not under any circumstances uh want this to be a Daytona Beach uh elephant uh I believe it’s a community elephant and we need to allow the community participate in the uh uh eating of the elephant uh and it’s going to take a you know you know more time you know it took us eight years to build this place8 years and and during that time the board was strapped and put into some positions that I won’t call them compromising but they certainly caused a challenge when it took over a year extra time to build the facility and that’s not knocking anyone it’s the nature of you know there are reasons for all things that transpire and so we don’t have to blame anyone but when that happened sure yes it took started to take money and eat away at money that that cost because you thought you would be open S a year earlier or 6 months earlier uh and some of it were was in in the fact that it cost us $6 million some of that was based on decisions that we made so it could have cost a lot less wouldn’t have been the facility that we have now to do the work that we believe that we can do so you have to allow them to do the things that that U that we’ve tasked them with doing and I I believe that that they will the board will rise to the standard uh and Mr may I wasn’t trying to jump the jump the gun and say that you know sky was falling with that I I what happened was when that event occurred and it was it’s a small thing and there’s a lot of little things you’re right we don’t need to get inolved as the city commission whether having a warrant is not extraditable as a problem things like that those are things that definitely policy can be worked out and that that wouldn’t have prompted me to to bring this up what prompted me was I kind of feel like a frog that’s been you know slowly have the water turned up and you realize you’ve been cooked I remember going four years ago with you to um to the county when you were originally asking for this money and I my recollection back then was our the plan was that the cities all the cities would buy in because they wouldn’t have to have their own safe Zone and this would be a a great you know community based thing with all the cities buying in and that was the vision that I that I went with you we fought for and and we won we got what we wanted and you took kind of a drubbing from them about it but you fought for what you bleed and you got it and um you know yeah we had a lot of setbacks along the way but what concern me was I didn’t want the shelter just to be just another another shelter I thought it was going to be something really unique and different because we were going to have all the Buy in from all the other cities and we were going to have this this this thing and one of the reasons we did Pitch it I think successfully in the county was a cost savings with the jail diversion aspect it wasn’t meant to be maybe only or primarily but that was a cost savings aspect to it too and that’s one of the arguments we made was how much money we could save to help justify the county giving us the millions of dollarars they gave gave us so I just thought that looking at what it what was happening I thought it seemed like a shift from what I thought we could agreed that we were funding and you know that that was what I wanted to bring up was I alone in seeing this as a ship um or is it a necessary ship that everyone’s fine with because if all the other five or six of us are fine with it then then so be it but this just wasn’t the direction that I thought we had agreed to what what direction is it though commissioner that you feel that they’ve gone a r or ar stray on because as I’ve said and the board has perpetually said some of this as it relates to how safe Zone where to have a safe Zone uh or a resting place has been a slowful process on the pro part of the board to make decisions because they want to have something that works and it doesn’t doesn’t mess up but we have to remember as I’ve said all along it’s been their intention to handle to to do these things but give it some time that’s all that’s all I’m saying is just give it some time and allow it to to transpire I actually will but the suain answer to your question was I thought the the shelter in itself would be the safe Zone that was P or compliant without the need for anything further and it could be but the the board has chosen that they do not want to co-mingle the the people on the inside of the facility in that way because they believe that they want people to be in the shelter who really want to graduate from homelessness and so there is you know and and so it there is the there was the possibility of that transpiring but we never set in stone any policy edict or directive as it related to our participation as a city those were just things that we discussed as it related to whether you would have a resting place inside outside uh and and I think those things have been left to the board and and and I think it in our best interest now that the board has basically stated that they don’t want to commingle the populations uh because they don’t think it will be uh beneficial to the people who are inside because ultimately the goal of the board is to graduate people from homelessness that’s the number one objective is to bring people in who want to be inside that shelter uh and to help them and then it’s also at some point in time if you get people who come into the safe zone or into the resting area and you can convince them that this is a service that they want but if they don’t we don’t want them just a reality we don’t we that’s what the board is that’s sort of the direction that they’ve taken um and that’s because they want to show that they can turn people over and there there is evidence already in in work uh with with different agents gencies they showing that there is a possibility uh to turn people over and mean by that I mean to graduate them into a better condition people are receiving jobs people are receiving uh uh housing and and vouchers and things of that nature uh are lined up so we just you know that’s that’s where we are okay and I and I hope I hope I’m I hope that everything comes to be exactly as we plan I just was I think and that was also I want I the other thing I would say is I wanted I thought the other cities would uh kind of flop to the banner and buy in and I and that that’s another disappointment to me that that doesn’t seem to have happened but you know I I’ll give it time and see how the how how things work themselves out but you know I hear what you have to say and I guess you know time time will tell whether whether that’s going to happen or not but we I feel like we need the Buy in from the other cities to make it into what we all envisioned it to be and also alleviate the burden from us where I saw this kind of going in a on a Divergent path was when the the board and I understand why they made a decision not to co-mingle the people in the program with the people that are not um but that took away the come as you are aspect of the shelter and took away the pure compliance right um which created this necessity for there being a safe Zone and that was not something that this body ever really contemplated because it was going to be a comes you our shelter and that would be po your compliant um you know I I still have some reservations about about that I think you know where we’ve left that is that the the board is going to send us a proposal um which I you know I voed my concerns about a few of the operational aspects of that um but you know the other the other cities are putting in U about $200,000 in the budget right now the projection for the safe zone is close to that which basically means that they’re going to pay for a safe Zone in Daytona Beach and we’re going to pay we in the county are going to be paying for shelter and that’s not an acceptable outcome for we need to find something that’s a middle ground that we we’re all paying and we’re all benefiting and are we paying for how many years four years do we have four more years of payments total how many how many years do we could you ask a stick your question to that because so we paid I’m we’re like year four right now I think we did not pay one year okay but the County’s money is all is match of our money mhm so if uh you know so we’re kind of obligated to to pay for what this is really year one for the county for another 5 years you know or they’re not going to manage right now there is some debate about whether or not the the the money that we have that’s banked with the shelter of whether or not that that spent in a County fiscal year that County would consider that something that they would match um so it’s possible we could get out of it in four but you know at this point you know I think that we’re you know we’re we’re we’re committed for for probably four or five years and the and I’m going to ask a challenging question the other cities are they also committed the same number of years no or is it okay that’s what I wanted to know so we’re the only ones doing this and with full commitment for the next four or five years in the county in the county and that’s it okay I H okay um we have a board member from the Shel are here uh Miss toror and we would all ask that she uh address the commission at this time and I will be sure not to violate the sunshine and comment on anything that she says that’s why I haven’t said much of anything um with all due respect to the shelter board we are having a meeting on Monday at which time I will show them or tell them all of the things that we are looking into and doing and all of the things that we are going to tell every at that time we have wonderful wonderful plans I deal with a lot of Builders and their clients and so I have a lot of people that um will may be stepping forward but I need to present that to the board so I want you to know that we have huge things to tell you next week thank you very kindly and um someday maybe the community will thank me for asking Miss toror to join the board she’s excellent by the way that’s just my point of saying that yeah excellent okay um any other comments okay um I had one other comment but I’m sure I’ve spoken more than I intended about this and I’ll go home and remember what it was um you know later um all right we will uh have our commission comments at this time we’ll commence with commissioner Reed thank you Mr Mayor I just want to share with you all that we had a very successful freshbook Festival that we helped to co-sponsor started out with a film festival that Thursday night a reception of the authors on that Friday and the Book Festival took place at our Midtown community and educational center on that Saturday Donna Banks continues to serve us well and do an excellent job in regards to that I’d like to recognize Pastor Mulla and the audience as the president of the MLK celebration the city did an excellent job in representing Dr Martin Luther King’s life he and his committee um and Miss Kim Crawford Brown and and all those others did an excellent job uh I really enjoyed the banquet we had several other things that took place the seven word last words of King the March and what have you and then lastly I just want to share with you all forthcoming you will hear more about the how Thurman house uh but on Saturday we had an unveiling of the historic marker which is going to enable us to be able to get some State funds if you’re not familiar with Howard Thurman he is a boy that grew up in Daytona Beach who is a uh internationally known Theologian and philosopher and um like Dr M MCL Bon’s home in our city his house is a Historic Landmark and we unveiled the historic marker on Saturday as I stated which will enable us to be able to get some additional funds uh we’re looking at several things that will come before you from a community garden to a um a museum in honor of him as well as a a historic black museum for some of the things that have just happened in our town that we want to make sure that we continue to Showcase and to remember um so that concludes my comments thank you commissioner trer nothing thank you commissioner Delgado I think I’ve said enough commissioner May um good evening everybody I just want to take a moment to say thank you to the ch chamber of Daytona Beach the great of B County Chamber uh we took a trip to Tallahassee we spent 2 days there uh wherein we lobbied um different representatives and one of the key issues was water um the rivers so thank you so much for bring that to our attention um also the um we were discussing some of the flooding issues that we have we had the executive director Housing Authority with us so she was able to directly address what actually transpires when we do have floods with the Reed Canal area so that was very important to us us also short-term rentals were a huge topic and the new phrase is not to call them vacation rentals or refer them by airbnbs but refer to them as in fact short-term rentals we looking at the legality of that and that’s a big issue for us here and then finally we also address affordable housing and so these are the key issues for the chamber though I just wanted to say thank you so much for bringing mental health into the foreground and making mental health issues a huge Initiative for the local community um valua why because it’s a big issue in schools and just people in general right so thank you so much and um I thought it was a very productive um productive trip yes sir can I just clarify you said sorry thank you thank you so overall I thought it was fantastic and then on the way back I will say one more thing while I was there I took the opportunity to Lobby on the behalf of minor league baseball and the Tortugas and from that position our chamber has really stepped up to support the t’s team in our efforts to keep them in the Daytona Beach area and to help the team that we playing against them so um trugas you have our support and um the chamber thank you so much for that mhm thank you ma’am is that it okay commissioner G you’re not going to talk about the uh the code board the oh my goodness that was exciting all right you deserve to be the one to mention hey I took that as stri okay so let’s just let me just share something with so um you know as it relates to short-term rentals and I call them illegal rentals people who defy the law illegal rentals um just recently actually was present thank you commissioner Gan um when we issued a $10,000 fine so Daytona Beach takes this position very seriously uh the first first violation was 1,000 second was two three and up to $4,000 an aggregate total of $10,000 all right so this is important it’s the first time we’ve actually gone this far and I’m hoping that it lets people know that we do have areas where short-term rentals are legal and they are zoned and we support you in that effort go ahead and do that and then we have areas where those communities have said we don’t want that and so right now the fine was $10,000 y thank you sir and that’s if I’m remember ly that was off of Jimmy an and it was driven by uh by res by complaints from the the people who live it was driven uhhuh yes exactly the reason why these things are are a problem in our community uh just two things uh from this morning’s TPO meeting uh Andy you’re here so February 6th there’s going to be a fot meeting in one of the agend item is going to be the revised lap lap policy so we’re going to want to make sure you know fot putting into play some fairly significant changes uh to that local agency program uh we are lap certified uh only Daytona Beach and County are so uh in valouch County so these would be changes that would be very detrimental to our ability to access those funds um so Andy’s done a great job of kind of commenting and following this but looks like February 6th will be um if not their unveiling of the revised policy the you know some at least some indication as to where they ended up with that and uh the other thing we we just talk about this morning um the the new iteration of the tiger grants is the infrastructures infrastructure to rebuild America infra is the the acronym for it um there evidently is significant local contribution uh local match money required but Jim I just want to make sure that that we’re kind of keeping an eye on that and what the you know whether or not there’s going to be any opportunity for us to participate uh this uh you know the half cent sales tax passed in Daytona Beach uh our voters are just maybe a little smarter than everybody else’s I think and but that would have been a great situation to have some funds to be able to go after those federal dollars uh if we had that that Revenue source and uh you know hopefully the next time that comes around the rest of the county will recognize how how important it is to being able to maintain the infrastructure that we have and also make the improvements that that folks would like to say U that’s it have a good night thank you right thank you had the opportunity to meet with the doctors the administrator the counselors over at hn Health Network um this past week and I’d really like for them to come in schedule uh a meeting where they can come in and maybe present to you all um HIV and AIDS in Daytona Beach is at a Henny Penny the sky is far in epidemic rate right now and there is no way for them to get the word out they’re struggling to get the word out that dayona beach is is we thought would think the numbers were going down but they’re steadily increasing right now at the health department Alone um there are 700 reported cases of HIV and the AIDS and with the health department not having enough counselors the health department gets grants from the Ryan White Foundation and there to have five counselors well they’re they’ve only had two counselors for the past couple years so you have 700 people that they have not including other organizations that they have that are not getting care they’re not getting medicine they’re not getting food vouchers they’re not getting um shelter and it is becoming more of an epidemic hi hi IV AIDS all of the he SE all of the hepatitis viruses are steadily increasing in dayona Beach the reason why and another reason why is because cases are coming from other parts of the county and we’re getting more cases from other parts of the county coming to Daytona Beach um we have a rise in HIV AIDS and he with our teenagers so they are not allowed to going to the schools HIV and AIDS does not have the same face that it had back 20 30 years ago because you don’t see the Frailty you don’t see the uh the the legions you don’t see any of that now and people are living with different strands of HIV and they don’t know whereas back then you knew you could recognize signs of HIV and it also is more prevalent now in in Rising with teens in Daytona Beach because because teens weren’t Avail they they don’t know anything about the HIV scare from 20 20 30 years ago they don’t have an idea of what that was like so um hepatitis C is on he all of the hepatitises are on the rise because uh the doctor said that it only takes the size of a Pin Needle um for the next person to become infected and because of the opioid crisis in suburban homes um hepatitis is now on the rise so um they’ve got their facility is a very nice facility they do all of the Care right there in the facility they treat the patients they have a pharmacy there um they don’t have the shame and the stigma of going to the health department where at the health department you they’re all placed in one room and you’re there with everybody and everyone knows that you’re there for AIDS and HIV so people won’t come to the health department and the health department is trying to get away from HIV and AIDS so they’re sending their people over to h&n so they would like to know and they would like to come in and present and let you know um just some of the things that I’m saying and I’m I’m I’m just the messenger but the doctors would like to come in and tell you how HIV and AIDS is affecting Daytona Beach and how um just within the next year you’re going to see um probably 25 30% increase over what the numbers are now um so they would like for us to know that uh other communities in the state are really big on the world AIDS day and they’re making people aware of Aids HIV and hepatitis and um that they Tona Beach they they just need to know what they can do within the city to let everyone know because uh it it’s a real problem and uh so if if they can come in at the end of a meeting or at some point I would love for them I would love for them to come in and do a presentation so that you all know where this city stands with and it’s not just the HIV th those are the two major ones that they want you to know but um just sexually transmitted diseases are on the rise and they’re seeing cases of babies because parents are not getting tested in the care for the babies so at one time it was almost at a point where you had zero close to to zero babies being tested I mean tested positive but now because parents are not bringing they’re having HIV and they’re not bringing the children in we’re having teenagers we’re having high schoolers we’re having all of them testing positive and that’s something that they I think as a commission we need to address the best we can because I I don’t want that type of EP epidemic in our community because a a a good Community is a healthy Community I Google it because I couldn’t recall but you know the Ryan White Act passed in 1990 30 years ago and we really have made little progress little progress from you know since that time and they’re saying it’s because the face of AIDS and HIV is now changing and people don’t talk about it anymore and and when do you ever talk about Aids HIV I very seldom it wasn’t until that I went in with the meeting and I was like oh oh my goodness weird and so the doctor did say it is Henny Penny the sky is falling wow U well thank you and I certainly would be happy to hear from um those who are experts and have have knowledge just as we heard from the health department and we will hear from the young lady who’s uh going to help us we want to establish the um uh Equity Zone and that’s a whole part of this Initiative for us trying to create a healthier uh happier Community because one of the things is is is knowledge and people don’t know you have to know and they don’t want to sound like an alarmist but some things we have to be alarmed by um and with that uh you have anything else um the MLK Festival MLK activities the ones that I was able to participate were just wonderful I mean um I think from last year’s numbers to this year’s numbers looks like it almost double with the with the March and I want to thank Kim and pastor mgala and um Allan for always stepping up to the plate and and hitting it out of the par when it comes to um making sure this community gets what it needs yeah true that’s true okay that’s it for me thank you um I guess I’ll just uh Echo the sentiments about the MLK festival and uh the activities that were in our community been here a long time and I would have to say that the four events that I attended which were all of the events major events that we had that uh the committee um sponsored and we as a city uh were go sponsors and like to express our gratitude to uh the Hard Rock for being the Platinum sponsor and all of the other people who sponsor they had seven young people that received scholarships of $1,000 and I was at all four events and those young people were at every event every event and then they received another 250 or 300 for um books but those young people were every event and their GPA and their resumés uh were Stellar but I watched them and when I watched them I looked at them I took pictures of them but I watched their mannerism their I watched how they paid attention and they couldn’t have selected a more aute and attuned intuned group of young people who seem to embody uh everything about Martin King’s dream that you want this generation to embody uh so I was happy with it but then also the four events that I attended were awesome every one of them uh I I you couldn’t say enough about how many people attended uh from Our Lady of Lords to uh the last program on the last day pretty much had a packed house at every event uh and it was just phenomenal and I felt uh good uh about Daytona Beach and about the community because it takes a community to make it happen and we have Community uh wheels and one of them I always describe Allan Chapel as a wheel in Daytona Beach because they uh step up and do great things and make things happen uh in I would like to acknowledge the mayor’s Fitness challeng is off to a great start I’m weighing myself too often but um we’re off to a great start we’ve had over uh 150 people to register uh Which is far exceeds any number that we’ve ever had uh Miss Goodman is doing a phenomenal job I don’t know how we can expand our gymnasiums I think that they are uh almost in uh fill the capacity and when I come I have I’ve never been I’m happy I’m just grinning when I watch the excitement and the enthusiasm of those who are attending because they they really are happy and and doing a great job want to encourage folks to uh send their children on Thursday nights to the mayor’s literacy initiative uh we need more and more children uh we need more children we need our churches to get engaged and involved because we have more adults willing to volunteer than we have children now on Tuesday on Wednesday we have ortona things are rocking and rolling doing great there but we need more children because reading is the as I’ve said before and we discussed this last week we need to get more kids involved uh we have we’ve had a good number and the number that we have has been consistent but I want to see 40 and 50 kids at some point in time the goal is that we turn all of the rooms in in the Von Scarlet golden Center who we’re celebrating a birthday I’m unfortunately will not be here uh to celebrate her birthday um but I want to see all of those rooms turn into reading rooms on that Thursday and we ultimately would like to go to more days but we have to have the children come uh and we have to have like I said we have the adults it’s not the adults it’s the children and that that’s it for me you have anything sir no sir uh it’s a pleasure to serve with you all uh I I believe I believe that the um tone and the way that we engage with one another is uh is is is both impressive but more than it is impressive is deeply appreciated uh because we do uh tough work make tough decisions don’t always agree but we do it in a way that is is profoundly professional and and I think it’s uh um indicative of the growth and the progress that our community is making and I think we want to continue to reflect uh the section of the National Council of negro women for those who may not be familiar with that the National Council of negro women is a coalition of women concerned with the welfare of women around the world it was started by Dr mayor mathun in 1935 with the intent of helping people will help themselves the dayon chapter section has existed for almost 75 years we strive to build on the legacy of Mrs Thun by sponsoring many activities to achieve the goals of the organization we have done things such as school supplies school uniforms horse Pats uh socks at local nursing homes thanks giving basket and we also participate in the mayor’s reading Initiative 3 years ago we initiated a school hygiene project providing much needed hygiene resources to middle and elementary school kids but our signature project is the black history brainbow this brainbow is held every February allowing high school and middle school kids to compete for laptop shs tablets and other prizes that will enhance their learning experiences schools such as seab Breeze mland alond middle Dand High Delona middle Allan Chapel black male explorers Delta gym and Delta Academy have participated in the bow and they the winners have received laptops uh and tablets and other projects usually we have had the help of Lo Lo businesses to purchase the computer equipment but this year they have been slow to respond therefore we come here tonight and my members are here uh we came here to make a public appeal to you and to anyone within the sound of our voices to seek support for this project uh if you have any vucha I’m here tonight to present a m multi-action plan to the city of Daytona Beach to reduce plastic pollution in the city through through public information requests which are contained in the folders that I’m leaving the city is not making money on the sell of bottled water the goal is to move Daytona Beach to a green initiative and move towards green tourism multiple speakers will cover all aspects of what I am presenting tonight the folders contain further details as speakers have limited time here after after all we’re discussing long-term economics a cleaner Community cleaner waterways and how the city is viewed in the public eye and this includes tourism we are asking for stopping the sell of bottled water by depleting the current inventory in the city’s possession the number of bottles in current inventory are contained in the packets place a minimum of four water refill St stations strategically throughout the city with the city and sponsors stepping up to pay these are different than the water fountains and allow for reable bottles to be filled cutting down on plastic pollution a local vendor will present an option for reusable items tonight which I just passed in the bags that the city logo can go on as green alternatives for promotion the adopted drain program is to prevent trash as well as protecting from debris washing down drains carrying pesticides herbicides and fertilizer runoff the goal is to keep it out of the canals rivers and the ocean for the chamber and the city to support a restaurant and business recognition program promoting green businesses in the community and finally for the commission to sign a resolution seeking to restore home rule at state level concerning the preempted plastic laws passed in 2008 and to send this to the league of cities which support it meetings have taken place with Jim Cameron of the chamber the beautification board and Keith Willis with Leisure Services the city has nothing to lose and everything to gain from moving forward with this plan other speakers will cover the individual parts thank you thank you um our next speaker is Rebecca shaffy and on Deck is Steve wonderly do we want to ask for like a presentation Mr Mayor if all these how many speakers have signed up to speak on the same item quite a few one to I have these that were marked five how how many cuz you show hands commissioner wants to know how many of you have signed up to speak 1 2 3 4 5 6 7 8 n 10 yeah I would I would suggest that we if if it’s all it’s all for the same thing all the all the talk about your plan that you want to implement can we just have a maybe ask them to give a presentation or something to make a better use of the time rather than break it up among you know 2 and half minute increments that way one person can speak and they can organize it however they see fit cuz I just feel like peppering us if if if it’s one presentation broken over nine or 10 speakers I’m not sure that’s the most effective way to get the information across and I’m I’m receptive to the information I just want to give them a chance to present it in the best way possible and not have to break it up if they don’t want to so we actually have uh four speakers who are covering the plan and the rest are here to just support all right okay okay is that reasonable to you all I mean I don’t you know Miss M like I have students here from high school school who are here speak and they’ve written speeches and they PR okay no no one is going to deny them their their opportunity to speak and I you know we’re fine to hear them I um do you have the four in order though for the presentation it may make it just so that it’s congruent you were one of them I have a um Maya Martinez and icing po Patty there a Delan Pickerton as well Pickering okay she’s not no okay just okay all right okay let’s go okay hello I’m back shafty with dream green valua last time I was here I spoke about our restaurant and business recognition program so I won’t go into detail but the info is in the full ERS that you just received we are asking that the city and the Chamber of Commerce recognize and support restaurants and other businesses in the Daytona Beach area that are swapping out single use plastics for Greener Alternatives both of our models have nine criteria which could be used or the city could create its own program the models for businesses to follow could be posted on your websites for their reference and those businesses could be promoted and supported on your websites and and in other ways you see fit such an initiative would be one way Daytona could promote itself is a green City another initiative I want to talk about is the adopted drain program which many cities are taking on across the country to protect their local waterways many people don’t know that natural debris such as grass clippings leaves fertilizer and pet waste become pollution when they get into waterways since algae and weed speed off of organic matter when algae take over a Waterway less sunlight can get through so plants near the bottom can’t grow this leads to fish and other Aquatic animals losing their habitats when algae die a dead zone is created trash also clogs drains and pipes which causes Street flooding this program could be a partnership with city employees and residents working together any storm drains in the city such as neighborhood neighborhood streets could be adopted generally volunteers take 15 minutes twice a month to sweep leaves trash and other debris off the drain surfaces so far the program has collected 173,50 15 pounds of debris calculated on the low end and Countrywide 10,032 drains have been adopted and there are around 5,813 volunteers data can be entered onto an online database adopted drain. org and a program such as this would add to Daytona’s initiative of becoming a green city thank you thank you thank you our next speaker is Steve wonderly and on Deck is uh sole Sky Rocky good evening uh Mr Mayor Commissioners and officials my name is Steve wonderly I’m at 7-Eleven North Halifax in Daytona Beach I also represent the Sierra Club for Blan Flagler counties and thank you very much for lobbying for our water the uh Sierra Club is taking a lot of approaches to address the single use Plastics problem uh talking to cities we’re looking at legislation at the state level we um endorse the restaurant recognition program we’re talking to private businesses and while I certainly support the efforts that Suzanne and Becca have already talked about personally here tonight I’m not here to request that you restrict any kind of plastic anywhere what I’m asking tonight is that you consider supporting an effort to reclaim the authority that’s rightfully yours uh as uh Suzanne mentioned in 2008 the state enacted a law that prohibits cities from regulating plastic bags auxiliary containers and wrappings for some reason they thought the cities weren’t responsible enough to regulate these things themselves last year they attempted to do the same thing at the state level with plastic straws the house and the Senate both passed legislation that would prevent you from regulating plastic straws somewhat unexpectedly the governor vetoed that legislation this year there are bills at the state level to help to undo the damage of 2008 and return home rule and give you that Authority again unfortunately these bills will likely fail if they do we will try again and how can we increase the odds of them passing we need cities to speak up to endorse these kind of builds so uh Daytona Beach is unfortunately a little behind the curve about 50 cities in Florida have already endorsed a resolutions supporting home Ru of plastic bags so with that in mind I I leave you with a draft resolution apparently you can find it in your mailboxes uh for you to look at and have your attorneys look at and and uh again it does nothing more than offer General support for State legislation which would return the authority to regulate single use Plastics to you thank you for your time thank you and uh you you you say we already have a copy of that he they cop yeah okay cuz I I I support that personally our next speaker is so is it scari scy and on Deck is spraying Kaki it’s skaki hello I’m Saki and I live in new smna beach single-use plastic bottles are a huge problem in this area just walking down any public Street you’ll see an outstanding number of plastic bottles littered throughout the area although it’s easy to blame an individual for litter for littering the the fault is really in the accessibility to these bottles we need better more sustainable alternatives to these single Plastics we need reusable bottles and realistic ways to refill these bottles in public we need reusable bottle filling re station refilling stations rather than bending machines full of single-use plastic bottles thank you thank you thank you appreciate that our next speaker is spring scroy and on Deck is Patty Perry my name is spring scy and I live in newa Beach Florida I would like to to start off by saying thank you for hearing me um single-use Plastics are a very large problem everywhere I go at school I’m surrounded by young adults using plastic bottles water um sorry plastic bottled water and plastic bags at the beach I can’t go for a walk without picking up plastic straws water bottles cups Cutlery bags and more even at home I occasionally see trash in the canal next to my house or that BW into my front yard I think that getting rid of plastic bottled water and installing water bottle refilling stations throughout the city will help the city’s pollution problem drastically it will help the city realize the seriousness of the problem and maybe inspire people to do more to help clean keep the city clean thank you thank you thank you our next speaker is Patty Perry and on Deck is Maya [Music] Martinez hi um my name is Patty Perry and I’m the owner of Red Rhino promotions a local small business here in Daytona Beach we provide promotional custom branded merchandise for clients here in is Maya Martinez and on Deck is Iceland core [Music] um hello I’m May Martinez I live in Norman Beach Florida um the amount of trash in every square mile of the ocean is approximately 46,000 um pieces of plastic just every square mile if you take in consideration the amount of ocean we have there is 6 tril 426 billion 2000 million pieces of trash in the ocean approximately and that’s just what we know of um the am monop plastic in the ocean and on the streets is bigger than a plan the plan wants to address some of the plastic we have and it’s a good thing because I mean Banning straws is probably less than 1% of the plastic out there um Theona Beach could be a leading City it could be one of the few cities in Florida that take the plan and spread it it’s a leading thing and then our water filtration system that we’ve developed um is being filtered into swamps making swamps cleaner making more water re re rehydrating populating our swamps um is the water being properly filtered are we taking in consideration the trash that’s going to go down the toilets or the drains through our septic tanks down our drains are we taking in that in that consideration because there’s tons of trash on the street so we never know what going to be on their swamps and if there’s trash in the swamps then there is no life that is sustainable because it’s being ruined by the trash that we’re taking in and [Music] then plastic is a relatively new thing it’s been invented in the last say 100 years probably not even um we didn’t need plastic before why do we need it now um a plastic band is a hard thing but it’s it’s definitely worth it in the end great it’s better for the younger generation true thank you great job thank you our next speaker is icing core and on Deck is I believe it’s Maris Copeland hi I’m Ash cor and I live in Orman Beach pull pull down the mic just a little as high school I’m president of our Leo club which give me many opportunities to learn both ways Daytona is being harmed and ways we can help this same September Suzanne Shyer came to speak to us about usage of plastic in Daytona as cabb we have begun install and promate water bottle refill stations which as of today have filled up the equivalent of more than 20,000 plastic water Botts if Daytona would promote limiting the usage of plastic water Botts and install these refill stations around town it could cause a shift in the mentality of arrestance which is just this first step of Daytona thank you thank you thank you will say it thank you our next speaker is Marquez copelan and on Deck is Delaney Pickering I’m sorry did did the CBR students have a third student because I don’t have a third paper okay okay she’s sorry my name is Marcus Copeland I’m new to the city um I was born here um my main idea is to like you know get more kids um out of you know privity um get more kids like for try reasons you know like for Daytona Beach police department and consist in I’m ask you guys if you can consist in this um it’s just like something like out of out of hours from between hours 11 to you know like 11 to maybe like 12 or 3:30 or 1:00 they should be in school if they get C out of school you know they go ahead and go to DJJ they get picked up the parents get called the city don’t have to go down for anything or any type of negligence and it’s called basically treny you know I mean that’s just idea that I had drunk drivers there’s more things in that nature it’s just a great it’s a great ordal because it can stop breaking they can stop you know people um from getting robbed bank robberies you know kids for breaking their homes you know just keep the crime rate down and that’s just you know something I address to the city okay thank you yes sir apprciate that you know what I appreciate you taking the time to think that through and then present that thank you so much okay our next speaker is Delaney Pickering and on Deck is John Nicholson hello my name is Delany Pickering I live in Pon sunlet I’m 12 years old um and I moved to Florida about 8 years ago my favorite part of moving to Florida was finding my love for seafood although there is a problem with the fish that we are eating most of the fish that we are eating are contaminated with microplastics microplastic is plastic such as water bottle that that has been broken down for years and has been and has become smaller than gra grain of sand there are tiny shards sh shards of plastic which might look like curl or plankton for a fish if a fe if a fish eats the plastic it can get stuck in their stomach and they can die if we eat the contaminated contaminated fish that have microplastics in them we could get sick too did you know that one study that I just read from National Geographics said that we consume 39,000 to 52,000 microplastics a year that’s insane what will it do to our bodies in the future to reduce the amount of microplastic we shouldn’t get rid of all single use plases I’m a rower with the with Halifax rowing we practice a couple of minute we our practice is a couple minutes from here without the intercoastal my team and I wouldn’t be able to enjoy this sport I have noticed that every time I go to practice I see many people drinking out of plastic bottles This concerns me because single-use Plastics are incredibly harmful to the environment lots of the time I even see garbage overflowing with tons of plastic blowing around and Inter inter Coastal Waterway this is extremely harmful to both the wildlife and environment since our sport depends on the inter Coastal I believe that we should do do our part as a team and clean it up I suggested the following ideas to my coaches everyone uses water reusable water bottles we could ask a water company to donate a water cooler or our yearly Water fee could go towards it purchase a water filter which attaches to the faucet and filters out the toxins those are the most eco-friendly I’m constantly looking for new ways update on the boardwalk it’s been about a year now uh there was some argument about $30,000 for the ordinance trust me it was extremely well spent I walk each morning between 3:00 and 4 uh three nights ago there was one young lady sleeping on the boardwalk uh a week ago there was a guy sleeping in Breakers Park but compared to the 200 or so from last year it’s piece of cake uh there’s a lady at the uh Dollar Store complaining about the number of people that are at our street corners holding up signs for panhandling and I asked her I said that when was the last time you saw someone with a sign with panhandling I said a year ago it was all over the place nowadays I have not seen one in a year uh I’m thank you very much for the 30,000 it is nothing compared to what the city of Daytona Beach raises on the beach side in any given year uh secondly South I want to again mention South Ocean Avenue uh there’s been four or five streets redone in Midtown there are two being redone in downtown there are zero being redone on Beachside uh there I can’t recall when the last time the city spent any general funds on the beach side I think it was in the 80s but I wouldn’t swear to it so I’m asking you to use General funds to do Ocean Avenue it is not handicap accessible there’s one sidewalk on one side which you cannot you get a whech down and there’s no sidewalk on the other I’m asking you to spend some money on beide it’s an investment we still have tourism uh secondly uh I’ve noticed we put three extremely ugly inappropriate lights on the boardwalk in front of the clock tower apparently someone had fallen took a wheelchair and went down the steps with the wheelchair and fell um so they painted the steps white uh they’ll get dirty in a heartbeat and now they put these three ugly fourfront lights they’re just extremely inappropriate and look ugly if you could do something about that I would not want to see those up and down the boardwalk um and lastly if we can spend some money the Streamline put a lot of money into their property and our surrounding area we have a beach approach between Ocean Avenue and A1A the uh ice cream parlor spent thousands of dollars putting in trees you don’t have to spend I’m asking us to do that beach approach to match the counties thank you thank you our next speaker is Lynette Garcia and on Deck is James Schultz good evening my name is Lynette Garcia 623 Orange Avenue I executed an environmental scan of zone six listening to the community re researching historical issues visiting local businesses shops observing educational institutions and historical preservations zone six has failing schools failing businesses lack of business growth lack of transportation for students to D DSC bth Emy real substantial augment augmenting programs public private and governmental programs have left zone six for surrounding zones leaving zone six children without access to alternatives to mischievious activities the summer is coming the summer is coming zone six is a unique Zone it touches Zone one two 3 four and five the surrounding zones build grow develop opportunities as Z six FL floods lacks job development job opportunity and the access two opportunities for growth zone six has a desperate impact for opportunity to self-sufficiency in zone six Economic Development has become Bleak Bleak the most distinguishable commissioner Reed has not addressed advocated communicated most of these challenges that are specific to zone six the zone six commissioner has been has not been available to the constituents on a regular basis the current zone six commissioner has not provided any substantial resolutions for zone 6 in 8 years two terms not to mention providing any suitable Community responses to the criminal elicit thear time is up your time is up I’m no no thank you our next speaker is James Schultz and on Deck is Jenny n Jim schultz7 Harvard Drive it’s always a joy to speak here you never know what you’re going to see here or what uh I also have been dreaming green for a damn long time I was told by somebody that it actually happened they weren’t really right I was told that they Tona Beach had stop coration and then I called and I talk I said no they’re not that kind of folks they wouldn’t do that take a toxin out of the water stupid but anyways I called and I found out you got a batch that was just too damn toxic it didn’t pass mustard so you can’t be adding it now but don’t worry they’re going to work hard and get that Chinese toxic waste and put it in your water soon so de dream green think about that too you talked about getting a filter to take out the toxins ask the city to stop putting them in uh the national toxicology program study uh just well they completed their study and they said fluide is presumed to be a cognitive neurodevelopmental Hazard to humans there’s couple hundred studies that show that it isn’t very good for Animals either but there’s 60 some that show that it cuts IQ in children hey that’s great should we celebrate it put more in the water I think that’s pretty stupid too what I suggest is listen to what so many of the scientists saying the national toxicology program yeah the EPA unions back in 95 were requesting that fluoride be removed because it was a carcinogen they also said it was neurotoxic the US finally did some studies to see if it reduced IQ they’ve got five of them now guess what yeah it does only four to six IQ points I’m sure these kids could get rid of a couple just to get take one for the team yeah and the government okay yeah times up thanks a lot thank you bud thank our next speaker is Jenny nasac and on Deck is Ken Strickland good evening everybody I’m Jenny nasak 501 Harvey first I want to speak out in favor of my colleagues dream green valua and really admire their efforts about the plastic and really support that um as in my capacity as Daytona permaculture Guild I would commit to raising funds to set up one of those water stations and um and I we have one of those at my church they’re really great and it says how many bottles of water it’s saved so far and they’re very cool and I want to thank you all for appointing me to VAB the beautification tree Advisory Board also I’ve been going to those meetings for years years it’s a great place to give input and trees and vegetation I mean they’re beautiful they create shade they’re good for mental health and Public Safety they’re also um infrastructure they are green infrastructure and they are essential in coastal resilience so I’m very excited to be officially on this board uh another environmental Eco isue is historic buildings I I like that there’s getting to be a little bit more focus on on preserving serving our historic buildings and I’m interested in the buildings all along bethon Avenue and so on they’re great relics of history and can we pull together some of the buildings that have been condemned can we pull together to rescue them can can we do something I don’t know I’m just starting a conversation um diversity diversity is Mother Nature’s greatest design principle Mother Nature does things diverse and in February in honor of Black History Month and Mother Nature’s greatest design principal a lot of my eco talks are going to be focused on diversity in various ways so I’ll be Halifax this the third time I’ve been up here and I’m asking for an update on the toilet to tap test it’s ongoing in partnership with the state uh on the back of the first step shelter property there’s an area that is U being cleared for a second borrow pit you can only see it from I4 unless you trespassed um I’d like to know how much dirt was is is um being removed from that plan to be removed from that that bar pit and approximately how much was removed from the first one and do we have a staff member out there that’s monitoring that um approximately what is the the dollar amount that the city will be receiving the other thing eight years to build a shelter and and now we’ve got a board that doesn’t want anybody that’s homeless to be a failure they want to pick and choose who comes in to me that doesn’t fit with coming as you are 24/7 uh a lot of those people that that they may not choose have mental illness problems drug and alcohol problems and to overlook them because you don’t think that they’ll be a success and and pick and choose who comes in there is not right okay our next speaker is margre Johnson and on Deck is Turner hin [Applause] okay then we’ll go ahead the resident uh feel that we cannot guarantee the accuracy of of statements that some of you Commissioners and the mayor are making and I’ve heard a lot of uh inaccurate statements come from some of you in here you mayor Hendry at the last meeting holled out a telephone number we’ve called that number 20 times nobody’s answer nobody got back to us this re same thing May uh mrm and Mr Gill miss m you need to make sure your statements are accurate and that you are proactive you need to do your job that we are P you to do read the residents are paying the bills here you’re supposed to be representing us and resolve our problem your salaries and we are not allowed to have access to our represent that’s the problem I was just telling the lady outside at T 9 News how you all have adour our meeting and let us get speak after the meetings have been adjourned uh this never happened under St Goen they’re going to be recognizing her and I helped get her elected as the first blank mayor of the city of Daytona Beach and uh she was respons for good new man James hman here her and Rick TR and darling another lady I help get elected but scly goldan did an excellent job one time they discriminated against her at the pebody and she had person to cut the lights out and she put them in the dark and they brought her down front she spoke up against anything that was injustice Injustice anywhere is a threat to Justice everywhere we need to have access to our representatives and at this time that’s not happening so I will be over at the a big birthday celebration that they’re going to have for her at the community center on February the 1st she was the outstanding mayor we got our three minutes before and after none of this adjourned meetings and then the residents who have paying the bills going to can speak so I say to you tonight you need to be accessible you need to be accountable and you need to do the people’s business that’s what we pay you to do thank you thank you for
