procedures for tonight’s meeting good evening agendas and all exhibits pertaining to items on the agenda are posted in the lobby persons may visit City Hall during a public meeting to make public comments on propositions coming before the city commission agenda for vote subject to City procedures and all social distancing establishing established by the governor’s executive orders the commission Chambers will be closed to the public city hall Lobby will be equipped with electron and microphone for public comments and an audio video feed to the city commission Chambers yellow forms will be provided for persons who wish to make public comment persons may enter the lobby to speak on an item before the city commission at the appropriate time when called upon for 2 and A2 minutes the lobby will also have a limited defined area with social distancing for persons waiting to make public comment in addition the exterior entryway of City Hall will be equipped with a loudspeaker for persons waiting for permission to enter to make public comment due to space limitations in the lobby persons may also monitor public meetings from their iPhone iPad or other electronic device on the city’s website and enter City Hall for public comment at the appropriate times all persons must comply with social distancing requirements while at City Hall such as by remaining at least 6 feet apart use of facial masks mandated to combat the spread of covid-19 item number seven is your opportunity to address the city commission concerning any item on the consent agenda please indicate on the yellow speaker sheet the agenda item number or numbers of the items you are addressing items or discussions not listed on the consent agenda will not be heard during this comment section agenda items March 17 2020 special City commission meeting and the August 5th 2020 regular City commission meeting so moved second uh we have a motion from commissioner Gillan we’ll take a second from commissioner mate do we have any questions or comments all right all those in favor of approval of the minutes let it be noted by saying I I those who are in opposition uh same sign motion carries 70 now move on to agenda item number five uh it is the approval of our agenda if there are any changes our city manager will address them thank you Mr Mayor uh item 8 R is in the agenda and Ruth trigger’s adding these items to that 500 to the Daytona law enforcement Charities 200 to food brings hope 200 to the Jewish Federation for Lucia Flagler County’s food bank and item uh we’re adding item 10K by October Fest 2020 safety plan private plan public plan and administrative items second second all right we’ll take a motion from commissioner Gillan and a second from I’m sorry commissioner Reed and a second from commissioner gilland uh no no it wasn’t the sound just looked over and saw you you the second uh we have a motion and a second all those in favor Let It Be noted I saying I my apology those opposed same sign motion carries uh 70 okay moving on we have no presentations this evening under item number six so we’re GNA move on to item number seven which is public comments by people addressing the city commission uh concerning items on the consent agenda and I have one speaker Mr John Nicholson speaking on multiple items the door shutting uh there’s several one of which uh there’s like 18 items under the consent agenda which I think is a bit much but there are six on insurance two or three of them state that uh it will have the insurance with the exclusion of a named hurricane or named storm um can you explain why since we get hurricanes and whatnot we don’t insure for hurricanes is it because we get FEMA money or something there’s got to be a reason why we don’t Ure for hurricanes especially the pier uh secondly uh the ice cream truck for the police force uh can that be a little bit of an explanation um there is a 200,000 203,000 for repair uh for the sidewalks uh at the golf course we have a city uh Department that has a sidewalk repair division couldn’t they do it for M much much less and uh lastly the loan for um Brawn uh they’re paying 5 cents per thousand gallons and the residents are paying like $68 as a standard for 800 gallons so um I know they’re getting a deal and I know they’re using massive amounts and I know their loan is for like 30 years so they’re going to pay pay off their initial um investment over 30-year plan but um 5 cents per thousand seems like an awful small amount and considering the fact that we’re adding all that divisions out west and people are worried will we have enough water if we’re giving away thousands and thousands of gallons at 5 cents uh per uh a bit of a problem and I understand when Valia County had Zephyr Hills or whoever uh pumping millions and millions of gallons a day uh just north of Alo County that will affect our aquifer as well so of the money and the water that we have because other people and the population will be needing this water so we have to look like we did with the uh boat slips in the river there was an allocation I think we should look at allocating what we do with our aquafer how much water we have and who can get what thank you that was my only speaker for the consent agenda motion to approve the consent agenda second second all right we have a motion we have a deal but I’m very disappointed in our contractor DME they put together such a wonderful presentation and and um Public Presentation on what they were going to do at Municipal Stadium yet we’re terminating that contract and our Stadium now is is in more disarray than it was prior to the contract so I’m a little disappointed I think from this point on when we make agreements with others we need just be a little bit more Stern in our decision making okay uh all right do we have any other questions or comments regarding consent agenda okay give me one yeah if you can take them and put them in the corners got a lot of speakers inight okay we’re going to move on to our public hearings we have a lot of speakers tonight it looks like our first item is the development and administrative Services planning division project Delta West large scale comprehensive plan Amendment this is an ordinance on second reading public hearing an ordinance adopting comprehensive plan amendments in accordance with chapter 163 part two Florida Statutes adopting amendments to a future land use map changing the future land use designation of 2.0 plus acres of property located on the east side of Ridgewood Avenue North of International Speedway Boulevard and South of Bay Street from commercial mixed use to high-intensity mixed use amending neighborhood policy e with respect to 5.9 plus or minus Acres of property located within the block bounded by Ridgewood Avenue International Speedway Boulevard pometto Avenue and Bay Street to allow a maximum density of 150 dwellings 150 dwelling units per acre and a maximum floor area ratio of 10 repealing all orces of parts of orces in Conflict here with and providing an effective date so moved second all right we have a motion from commissioner gilland and a second commissioner Henry I do have Mr Rob Maro on behalf of the applicant for any questions you have any questions of Mr mer do I have any other speaker sheets for 9A and Mr John Nicholson would like to speak on nine a John Nicholson 413 North Grand View Avenue with regards to this and a future possible maybe project uh about a garage that would help this project uh it was on the mark berer show and everyone calling in was talking about and commenting about the citizens paying for this garage and I would ask Jim to use this time to explain that we paid for garages and got the five buildings in front of my house we forget that the CRA paid into and helped the old Marriott which is now the Hilton Hilton North Ocean Walk Windom and Ocean Walk shops are all done in the same way we would not have that development and allive Beach High would be in really hurting position if we had not done that for those of you who opposed it I ask you to go out to one Daytona remember we gave $20 million for that parking garage if you stand in front of that theater and look around all of that development would not be there remember there were parking lots when GE left it was nothing but parking lots all of that development was because of the seed money that went in and it’s really not money it’s funny money there would be actually no money available if those buildings did not go in and those developments pay every penny of that garage absolutely not a dime of the general fund goes to that development Jim could you confirm that please you did a great job explain that John you know you know I was I want to stop this time could you ask uh wait wait wait you going you’re going to have all your time okay because I was sitting here thinking I’ve been listening to you for a long time and and what you just said I wish that you would that the residents would listen to that because there’s this idea that when you use uh Tiff funding that somehow that it’s coming out of the taxpayer’s pocket but it’s actually money that is that comes in the future and the projects pay for themselves correct but you know we have people who know this in our community but because for some reason they don’t want development they essentially just lie because when you deliberately mislead people into believing that they’re paying for something that they’re not paying for you’re really lying to them uh so what you said today John as a as an old teacher and one teacher to another you get an A+ okay Carry On good job so if you could have either Reed Berger or denn or Jim Morris or yourself explain to the public that really it isn’t General funds at all but these are paying for themselves thank you and and I would add to this as John is saying that because we do have to do a better job of public education and I I said this at the last meeting when we talk about our water and our water quality and we talk about our uh plant that recycles uh water and reuse water uh so so-called sewage to tap water I I would like for us to go a bit further than simply making a video I actually would like for us to to to to create you know a department or not a department but to allow for tours and training sessions so that we can actually teach the residents what’s being done there that this is actually sort of like a lab it’s sort of like an experiment to actually help people who develop the who want to intensify the quality of our water and make certain that long into the future that we’re preparing for the future uh uses of water so I think it’s an actually actually an opportunity for us one to show off the quality of water that we have which is which is among the very best in the State of Florida anywhere best anywhere but definitely in the State of Florida two to show off uh the the fact of of that we are a research facility show off just how great a job we do in as it relates to our water site so I’d like for you guys to sit down and sort of develop a a plan so that we can actually educate our residents in a comprehensive way as it relates to water and any challenges that we have because the reality is that with growth you’re going to have some challenges and we need to be able as a community to decide do we want to take on those risks absolutely correct mayor we’ll try to do a better job uh our um we have a plan to U produce a video for the purposes of education on the on uh on the the treatment process and how it benefits the community and how it could benefit us in the future but we are truly a research arm or the Water Management District in many cases but at the same time we get the benefits of of the outcome of that study and um we’ve got a number of projects like that and we’re going to try to continue to pump in additional information publicly for uh for everybody’s understanding of what we are doing okay thank you any further comments all right thanks John okay he was our only speaker he was the only speaker Motor Vehicles this is an ordinance on second reading public hearing an ordinance amending article 8 Bicycles of the chap of chapter 94 city code to establish licensing and operating requirements for motorized scooters requiring City franchise agreement for micr Mobility Scooter providers providing for impoundment and penalties for violations repealing all ordinances or parts of ordinances and conflict here with and providing an effective date so move okay we’ll be here all night at this pace we have we have a motion from commissioner g land and a second from commissioner mate and I do have a number of speakers on this item Mr Mayor our first speaker is I believe it’s Ty Tyler dony please forgive me if I’m mispronouncing names and on Deck is Jessica gal yes hi I’m Tyler Don okay in regards to the uh motor scooter situation the um scooters are trying to be categorized um and into anything from a Mobility assist vehicle you may be familiar with with your parent come to town and they need to ride because they’re not able to walk up a sidewalk or to their hotel room you’re trying to categorize or group all these into one individual item which makes it hard to make them rentable or even usable for a pedestrian or any tourist that comes to town so by grouping these things into a category and then policing it it makes it very difficult um some of the things should be reread excuse me some of these things uh you’re actually not thinking first before we actually take into consideration what they’re used for uh we do see a lot of that misuse with the scooters that stand up and they’re riding up and down A1A but consider the fact that most of them are tourists if they’re banned from A1A they won’t be able to get from their hotel to anywhere else in the beach so the limitations that this reads into is um quite in cumers of anything or anyone that wants to use these strictly making them usable so in that I would like you to reconsider grouping them into anything ebikes or anything like that as it could affect future use of anyone wanting to do so on the beach something to consider thank you thank you thank you our next speaker is Jessica gal and on Deck is Tim Cameron Kim can you check on that door to make sure it stays open question did we lump them all together the little scooters that he’s talking about as well as the standup ones a scooter is a scooter is a scooter scooter scooter CU he sound like he’s talking about the um like motorized little wheel chairs he says to be physically challenged in getting around he’s not really talking about that but he’s he’s not from what I understood but he’s saying that they use some of them in that way but I don’t but if you want to ask him a question we can call him back there so he can clarify and speak for himself we’ll do that if you want go ahead ma’am good evening Jessica G with cob Co Law Firm 149 South rwood Avenue I’m here representing goex scooter company I’m one of the scooter providers here in Daytona Beach I think the only one for now um but we will see um I wanted to start just by thanking um Commission and staff on drafting the ordinance we think that um the framework that it lays out for the license agreement is really great um and goex is committed and you’ll see tonight that a lot of the local businesses are committed to keeping this use in town um they think that it is a great opportunity for local businesses and residents and visitors um so I just wanted to say they’re committed to doing this safely um and within the bounds that we set forward and I hope that you listen to the the testimony here tonight from some of our residents and we thank you for the time on this item thank you thank you thank you Miss G do you want to ask him that question no our next speaker is Tim Cameron and on Deck is Antoine beron um I own the uh Surf Shop triple X surf and skate on Atlantic and so we rent the goex scooters um it’s it’s a significant source of Revenue in that area I mean most of your people there are tourists so they’re walking so they need something they need some kind of Mobility they need some way to get around and uh it’s a it’s a substantial s amount of Revenue and the way the ordinance is with uh as I understand it you’re your Outlaw electric bikes on Atlantic Avenue too are just scooters is it just Scooters or is it just scooters so it’s like you’re just separating it out you’re you’re you know I mean that’s a excellent source of Revenue and the reason you see so many of them is because that’s what people want to do here I mean the city spends all this money on advertising and marketing for wide open fun and then the people come here and you do everything you can to try to stop that so if you see it everywhere and you see people using it everywhere that should tell you that it’s popular and people you know people want to use it I agree there should be some some regulation on it but uh to just eliminate it and Outlaw it is just other cities have adopted Mobility policies micromobility policies so that works for everyone I don’t know why we have to eliminate everyone here in Dayton and try to cut the businessman out but that’s exactly what you’re doing so I mean it’s a substantial source of revenue for us and on the beach we’re we’re barely hanging on it’s not like you got tours out there that are beating down your door you know I mean it’s it’s not it’s not a good situation all the time so that’s all I have to say I hope you’ll consider it and I hope you’ll uh you know look at the amount of Revenue it generates for the local community and and and and look at the popularity of it and and reconsider the uh the motion so than than you thank you okay my next speaker is Anton B Bearden and on Deck is Jared root how yall doing today uh my name is Antoine beardon I’m the owner operator of dream Reynolds Daytona on ISB I rent the player slingshots and scooters and I’ve been renting the goic scooters for quite a while now uh then pick it back on what the last guy said it does help generate a lot more income for a small business like me and during this uh pandemic it helps a lot U and I’m it’s pretty fun to ride around in it’s pretty safe for a bunch of different people and it’s less expensive than I operate my slingshots in my scooters so it it’s a great way for any tourist residents to get around and enjoy the beautiful Daytona Beach uh I think they are pretty safe from a standpoint uh so um I’m quite sure the the good ordinance can be found out uh but other than that I think um they’re pretty good and I hope you guys consider keeping them here on beach side thank you thank you okay our next speaker is Jared root and on Deck is Andrew capella I’m Jared rou I am a goex employee I work in the operations team just wanted to come out and say that you know we uh do our best to make sure that the scooters every scooter that goes out there is uh safe for the customer to ride uh it provides income so that I can take care of my family uh and uh it generates income for the community that’s having a hard time right now um and you know that it seems to be very popular and I don’t know why it would you know try to take it away from us that’s really I’m not not great Republic speaker so I’m would have pass it to some of the other guys but uh I’m here thank our next speaker is Andrew capella and on Deck is Alex I think it’s dealor hi good evening and thank you for giving us the time to talk about this I’m here representing goex um I’ve worked for goex uh for the past six months now and I could honestly say that uh we take every action necessary to keep these scooters safe we have uh both a mechanic and an operations team not only fixing in uh in uh and uh in the operations teams as well picking up the scooters that are left around the city um All Around the Clock um and uh as well benefiting every uh local business here so so I see how these scooters are important not only for the local economy but they’re inevitable as well as uh as technology increases and uh and the tourism love the tourists love them so um thank you for your time appreciate it okay our next speaker is Alex dealor and on Deck is Brandon I think it’s tet Ral um thank you so much for your time um I’m the founder and Co of goax actually flew in from San Francisco for this meeting specifically and before I kind of go in and tell you about scooters and how amazing our transportation option let me tell you what the mission of my company actually is so a couple months ago I was catching up with one of our partners in Daytona Beach Shores Bob he runs Daytona Beach Shores in it’s a 17 room Hotel uh they go for about $65 a night he lives there with his wife and two daughters over the last three months he made close to $20,000 and it’s enough money for him to that it would take him a 300 nights to rent out in his hotel in order to make the money and he told me straight up he said Alex honestly this year um this is the best thing single best thing that’s happened to my business with everything that’s going on for the tourism indry with everything going on for the country this is the single best thing that’s happened to my business and you guys like a godsend and when I heard that I realize like same same you know you heard from Tim you’re going to see Antoine you’re going to see and hear from a lot of other business owners this is the thing that wakes me up in the morning this a fact that we can Empower these local entrepreneurs we can give them an ability to earn an income ability to keep people on staff an ability to provide something that is safe that is eco-friendly and that is uh um fun for people to enjoy that are visiting the Tona Beach and that are living here as well um and I want to also say you know over this time that we’ve been here we’ve seen over 100,000 rides we’ve seen over 7 100,000 miles covered on our scooters that’s enough to cover the country 300 times there and back and we haven’t had a single person even break a bone so with the all the issues that we have we’re here to work with you we’re here to listen to you and I’m here to make sure that we can make a dream cont for a lot of entrepreneurs and make sure this is a fun reliable and safe option for people to get around thank you okay our next speaker is Brandon tetri please forgive me if I’m mispronouncing and Mickey Pon how’s it going uh I’m a student at Ember riddle here in Daytona uh gox has provided me and my friends the opportunity to transport ourselves from school to the beach we get to go out and eat we get to hang out the beach uh visit all local spots and it’s a uh I think it’s a safer alternative than Uber uh meeting strangers and riding the car and uh an enclosed car with you know Co going around right now um and it’s also environmentally uh conscious there’s no pollution it’s all electric so uh I think allowing goex to continue uh is a step in the right direction that’s all okay all our next speaker is Mikey Pon and on Deck is Ryan Reagan thank you for letting me speak on this item I hope that you all received the letter that I wrote I tried to email it but I messed that up so I delivered it in person and and hope you all got it and it’s signed by by quite a few businesses other than my own my name is Mickey Peterson I own the studio 1 Motel on 1700 South Atlantic and um I I agree with with all the previous speakers here the the feedback from families tourist whatever has just been absolutely tremendous this is Affordable great and convenient enjoyment for people visiting our town and before I became a partner or in this instance it’s with goex I was actually a consumer and had a wonderful day myself my two kids and a friend of theirs and and driving on the beach in Daytona with the scooters down to the boardwalk played a few games drove back to the hotel we were in Daytona Beach Shores used the pool ho back on the scooters drove around again and I think for for three kids and myself I think it set me back like $60 or $80 or something for for the hours we use these and and that is in my opinion affordable family fund and I hear it all day long I own three Hotel locations on Atlantic Avenue and I hear this from consumers from visitors families it’s great they’re having a blast with it um I haven’t encountered any accidents with anybody that’s rented scooters from me uh or or or heard the first I’ve heard of was a gentleman outside um but but I I just think please let this rental structure be allowed by all businesses that’s what’s so appealing that you can take a scooter and they turna Beach yours you can ride down to the boardwalk and maybe uh return it at participating location down there and if you want to go back you can walk back or you can go into a participating location pick up a scooter and ride back so I really hope that you’ll reconsider this and and make it easy for every business in Daytona to participate and um thank you for hearing me out k next speaker is Ryan Reagan and on Deck is Nicholas fice hello uh my name is Ryan Reagan I own vast ocean surfing sub under the sign welcome to the world’s most famous speech I’m born and raised here I’m also an action sports industry consultant I was a former surfing champion on the world tour and I own my own business and this has been the best thing to come along for kids who love activity parents I have the number one surf school and um my my reviews are second to none and I know that everyone loves these scooters they’re relatively safe not to mention the business Revenue that it’s helped we’ve had the um world’s biggest hurricane another hurricane the dead of winter and I’ve lived here my whole life and this is I’ve seen so many people having so much fun on these you can get around Daytona you can see so many more of the sites I travel all over as an action sports industry consultant and they’re in every city I lived in San Francisco San Diego I rep rep uh companies all over the you’re you’re not going to stop this I don’t understand why the city is having a problem I had to actually stop them because the police officers would come to my shop scare my landlords and myself and my clients and bring three police cars and and take them away from me I had to stop because I was scared and it’s just like these are just kids having fun parents are on them I see moms riding them it’s just I just think it’s the best thing since sliced bread or or uh longsleeve t-shirts it it’s a great way to get around and if we can only you know work together on regulations I think that everyone can be happy and I just hope that you guys will please consider this because all the businesses here are absolutely suffering so tremendously it’s unbelievable we’re hanging on by a thread world’s biggest hurricane the another hurricane winter pandemic and I don’t know I’ve spent all my savings just hanging on and this everyone loves these things and just please think about it I thank you very much our next speaker is Nicholas fice and on Deck is rapael quanis so good evening ladies and gentlemen of the board I thank you for bringing our company and also our business partners in tonight so thank you for um hearing our thoughts tonight I would like to start with also like my colleague Brandon we are students at EMB riddle Aeronautical University here in Daytona this company has offered us a great opportunity to advance our careers and I only worked here for two months so far but I built a family here uh everybody that we work with is great and from our operations and maintenance Personnel that we have we ensure that each scooter that we deploy is safe and that’s why we have such a great safety record here in Daytona Beach and at all of our other locations as well because we put care into these scooters we’re not like the other companies that drop them and make it the city’s problem we take them in whenever we find broken ones and we give them the best maintenance that we can and you’ve seen from our business partners this is a great source of anciliary income for them and during these times what’s better than having an extra income for all of these businesses here the tourists love it I’m a college student myself uh the bethon cookman students love them as well it’s a great source for family fun for student fun and it’s a really great source of Engagement for the entire city so and I think that if you encourage it more like I said we only have about five locations in the actual Daytona Beach A1A area not counting Shores Norman if you encourage this if we are allowed to have more Partners on Daytona Beach that clutter that you’re complaining about if you find a scooter or two on the sidewalk will soon go away because there will be more locations for customers to drop these off safely and it won’t be a hazard on the sidewalks or anything like that so ladies and gentlemen I just ask you to please consider your ordinances and work with us a little bit more going for the future and I thank you again for having us here tonight our next speaker is rapael quis and on Deck is I believe it’s kador Salam hello everyone uh my name is rafhael and uh I am I work for goex I am the head mechanic and uh basically our main function is uh to ensure the safety of these devices we uh not only ensure that they are safe for riding they also um the systems that we are that we use to locate this uh these devices to ensure that they don’t clutter the streets and that they don’t stay stranded in places are worked by us we actually spend a lot of time getting these uh these devices to to operate properly uh the brake system the uh the lightning system and and anything that make the right safer for the uh for the user um during the time that I have been here we have we haven’t seen I’ve been working for this company for four months and uh during this time we haven’t really seen major incidents with these devices uh the new devices that we are actually the new uh scooters that we are bringing in now they’re even safer they have better lining they have better brakes they have dual brake system on them and uh they are actually regulated uh the speed is regulated electronically so this uh this if if safety is a concern and it’s something that really bothers or or worries anybody here I can say by experience that these uh by my own experience that these devices are pretty safe and uh that we actually doing everything we can uh to to keep them that way um thank you for your time um I’m hope you reconsider the uh the uh the actions thank you our next speaker is kador Salam and on Deck is George St Pierre hello Commissioners pristine Commissioners and Mir my name is kador Salam I uh I work with goex and I want to thank you first for having me here today um I want to first touch on how goex might have obtained some of the signatures you saw over the weekend or might have received on email um we’re mostly able to uncover our support through our app mainly we also had a team on the ground that was uh meeting with local businesses residents and Riders alike to um to to have them voice their support for for scooters on beach side through this strategy we’re able to collect over, 1500 signatures in support of goex scooters on beach side in exchange for their time and support a $15 coupon code what equivalent of an hour of free ride time was given to them as a way of saying thank you for their support out of the 1500 signatures only 48 coupons were actually used and redeemed which actually proves that the real intentions of the supporters were actually to support our business business model and not for the sake of getting a free ride since March 2020 goex has seen 100,000 rides in Daytona Beach alone that results in $350,000 redistributed upon local businesses in in Daytona Beach during a pandemic our program has helped businesses keep all their employees on payroll and would not have been possible if goex was operating on on Mainland go is fully committed to providing a safe opportunity a safe riding opportunity for all Riders and pedestrians alike with that being said of the 100,000 rides taken in Daytona Beach nine Riders have reported minor injuries such as Road Rash resulting from the use of the scooter we have not had any reports of serious injury in the area or the history of our company on top of that the city of Daytona Beach and local police will have access to our backend to analyze similar metrics like injury ratio average speed most popular pickup and drop off locations frequent riding routes Etc through our program not only have Mom and Pop shops been able to keep their employees on payroll but it has helped take their businesses to new heights we are still able to add drastic changes to our app like requesting driver’s licenses requesting pictures of scooters being parked appropriately dropping speed to 10 mes an hour adding SOS buttons to our app in our scooters the options are endless with that being said I would like to sincerely and humbly ask the city of Daytona Beach to give goex a chance to present a plan for a one-year pilot program on beach side with which will uncover the full potential of our partnership allow local business beat with companies like uber lime and bird thank you thank you sir our next speaker is George St Pierre and on Deck is Betty Joe Salman hello um members of the commission my name is George St Pierre I own Jungle George’s at 1022 m Main Street I have written you guys I have emailed you I’m not sure if you all had a chance to read them all over the past few weeks um I’m not sure which way to go with this it’s I’ve been trying to speak since April besides all the Carnage that I’ve actually seen and the numerous times I’ve been hit when should the city put the money that somebody would make over the safety of an elderly woman or an infant child I have infant Childs that walk out my doorway and my doorway is set off of Main Street and as soon as they step full on the sidewalk they are plowed by a 200 lb man doing 20 M an hour the Carnage is Extreme I’ve been asking for these things to be banned I don’t understand where in the city they would be they don’t want to ride them in the S on the streets for being afraid of being hit and sidewalk is really new no place there’s parts of our sidewalk on Ocean Avenue that are only 30 in wide and you can’t barely put a wheelchair through that let alone an old lady with a walker and a scooter these things fly down the H fly down the sidewalks uh was on the phone on a three-way call with conita with the owner and he said he could slow these things easily down to 2 miles an hour he could have them just in the road but he refuses to do it anything that this company has promised to do with you and promised to do with the city has been a fight my understanding talking with the police department at first they couldn’t even get a hold of who actually own the companies the city does like to look at what other cities are doing San Francisco even banned these things they are trying to rectify it now I was in Las Vegas two weeks ago and there are no scooters there and there’s miles of area to walk and those those sidewalks are huge they don’t want them there most major cities don’t want them there because of the liability that you guys are going to get sued and us as taxpayers are going to have to Fork this out I really hope that you actually do banies on the beach side and be weary of where else you might want to put them in the city because thank you our next speaker is Betty Joe Selman and on Deck is Dan Gardner good evening all thank you so much for having me today um I wasn’t planning on speaking but just listening outside for a bit I decided that I should and everyone outside that was just laughing about somebody getting hit on a scooter is not something that I would find funny um these are the goex guys that are just talking how safe they are they are not safe I have witnessed children 7 years old stop almost get hit there is no helmet there is nothing I have I am I have people that work for us that are 16 17 years old which I have the text here that goex yes first did say they’d send you $15 it does not say coupon the second one that they sent said please send an email to show the support of the scooters in Daytona free to modify goex will send you a $20 coupon so the second text that they got was $20 but you’ve got to understand these children don’t even have license and they’re they’re bribing these kids to come and sign a petition that aren’t even old enough to vote I think that it was mistakenly put out as far as maybe coupon I’m not sure but myself as a mother seeing these children all the time flying through I personally have been hit it is not fun to get hit okay I’m not saying that it I want everyone to have fun and I I hope that there’s something that maybe you guys could do to find a work maybe a helmet might be something to start with if there’s going to be children riding on these things Crossing A1A mind you and we all have children we all have family I am a born and raised Floridian I respect any that you guys say but I would like you to take into consideration that there are children that have signed this petition I’d like you to please look into it further and and seriously with with people getting hit you know at the stores we have kids run in and out all the time and these people have gotten hit and it it I’m afraid that somebody’s going to really get hurt one day but I really do appreciate your time and thank you very much our next speaker is Dan Gardner and on Deck is John Nicholson ladies and gentlemen of the commission thanks uh you know I don’t really have a whole lot to add I’ve been listening to the back and forth and uh I think pretty much everything that needs to be said has been said um I like the idea of the oneyear uh trial let’s see how this thing goes uh we opened our business Daytona Adventures here on uh on cbze Boulevard uh we bought and we maintained five licenses with y’all and I think the deal was is you know we have a license to rent we have a license to sell we have a license to service and repair we have a license for delivery we have another license for I can’t keep track of them all touring uh and the deal is when you get a business license is you’re making an agreement with the city and you’re saying I’m gonna abide by y’all’s rules and if I don’t a code enforcement or somebody’s going to come in and say hey we’re gonna take this license I mean it’s just the way it always worked uh I think gox should be looked at the same way given a given a shot and uh try it out you know make sure they get all the appropriate licenses and let’s see what they can do I think they should be to handled the same way brick and mortar stores are handled uh here in the city that’s really all I’ve got to say because plenty’s been said thank you very much for y’all’s time our next speaker is John Nicholson and on Deck is kall Waters John Nicholson 413 North grv Avenue as you know I live on Beachside I walk as early as 3 in the morning I’m out as late as 3:00 checking on the bars their numbers Etc we’ve already had the trial period for this and the scooters failed they go everywhere they go through the neighborhood and I understand you don’t want them on A1A it’s dangerous you don’t want them on the sidewalks on A1A it’s dangerous so you said okay the only other place is the neighborhood and they go up and down our streets every single hour of the day and the night yes it’s safe there have been only six incidents in which the people on the scooters have been hurt but if there are thousands of people that are tourists and residents that get hurt do we count yes she got hit I got hit I’m walking down the boardwalk I’m on the far left hand the boardwalk is 40 ft wide I’m 3 feet from the edge of the boardwalk there is one foot between my body and the grass there’s a piece of trash I went down to pick it up and the girl on the scooter came and hit my arm and went down and she thought it was funny she circled came back and aimed right at me and I told her I said you get too close to me and I’m going to push you off the scooter you will get hurt you have no right to hit me well she goes to gets her boyfriend he wants an argument he wants a fight I’ve not been in a fight in 50 years and that was a drunk at a bar so I don’t expect to get into fights if not something that should happen on the beach side so when you say it’s okay that it raises a lot of money well so does drugs and prostitutions are you going to allow that the idea that it raises a lot of money is nice but it’s not the end of the day you have to look at what is it happening on the beach side you don’t want them on the streets which is obvious but that’s where they belong you don’t put bicycles on the street you don’t allow motorcycles parked yes but driving on our streets I mean our sidewalks but why would you allow this on our sidewalks and you can say oh no no they’re not allowed on the sidewalks that’s the only place they go that and the boardwalk and they literally harass when they’re four and five and six of them they harass the tourist this poor got harassed by this group there’s no reason why they should circle around and harass our tourist thank you our next speaker is Kendall Waters and on Deck is Dan Ling hello my name is Kendall Waters um I’m a local surf instructor at Tri xx and um I’m here on behalf of the goex scooters um I just want to say first I’m definitely Pro for the scooters because um I am a surf instructor um I ride I skate I scoot i surf I do a lot of different things and um I think a lot of other people like to enjoy those things and so I think that adds value to Daytona City and um to the beach um and I think the majority gets that value from the scooters and I think that’s like the most important thing and um since I was like the only one representing the scooters I feel that uses them that has to say positive things about them I I want to say vice versa for the people riding the scooters there’s some people in the city that don’t like them at all so they don’t give a scooter riders a chance chance and um at my shop we definitely try to make sure everybody’s safe and we definitely show them the instructions and how to properly ride and get off and stop the scooters and I’ve personally been attacked by people who are from the city with bad attitudes and I was able to stop the scooter and get away from them so um I just think they do add value if you want to add value to them um and about the signatures and stuff I definitely think everybody Who provided a signature uh provided their age and I was told by the goex team about that and I was supposed to inform um the city about that because there’s a lot of people in this city from every age that I have put on those scooters and I just want to say I think they’re awesome thank you our next speaker is Dan Ling and on Deck is Todd aers hello members of the board I am a scooter mechanic for business going in on Main Street 610 Main Street uh it’s called life the beach Reynolds I just like you to know that I am for the scooters um we have a drop off point and a pickup point at life the beach and it’s good revenue for us and it’s good revenue for the city um basically I hope that you do not ban the scooters thank you have a good day and our final speaker is Todd aers I’m a owner of Daytona Board Store and I’ve been Renning the scooters since beginning of March and for one when we were closed for over a month it was one of the I mean it generated income and it was one of the things that really really helped us um not only that I know that to ban them on beachs side is absolutely ridiculous because everyone that’s that comes to Daytona they all are staying in hotels on the beach they’re all on the beach side to put them Inland I think you’re going to have way more problems than you would and especially on Beach Street and all that I know that there has to be regulations and to be honest we’ve rented hundreds of scooters and I have not seen any injuries I know that some people that might ride them that you know might not respect or you know whatever that there has to be something fun for tourist to do in town we provide surfing and we provide paddle board rentals and surfr and all that stuff but the scooters are something really fun for the city and as far as the butiti goes and underage you had to provide your age on the on the petition so I’m not sure if the underage stuff is even correct but um and another thing is that I believe that the Daytona is is improving a lot and and and it’s a lot lot more tourists are coming to Daytona and there’s and scooters are in almost every city I think they should be in Daytona and I think they should be on the beach side and I honestly feel like it’s it’s something fun for tourists to do that they don’t have much to do besides go to the beach and go to dinner and so that’s what I have to say thank you that was my final speaker Mr Mayor Mr Mayor could I just real quick Bob can we highlight some of the key points here which is and let me highlight them and tell me if I’m right the the prohibition would be sidewalks A1A and the boardwalk that is mostly right I would add there are a few others uh well I’m not so if you got a a a road without a bike lane that has a speed limit over 35 miles hour would be prohibited I’m trying to hit the just the high points here because I think yeah I heard several people say that they were talking about a complete ban which is not the case so um I that last week or last time you mentioned Mainland we talked about having it on Mainland as opposed to Beachside that’s what I thought I did not know we was we did not say complete ban we said let’s try the mainland first so the ordinance that’s before us what it says is the the the places where they be prohibited are sidewalks A1A and the board one so they would be allowed to operate on Main Street ISB uh Halifax Peninsula you know I’m not sure the speed limits on those but you know they they they wouldn’t those three limitations wouldn’t prevent operation on those beach side streets so what what do you think my thoughts were that um I mean I I supported the idea of keeping it on the mainland because we got some good support from the Commissioners about the universities and going to and from as a Mobility Aid between different communities I was okay with that as a trial period so you know I would really like to hear if we don’t mind it’s our time is moving from a code enforcement officer I would like to know what’s been going on from that perspective because we’ve heard from businesses who are pro we’ve heard from residents and business Merchants have experienced it I’m curious as to what our police force if they wouldn’t mind telling me what’s going on be before you come up were were you done no sorry go ahead this is going to be a little wild conversation I just want to make sure that you you know you can come back okay yeah go ahead come on police captain with the Dayton Department oversee code enforcement um I guess as an update we’ve been um kind of just waiting on your guys’ decision what we’ve seen out on the street is that the goex has not ceased their operation they’re continuing to operate um they they have actually probably expanded locations it’s probably the best way to describe it um um opening up more and more little drop off points within the city with people that are trying to partner with them um it’s created some issues uh related to some abandonment clogging up with some of the sidewalks the bigest issue I think that we’ve seen was this last weekend which is that each time there’s an event or or a large amount of people or a big weekend coming uh the the core area of the beach side is just flooded with these scooters they start dropping them off putting them at the applications putting more and more out there people are picking them up they’re renting them driving them down these sidewalks that are heavily congested with people zipping in and off of the roadway and the sidewalk um wherever they can um creates a lot of issues uh for obviously the pedestrians and the vehicular traffic um for us as law enforcement when we’re working those crowds there was several occasions on the weekend where they would zip in between us as we’re either responding or or moving towards stuff or watching as if we’re trying as as trying to determine what’s going on across the street or things like that um it’s just another thing for us to have to deal with and watch out there um it’s you’ve heard the testimony from the business owners that’s really the best testimony as far as the the impact on on those thin walkways that a but right to the business owners any other questions anybody else thank you you know so I guess that’s sort of of the first question is when we at our last meeting we were talking about a ban on the beach side but what’s before us is a ban only in those those areas so do we want to revisit that which way do we want to go with a you know I mean I don’t think there’s anybody that disagrees we need regulation on this you know and we can get into some of the other finer details later about speed and age and whatnot but this Geographic limitation I think is something we need to kind of get to some consensus on before makes a lot of sense to go forward with getting into those finer details personally I would you know uh we always have the right to change it you know so I would be inclined more towards going with something like what’s before us instead of in complete ban on the be side and if we have continue to have problems you know they continue to ride on the sidewalk for example because once you leave the store with a scooter you know the oper the owner doesn’t have any opportunity to police what you’re doing that falls upon us so if we if we do this and we have continue to have problem with people on the sidewalks then yeah the next step will be a complete ban but I would rather take this incremental step to see whether or not that won’t help address the situation instead of instead of going with what really is kind of a a nuclear option in my mind right out the right out of the gate I have a few questions I’m sorry were you about to say Mr Mayor um well my heart goes out to the businesses that are indicating that um that this is uh been a means of them being able to feed their families and and be able to still have a quality of life however we have to consider all when we’re when we’re looking at this picture and one of my questions is I know we gave staff directives but did we sit down and talk to the business owners to see if there was some kind of happy medium that we could come with or did we just based on what was before us and we gave staff of directive and they followed our directive I don’t know Mr Morris tried to schedule a meeting with them didn’t you with the with the uh with the goex folks I’m sorry can you use the podium sorry about that I apologize they had one representative they did schedule a meeting they canceled the day before and there was no request for rescheduling at least with my office maybe with someone else but not that I’m aware of okay there was one representative and that one went away and someone new came in and I think Jessica gal came on about that time as well and most of the companies that have were the only company name I heard tonight most of them are saying that they use goex are there other scooter companies there are other companies I don’t know if they operate within the city oh okay um I have to agree with Gill land that if we’re going to um commissioner Gill land if we’re going to um consider something to try to alleviate the situation that we’ve had then I would like to take an incremental step like we’re doing this evening I even like the idea of the pilot program but I I’d prefer six months instead of a year to see if what we’re proposing tonight would even work and do we need to come back and revisit this and say forget them all together I think what they didn’t understand was it wasn’t so much about the mechanics they kept having mechanics to come and speak to us it wasn’t the mechanics of it it’s what we’re experiencing and what our people are experiencing being hit then being left at places you know there aren’t supposed to be left there aren’t enough drop off spots and just the concern of the speed and what have you and just what the what the people are doing when they’re having fun on these things that they can’t very well control so I I’m I’m in agreement with what we’re proposing tonight and see how that works commissioner T well I know many of us in fact probably all of us have gotten a bunch of letters from the people uh I counted upward of a hundred some names for up appeared four or five times but they were all form letters to me that is not not it doesn’t count very much to me there were petitions I looked at the phone numbers on the petitions most of them were out of town in fact practically all of them on the letters there were some from Florida some maybe from Port Orange but the majority of them were out of town uh it says is here about 16 years old Tarentum I live on the beach side I live off A1A there were kids riding that who were definitely not 16 definitely not and then it says that they shouldn’t write it on the sidewalks or leave them on the sidewalks well yeah they did says they shouldn’t ride them in the neighborhoods of course they did I mean hollering screaming usually a bunch of at least five if not more um it says that uh they should be 15 miles per hour well those that I saw were definitely more than 15 miles an hour I am um open to like uh commissioner Reed said maybe a pilot program for six months but I I think of the safety of this I think of Daytona Beach being responsible for the safety of not only its residents but the tourists that come here I really do not see with our narrow sidewalks our congested traffic on the beach side I cannot see where this would be safe not for our residents and not for our tourist it might be fun for a bunch of tourists and they say well G whiz this is the way they want to get around well most of the tourists who are lodging on the beach side have come in cars or trucks or Vans or they do have transportation if not you got two feet you can walk it has been done before uh I really cannot see this being a safe um safe fun thing for us to offer for the tourist to do my opinion actually Mr Mayor if I could make one point to those people who sent the emails uh you would address them as mayor Henry not mayor Derek every one of them said mayor Derek mayor Derek like you know yeah cut and paste didn’t work too well for him on that one you know um commissioner Henry or commissioner Delgado uh Mr Mayor yes yeah I’m un sorry I’m unmuting go ahead go ahead go ahead no you first that’s fine so this this has been a really big issue and and a lot of the uh points that the speakers broke up brought up tonight were many of the same points that I brought up weeks ago having known um or feeling like I have a a a good knowledge of how this particular business Works uh with these scooters and uh as of now I I I I really I really agree with many of the issues that were brought up tonight because I have watched this business from different levels and I’ve seen it be successful in other cities many other cities I’ve seen it be successful in college areas I’ve seen it be successful on beach areas and I think maybe we need to go back to the drawing board and um before we complete completely throw this out because I think we can get to a happy medium with this um and that’s where I’m standing right now I’m not really prepared to make a final decision on this tonight but I do think that maybe we can go back to the drawing board because I think that we can find a can agree on something I don’t want to ban it completely um from the Beachside area so I want to see what other options are ail ailable to us okay commissioner thank you and I hear commissioner trager’s concerns and I also uh hear a lot of what commissioner Henry is saying as well and I’m I’m kind of with commissioner Henry in the sense that I’ve seen this concept executed in other cities and there seems to be a demand for this and there seems to be a Marketplace for this what it seems like is that the the rules are not being followed that are currently in place and that people are you know for lack of better word behaving like jerks and I mean that’s that’s a problem that you know if we can solve that we’ll get a Nobel Peace Prize but uh you know I I think I think that enforcement and letting the market dictate a lot of this is the way to that I would approach it and if we’re not if we’re not forcing if the true costs of operating the business are not being born by The Operators then that’s a problem if we need to look at you know proper f or you know somehow you know making sure that they’re responsible for their externalities then I’m fine with that but I I see something that has the potential for success I see something where there is a demand for it and clearly people are saying that this is an activity they enjoy there’s a lot of things that are unsafe a lot of things that are dangerous a lot of things that you know um are risky let the tourists kind of vote with their dollars let citizens vote with their dollars to some extent and let’s make sure that you know we um we don’t just immediately slam the door shut on some that is a promising idea I mean I watch businesses struggle to survive on beach side I watch businesses relocate and move towards the mainland to move out towards the highway you know if there is something uh that can Revitalize you know the beach side if there’s something that can get people you know down there exploring traveling stopping in in little areas I’m all for that I’m not saying that this is the the solution by any means but I’m with commissioner Henry I would like to see us find a way of saying yes and getting this to work instead of immediately uh recoiling from the idea and you know closing it down there’s lots of I mean a lot of the anecdotal evidence that I heard tonight um just seemed like really bad choices that individuals were making or people who were just being difficult um you know I think if you let your seven someone saying a seven-year-old was writing this on A1A well I mean that’s there’s a whole host of problems with that I’m not sure it’s the concept problem as opposed to maybe the parent or the you know that process so to me I think that we should I’d like to approach this from an idea of finding as commissioner Henry was saying a happy medium where we can give this business a chance to see how it works out um and not just you know kind of closing the door on it but I I mean I agree we have to be mindful of the safety considerations we don’t want to you know we don’t want to pass laws that are you know going to encourage chaos and Anarchy but um it seemed like this was maybe I I think there was a lot of hand ringing I’m not sure that it it’s born itself out there was a lot of concern about the truck every time there’s any activity we get a lot of U you know commotion we can’t shut down every single thing and here I think there is a there’s a kernel of a really good idea more than a kernel of a really good idea and this is something that has been done with success elsewhere so I would like to continue trying to find a happy medium I support kind of a test program a test product I don’t know that um you know I think the beach side has some unique uh attractions to it that make it probably well suited to this concept and I think at the at its perfect execution you would want people to do that on the areas on beach side because that’s those are neat areas to ride along those are neat areas to visit and we want people going to Main Street we want people going and exploring our Beachside offerings so I I’d like to continue trying to come up with a solution that lets the businesses um you know work with the city to have a have a uh successful Endeavor while still trying to keep our citizens safe and trying to avoid you know the unpleasantness that we’ve heard about tonight thank you I just had a thought I’m sorry Rob I Bob a question for you so right now they’re not regulated at all right that’s correct so so commissioner Delgado right now they’re they can operate legally by riding on the sidewalk the ordinance that’s before us tonight would get them off the sidewalks you know I I think that’s a very very important thing I don’t want to just leave this wide open until you know we can finally come up with something that’s a you know agre able to you know to potentially both you know or all parties you know I think what’s before us is a reasonable First Step um and and it should be adopted tonight I mean maybe I misunderstand but I mean I I was looking at more like capital L laws like I I thought there were I mean there are other laws that can that a lot of what I heard tonight I thought could be policed or regulated under existing law outside of Oran so maybe I misunderstood the applicability of like you know our general law to that and maybe that’s you know not the way that we want to go maybe we don’t want to leave it up to you know the law enforcement and the state attorneys to regulate it with that level but I thought that some of the behavior that I heard tonight would have been just a violation of a existing state ordinance so you know or a state law so if that’s not the case and if you think that this behavior is is you know there’s not another way to regulate it then that’s fine but I thought some of what I heard would have been improper under our existing law regardless of this ordinance but I I agree with you we we definitely want to have a framework for regulation and a framework for success I wasn’t sure um that like I said I wasn’t sure that some of the problems that I heard um you know weren’t a violation of other laws like certainly interfering with the police officers some of those other things there probably other citations and other um traffic control laws that could be used or could apply so um you know that that was what I thought but I’m I’m certainly could be wrong uh but I’d defer to our City attorney on that issue but that I mean I agree with you commissioner Gan that I mean this is there are some really good um aspects to this ordinance and some things that are that are needed I just wasn’t sure that um there wasn’t other ways to avoid it that was that were currently in place like if those if the people are interfering with the police doing their job I think there’s ways the police can enforce that without without needing this ordinance for example but uh again I would defer to our our attorney on that point you are correct commissioner that um motorized scooters are treated under state law in the same way that bicycles would be so if there was a violation of state law under 316 for operation of a bicycle that would apply equally to a motorized scooter and of course interfering or obstructing an officer is a separate crime uh so you are right to that extent I would like to point out one thing that um perhaps has not been highlighted tonight with regard to the draft that’s before you um it does require all micromobility scooter providers to enter into a license agreement and so we’ve talked a lot about the operational restrictions but uh companies like goex would not be allowed to operate within the city as proposed in the draft unless they had a separate license agreement with the city which would have to come back to you for approval and that license agreement would have additional operational restrictions presumably uh such as how they would be docked and where they would be docked and the pick up and the drop off that sort of thing many of the problems that uh the police department has been addressing would be addressed in those franchise agreements and so I just wanted to uh remind you of that I like that part I had a thought for bicycles you have bike Lanes when we had problems with the kids on the little skateboards we created a skateboard park what if we had a scooter route you know just designated areas painted a certain color like you do curves yellow which would be the only places they could ride these things and when you get off of the scooter route thing then you’re violating you know a policy somewhere that just contains them and and maintains where they could be just a thought just throwing it out there you know nothing beats a fail you but a try Mr Mayor I um I got a question from um a constituent I think is also a good question is the is the technology such that the bikes can have like a a governor or a GPS limit based limiter where we can say that you know based on where you are uh that the speed limit would be enforced by that kind of limiter where uh you know we could say if you’re Beachside or you’re on this area then the this effective speed limit is you know however many miles per hour because 15 miles an hour does seem quite fast but I’m sure people bike on a normal bike much faster than that if they want to but um I don’t know if those devices can be uh can be governed like that with the GPS but I I mean I think those are and those are the areas that maybe we could work with the the vendors on things like that and I think uh commissioner Reed makes a good a good point too that that kind of thinking is a is a good way towards a happy medium but I I just don’t know the the technical aspects of it so if there’s anyone in the U in the industry that wants to comment on that and send me a private email or something like that I would like to learn a little bit more about the technology of that um from some of our providers we don’t have to do it tonight but if they want to get that material to me I’d be happy to hear it thank you I like the idea of commissioner Reed’s idea of a set route uh then the Walkers would also know that that is a set route where you are possibly going to be faced with the scooters and you can avoid that if you want and I also like the idea of a six-month moratorium to come up again um I think that would be a good idea because in 6 months for sure we have a good idea of whether this is feasible for our city or not I mean it might be great in some other cities but that doesn’t mean it’s going to be great for Daytona Beach true Ruth you lost me during the six months so are you saying adopt this for six months to see how it works are you saying you said a moratorium you saying shut it down entirely Citywide for six months I mean it’s six month trial period with under under this set of rules uh like uh Mr Jagger said if we don’t pass this we don’t have any regulations whatsoever I think the answer pass I would like to pass this maybe with some uh like uh commissioner Reid said fixed routes uh six-month trial period uh maybe like somebody mentioned ago governor on less than 15 milph I mean you can always have a scooter without a motor on it but uh I don’t want to leave It Wide Open that they can go anywhere they want any age they want any speed they want um I know bicycles are are forbidden to go on sidewalks in places but nobody seems to have forbidden the scooters to go on sidewalks in places and I can understand they don’t want to go on the road because they think it might be dangerous well for people who are walking on the sidewalk or coming out of a store a scooter zipping down this sidewalk is dangerous and if we adopt this tonight I mean it’s on second reading we always have the right to go back and revisit it you know and and we’ve done this before where we’ve where we’ve adopted things and you know requested at some periodic you know you know 6 months 3 months a year whatever it is a report back from staff on you know what what is what the experience has been so I think that I think we’ I’d like to see us adopt this tonight and ask for a report in three months I would like to make an AM amendment that we revisit this in six months and that they have established routes and that they have less than 15 miles hour the established routes is going to be a problem because you would need to have something like a multi-use path that’s either eight or 10 ft wide so that would pretty much knock it off the beach side entirely well I mean the speed on the beach is only 10 miles an hour the speed is but the established route part I think might be a little more challenging I think it’s a great idea I think it’s something that would have to come in time wouldn’t happen within the next six months but we we need some research to figure out an inventory of where do we have enough width on these pedestrian walkways that you could have both pedestrians and a scooter you know a lot of the places on the each side as you know are were older and they just couldn’t accommodate both exactly so like the gentleman mentioned what Ocean Avenue or something like that yeah yeah but can we uh well we can tell staff to bring amendment to uh revisit this in six months I have a question I haven’t said anything so far so I have a question so regardless of what happens this evening let’s say we adopt it as it is I’d like to know what happens next so everybody goes to bed tomorrow morning everybody wakes up what happens to the scooters are they operating can they rent at that moment operations would not be lawful without a license agreement what other jurisdictions have done is to uh go through the RFP process and of course uh through that process you you select entities which are most qualified to negotiate into a final agreement which would come back to to the city for approval so then this would open it up with the RFP so that everybody understands to multiple entities who are interested in providing Services it would no longer be limited to goex only as it is now correct that’d be correct and in fact right now anybody could come into Daytona Beach and set up shop go to a merchant and start competing with goex and add more vehicles to the roads sideways sidewalks Etc is that right well uh pursuant to a franchise agreement yes but let’s they don’t have one they’re just coming into the market they could do it tonight if they wanted to if you don’t adopt something yes anybody could come in and operate but tomorrow morning if code enforcement sees a scooter and we adopt this what is their course of action what are they allowed to do at that point well um if you adopt this number one every scooter uh within the city would need to be licensed so at that point we would know who the owner is in for enforcement if they are operating in violation of the license agreement other it’s a in other words it’s a rented device they may be impounded and the person providing the scooter would be subject to citation okay I just want to be clear on what tomorrow morning looks like for code enforcement for everybody in the city I just want to be sure I’m understanding what happens tomorrow morning so I just want to make sure I understand so if we adopt this tonight because they have to come with an RFP and they have to be licensed with us that means all scooters cease until that process takes place except for privately owned scooters except for privately owned scooters what about fees B fees there would be a license fees associated with the license and the micr mobility provider agreement would or may provide for a fee back to the city for the right to operate within the city all got to come back all that would have to come back you’re talking about one franchise or you talking about multiple franchises could be either it’s up to you is there is is there a way to um allow people kind of not grandfathered but to give people some opportunity or do we want to let people to continue to operate um if they’ve already been operating while they apply for this this process I mean because otherwise the people that have this existing inventory they would be just dead in the water until they went through whatever process and get that um is it a franchise or a license what’s the ter are we saying it’s a for the city it’d be a franchise agreement to distinguish it from a license that goes on the device like a bicycle license so they would have to come in and have a franchise agreement with the city for the abil for to have the right to rent these within the city and is that like I mean is there any way to is that like a a 30-day process to get approved is there any I mean not trying to hold anyone to to a you know a strict timeline but is that something that one could get done in days or is that week months what do we envision that process being so that if we do pass this or we do intend to pass it people that are listening are given kind of a fair warning of what they have to do or try to do to get uh compliant so they can resume their business operations and RFP is typically on the street for 30 days and of course it takes some time to draft and prepare the RFP uh following the RFP there’s a negotiation process and contract Drafting and so we’re probably looking at a several month period in order to put a franchise agreement in place so Bob could we uh if this were adopted tonight could we take that uh item a the franchise agreement required and make that be uh effective 90 days from today that way that that the existing everything else would apply until that 90 days is up but during that 90 days we would identify the uh the entities that would possibly uh would be awarded a franchise uh certainly you could do that I think that’s a good I mean I I like what um commissioner Gill and is I think the direction he was going with that if I understood it is I would like if we’re going to do that to have something to let the people who have a financial on ongoing financial concern uh avoid a over the shutdown waking up to find that they can’t operate but instead giving them some path forward that they can uh potentially get the franchise agreement with us without uh being dead in the water because I’m worried if we just shut it down then they’ll never come back to revisit it and that you know it’ll essentially be killed I don’t know if they can continue to I don’t know what you know 90 days with no Revenue would do to them I mean there’s already enough obstacles for small businesses like this so I wouldn’t want to impose another obstacle like that unless that was the the intent of the entire commission was to slam that down and say no it stops now and if so that commissioner Gand if you were in favor of that I would also be in favor of allowing um or giving them kind of a a warning period a grace period whatever the term is so they can start uh submitting that paperwork and getting that process going and giving them like you said 90 days or whatever we decide is reasonable 90 days seems great to me to um start applying for and coming into compliance with the the franchise requirement okay um Mr Jager does this mean other other competitors can come into the marketplace at this time then or are we giving preference to the ones exist cuz I want to really understand the franchise concept I I thought if I understood it correctly that we were breaking it up into Geographic areas let’s say so would all the vendors who have operations going right now would they all be allowed to continue or would it be one vendor for a particular geographic area etc etc and then also are there other competitors that want to come into the marketplace who maybe have already looked at Geo fencing who have already enacted helmet considerations who already accept you know a driver’s license or age restrictions who have already um been good actors just as a curiosity in a compet in a competitive Marketplace would that allow them to come in and compete for that franchise license as I understand the suggestion there would be a 90-day period prior to implementation of the requirement for a franchise agreement so during that 90-day period any Prov provider any micr Mobility Scooter provider could come into the marketplace within the city and operate I presume from what I’ve heard that the lure requirement would still be in place during that period so that all those providers would have to come to the city to the police department and obtain a license which would be a a sticker placed on the device uh so that uh that that has several advantages for you it tells you who the owner is because they’ll have to come in and register um and you’ll also get an idea of how many units are on the streets do we have a limit right now commission as to how many units you’d like to see on the street so that’s something again which is a dealt with in your license agreement I’m sorry in your franchise agreement so your franchise agreement would address the other issues in terms of how many units would be made available you could limit that in the franchise agreement uh you could limit it as to area as as you suggested um and and spread the the marketplace among the providers uh or you can allow them all to operate within the same geographical area uh again understanding how many units would be provided but as of right now we don’t have any of that you don’t have any of that currently right I have a question what if somebody rents a scooter in orand or Daytona Beach Shores and comes into Daytona Beach and behaves recklessly so any scooter coming into our city would have to comply with the operational requirements so the user would have to not ride on the sidewalks for instance use the bike Lanes Etc I I am not interested in saturating the market with a bunch of scooter businesses I think this if correct me if I’m wrong that this 90day um preferential little extension thing uh should only be to who’s already existing and everybody else that wants to apply can apply now and they can wait for the the um RFP to see if they are qualified if they come with these additional conditions that you’ve mentioned with the helmets and you know they may be more qualified than what we currently have and that’s just it so we are I see this Mr Jager so we’re allowing if I’m understanding because I’m not an attorney so we’re allowing people who have less kind of structure to operate and people who may have more structure to have to go through a further process and then as of right now if we took out the franchise agreement anybody could just sort of enter in we have no regulation on number quantity location Etc we have nothing there okay I got I got I got one for that too you got them licensed within 14 days so 14 days 15 days from today you cannot license one for the remaining you know 75 days until the franchise Agreements are done so that way the existing guys are here in the next two weeks they get to the PD they get them licensed they continue to operate some new guy wants to come in in three weeks he cannot M so I I’m about the details because I have a feeling they’re going to come back so I’m really curious about this so right now we have roughly eight people that came up and that’s not all of them I’m sure who own who operating the goex in the A1A area how how are we going to decide which one of those eight or 10 or 12 people gets to have the franchise for that area how do we decide that how who makes that decision you will make that decision and the decision we will be made I presume based on the number of units available so it’s not so much who’s providing them maybe it’s more about how many units are made available in the area and once they get licensed we’re going to know how many are operating on the so in all of those Merchants who came in today will in fact be competing against each other for franchise rights let’s called competition to operate freely and on top of that more more competitors can enter the market as well in addition to goex they have how many days for that would you say 14 days or 90 14 days to Li the existing people have 14 days to license the existing scooters mhm the franchise piece of this would be completed in 90 days so at that point now Bob is it the manufactur is it goex that gets license gets the franchise or is it the individual operator the guy on C the guy on ISB could be either or both or uh you could add a requirement that there be a physical location as well within the city I think that’s important my concern is right now we have none of that we have none of that so we are we are um I haven’t said anything during this meeting I’ve just sort of sat back and listened and all I’m asking right now our questions just about how we intend to go about doing this what I find interesting is that not all the merchants who are here today will most likely be able to continue on in business at the end of 90 days and at the same time they’ll be attracting more people which is okay too but it’s just an interesting place that we’re at right now one thing I’d be interesting to see is one you we get through the next 14 days how many licenses do we give out I have no idea how many of those things are over there you know so is it is it 50 is it 100 is it 500 you know and I think that’s going to help guide us yeah we got to get a handle on this thing yeah what kind of fees what kind of fees we well can we stagger the we can we can have the licensing start earlier than the um franchising I mean there’s nothing to prohibit people from going in and let’s start the regist the registration process not to be confused with like vehicle registration but let’s go ahead and start getting count on that I mean I think that’s good information to have I mean I don’t if if all if we just want to get start getting that data I don’t think that would be um a barrier to them to continue to operate it wouldn’t cause them any any problems but it would give us useful information so maybe we need to start go ahead and start doing that you know sooner with the idea that you know they’ll have 90 days to apply for the franchise option but they need to register within you know get the license within you know a short a period of time so that we can start Gathering that information and we can have it when we make decisions about you know what this looks like in six months or a year so I think that would be useful information to know and I don’t know are there are there different types of these devices that have different capacities and that might make a difference too there may be more technologically advanced ones that we are more comfortable with or there may be newer ones that are safer and older ones that are you know less and then I don’t know if the license part would also be an opportunity you know would we have a a city mandated inspection or something like that which you know maybe there’s a feat there or something like that but also a chance to establish certain criteria for the scooter or the device itself so I think there’s nothing wrong with kind of bifurcating out that process of having the uh the licensing and then later the franchising if if if I’m using the right terminology I agree with you commiss I’d like to know you know how many of these are we going to be are we going to be having in the city what kind of shape are they in how old are they you know and I don’t think the only way to really get a good handle on that is to go ahead and get that process started unless the businesses have that information ready for us um I don’t know if there’s like a a Consortium of business owners that can kind of get that data to us to try to make some of our decision making a little bit easier and the RF thank you the RFP would be going out to all of the companies is that correct the RFP goes out to all of them or we just put it out there and then people research it what’s the RFP process how do we advertise it I think we’ve had a lot of great ideas and things that need to be really kind of tied up to just why don’t we just let it continue the way it is now and let us work on you know the issues associated with the franchising the licensing and all those issues because it’s you talk about a lot of different things I I want to get them off the sidewalks I want to get them off the sidewalks tonight so the only way we can do that is pass something I think if we pass this you have to get them licensed within 14 days and you don’t need the franchise agreement for 90 days I think that accomplishes 90% of what we’re trying to do whatever you prefer I can live with what commissioner gillan’s proposing I think that that kind of is a is a happy medium or at least you know I I I can live with that if that’s what we want to do I think that you know if if the safety concerns are Paramount and there’s I think that accomplishes like you said about 90% of what we’re trying to do with the with the understanding that we’ll have a you know a chance to kind of revision this and revisit this and fine-tune it and I mean I would encourage the business owners uh of these franchises to listen to some of what the questions at least that I’ve been asking the others have been asking and maybe you know nominate a spokesperson or do something to try to get us some of this information because there may be some technological solutions and I think it would be helpful to have them you know contribute some of that information to us so that they you know they’re part of the process and not just you know the uh recipients of our decision-making and rulings on high because I I think that I think there may be some some I think they may be willing to or able to implement Solutions at the business level that will make everyone feel more comfortable um and I haven’t heard anything from them like that tonight I haven’t I mean I’m sure they have a willingness to do it instead of losing the business but I haven’t heard anything from them tonight saying you know here’s what we would voluntarily do or here’s how we would address those concerns what I mostly heard is just anecdotal evidence about whether it’s fun or not fun or dangerous or not dangerous and uh I haven’t heard you know a willingness from them to uh help us formulate good safe guidelines and again I’m not saying that they don’t have that willingness we just didn’t hear it tonight uh or at least I didn’t hear it tonight so I would like to I hope that someone will contact me or contact us and try to give us some of that information so they can be a part of that thank you commissioner Henry do we need to amend something to put that to a vote or yes if if that’s your your desire i’ need a motion to approve with an amendment uh to provide for uh a requirement that uh the micromobility scooter providers be licensed within 90 days and that uh all operators uh or all units have a license within 14 days that and the that applies to privately held scooters the licensure requirement yes it does okay both both commercial and privately owned uh Mr Mayor um if I can I I I think that that is the perfect solution thus far and um I’m okay with with what commissioner Gillan has po has uh proposed with the amended changes uh I I think that’s a great middle ground do we have a motion we do have a motion who made the motion can we amend the mo it was commissioner Gillan and commissioner May okay but before we do that uh I don’t think you guys have really traveled that far from where we were you know and I haven’t spoken on this item but I think we haven’t traveled really any distance from where we were in the very beginning other than we have a lot of ideas that we kind of want to add because this is much more complex issue than I I’ve personally given it um although it’s been important but it just got so many details uh but we we did a lot of uh talking but we didn’t didn’t go far and that was kind of humorous to me tonight but at any rate uh I certainly am most concerned about my biggest concern is um I don’t want businesses to think that they can you know I I don’t like it when businesses don’t work with us and they don’t show an intent to be good partners and then they show up with you know 100 um petitions or um emails and a bunch of speakers Mr may can you repeat that I the sound went out can you repeat your comment please I was simply saying I don’t like it when businesses um show up with a 100 uh emails and and they haven’t operated in real good faith so for me it’s a no-brainer that we would at a minimum take these steps tonight they they you know we have to take these steps tonight for multiple reasons one for the safety but also we want to make certain that you know when we put measures in place and we show you that we want to partner with you you need to come to the table and work with us uh because this has been this a problem this is a problem in our community it doesn’t mean that you know we don’t respect business uh we value business and you know I’m sympathetic to hear a guy come up and say that he’s working very hard and he’s invested in resources in this community and they’re now threatened we don’t take that lightly but we also don’t take lightly that we have people who are visiting and all of a sudden they’re in an unsafe situation and you haven’t done anything to try to accommodate that or to ameliorate that situation now one of my uh concerns is uh you know going forward how do we you know when we we got this 90 days they have to now tomorrow begin to operate according to our new rules but what happened happens when they’re because it’s not these folks themselves it’s the people that they rent these devices to and so you know our rules are not really going to make this go away and for me you know yeah the one thing I didn’t want to do is to say that to the police you’ve got to chase down every guy on a scooter um because we don’t need to add that burden mhm to the police and so what I’m saying to you folks who are operating these is that if you want to be successful you had better come to the table and try to help make it successful because if these people continue to do this I’m not going to support keeping them on the Beachside so I don’t know what you can do to keep them off our sidewalks keep them off our Boardwalk stop them from running in the people our citizens like Mr Nicholson I don’t know what you can do I wish you well in your business but if you don’t help us you know I don’t see you surviving on the beach side that’s just my perspective um so I think we have a motion and they’re asking that you you made the second I’d like to amend my Mo motion to uh extend the license period to 14 days from today and extend the uh franchise requirement for 90 days from today and I’d second that motion uh quanita was a second second or withdraw it yeah I would I’ve purposefully not said anything because apparently this has become a Hot Topic the reason it became a Hot Topic in the first place is because I received a text from U business person who said that why was it they were trying to follow the rules they’d been here for a few years and the new business was popping up and not following the rules and why was it okay that they had a cease and deiss Order which they followed that’s what initiated this on May 6th actually to where we are now and so now it’s turned into gox’s feeling I get the sense victimized when the reality is when this first started this was being done to an established business in the first place that’s how it started um on Facebook recently I was attacked because of the goex concept let’s just start there that’s why haven’t said anything right um I will say that I’ve tried to work with goex I so appreciate what you just said about people working in good faith I appreciate that because every step of the way I’ve been trying to work with them have a conversation with them say hey can we try ABC D um that’s all I can say about that the concept of good faith as a business person means a lot to me your word means a lot to me and so far from what I’ve seen and from interactions that I’ve had that has not happened so as we move forward if this is how the relationship starts as with any relationship if this is how we start 3 months from now 90 days from now I’m not sure what that relationship looks like exactly so I I cannot actually second this I mean I’m not quite sure what happens at this point somebody else can just just withdraw it and then someone else will pick it up sure I I have to withdraw it okay elato then I would second that amendment that emotion with the amendment that commissioner gilan proposed okay and Mr Mayor I mean why why we’re doing this and kind of I mean if there is someone from the I me I don’t know if uh you know I mean I would actually call on I I’m not there to see if these people are there but if there is a representative that you know has answers any of these questions you know I we might if we want to hear from them now it would be as good a time as any while we’re about to make these important decisions they may be able to answer some of these questions now and let us make a more informed decision but at this point I would you know I’d like to hear any response any information that the uh businesses have that they want to share with us I would like to hear that since we spent a lot of time talking about things that are going to be uh you know impacting their business that being said again I would second commissioner gillan’s uh a uh amended motion Mr we’re probably gonna have 30 people want I’m not going to let 30 people speak three three may can I make a comment yes ma’am commissioner um I just wish that commissioner May would have um not remained silent and told us that she had been talking to the companies uh and trying to uh work with those particular companies and the experience that she had because I think it would have made a difference and uh I wish going forward that she um will Express that um going forward because it does make a difference it definitely makes a difference to me it has it makes one to me as well because I asked did we talk to this company and now you’re telling me you’ve tried several times to no avail no Mr Morrison attempted to speak with the company they did not meet I then went ahead and said okay let me try to negotiate between a business person in the Community Merchant goex I did this with three different small businesses M I have been in contact with them they have been in contact with me the gentleman who I’ve been in contact with is actually here the last conversation we had was this week where he said to me he’d like to meet with me and I said at this time I am not comfortable meeting with you unless you meet with the rest of the commission first and the reason is that I had reached a point where I no longer felt that we were acting in a responsible way I did not feel that for all the effort that I had put in and time that I had put in trying to work with them trying to find little ways that we could come up with something I did not feel that it was going to go anywhere and I’ve been doing it for a while and when I came this evening it’s because their latest thing was a Facebook message which I think all of us received wherein I was mentioned they also sent an email out I confronted them on the email saying why did you mention me in this email and they said it was a mistake it was sent to me by somebody else I did not appreciate any of those behaviors and if this is how you start a relationship in 90 days I’m not sure what it looks like and that’s commissioner may I wish you would have um spoken up and told the rest of us exactly what your experience was because as I’ve said um just a minute ago your experience with this company or with the the people involved would have mattered to me MH if if that means anything and and it quite possibly would have made me see not see um the actual model as something that cannot be attained but see the relationship with the businesses as something that may be problematic going forward so um I hope in the future that you will trust your cohorts enough um on the diet to to just come forward and say this was my experience so that um so that we will know and we can make better decisions or or different decisions um going forward in my mind goex negotiated in bad faith when they when they have scheduled a meeting with the city and then they canceled the meeting and then never rescheduled it if I’m that guy from San Francisco I’m finding out who that was and I fire him tonight you know because that’s that’s a problem so you know but I’m not I really could care less about goex in this whole thing I’m worried about the small business people that we have in Daytona Beach that are relying on this to pay the rent to pay their utilities to pay their staff you know I don’t want to see them have to suffer because goex didn’t do this in a responsible mature way I want to make sure they don’t get hurt we’ve got a framework here together to where we can get them off the sidewalks that’s georg’s primary concern you know is that we’ve got um you know know the the the unsafe condition it creates particularly in that core core uh tourist area so you know I think we we this is a a good incremental step for us to get we might find out when the franchise agreement comes out that we’ve got it’s still not working and we just canel the whole thing so the middle ground for me last week or two weeks ago was I took a step back was when we decided and you had brought this up commissioner Gillan why not do it on the mainland for period of 6 months and let’s test it and let’s get all our processes in order etc etc the next day I went ahead and I called them and the gentleman is here I called them and I said look this is what happened I need you to understand this is kind of where we’re heading right now can you get some things together to make it kind of work and then in the meantime kind of talk to the merchants on beach side and get make it a nice little transition so six months from now you have helmets you have Geo fencing and it’s ready to go on beach side the response was was and he’s free to respond to this was that they would not make enough money if they did it that way the money was on beach side so that’s where we are with it if if they decide that they can’t make any money by not renting to children or not being you know being able to operate on the street and they pull out then they pull out okay all right I think we have a question on the floor as it relates to some of the speakers uh I’m not going to listen to 16 or 20 speakers so you we’ll listen to a few people how many do you want three you guys can dis discover between yourselves who you want to speak for you I think she represented them didn’t she you represent the the okay recor Jessica G Copco Law Firm 149 South rid Avenue um I was brought on about a month to a month and a half ago um to represent goex they did have previous Council before me um I think that’s who Mr Morris was referencing for that meeting um to start out I just want to apologize I know there have been some permitting issues that’s where I first came into this I’m working with planning staff to make sure that the use as it is currently unregulated it’s still regulated by zoning so making sure that was in the appropriate area um from there I know that commissioner May has been in discussion with kador and Alex and if they want to speak directly I have not been involved in those discussions I apologize for that as well um we’ve also discussed the need to talk more um I think that this my perspective was this was a starting point um we needed to sit down with captain Lee after this we need to sit down with Commissioners to kind of put that franchise agreement together and see how we operate a few weeks ago we did share a safe operating plan um that they put together that kind of dealt with some of these issues speed limits Geo fencing um to answer commissioner delgado’s question those are technologically possible um they can drop speeds to any speed that the city finds appropriate um within certain boundaries and that technology exists now they can do it through their app interface um if you want to speak to them directly they are happy to come and respond to comments I just wanted to put that on the record okay yep that’s enough for me you I don’t do you want to allow any other speakers or is that commissioner still up there yes yes she’s still there Council I just have two simple questions I don’t know if you can answer this or not my first question is you said the devices can be governed uh with GPS for the speed or they can be governed just with speed period And my second my second question is do you have an idea of how many scooters um would be how many commercially owned scooters would be licensed if you can answer either of the questions um absolutely or if you think the question needs to be rephrased to make it more meaningful please feel free to do that no it’s perfect um so the technology exists that you can create what they call a Geo fence um that limits location and speed within that location um so this was in the safe reopening plan that they started to put together um in hight traffic areas where there’s a lot of entertainment districts or bars um limiting the speed to like 10 mes hour after midnight um was something that they discussed it’s not in the ordinance but they thought might be a good step um so that is definitely possible um they can even do it to where the scooters would shut down once they’re outside of a specific Geo fence um would they be able to limit density too like could they say if there’s more than 20 scooters in an area more than five then the scooter additional scooters won’t operate if we have concerns about density I am not sure on that but I will let them speak on it if they have that information probably is to you the number of operating C area yes hello Commissioners thank you for having me again um we can limit um well not completely limit as in Kill the scooters completely once there we have multiple scooters in a specific area but we can dispatch and we can be notified once we have five 10 or even 20 scooters within a a certain a certain radius and this is very could be very easily done through my phone um as for the stuff you guys mentioned from reducing speeds um in different in different areas is also something that is um very easy for us to do um so the answer to both of those questions are yes and then sir I have a if if then would you be able to say that a scooter has has had a zero speed for more than 30 minutes it’s therefore you need to come pick it up things like that you know as your software intelligent enough to say like we know the typical use patterns and so if the bike doesn’t move and has a zero speed after 45 minutes that we can say that it needs to be picked up and if we have 10 bikes in one area we can alert someone to come you know pick it up so we don’t end up with a bunch of bikes left all over the place and things like that is that within your technological framework 100% sir we actually also have very similar notifications that we receive sometimes scooters do end up staying um staying active when Riders are actually not um not using them so we’re notified that the scooter hasn’t been in use for more than 10 minutes and we’re immediately um able to lock that scooter and pinpoint where it actually is so yes okay great I mean I hopefully you’ve heard some of the concerns we have and and you know I think uh you know it seems like technology can solve a lot of these problems but uh you know maybe I would like to you know know more about the technology of this because I think that’s a lot of the solution can lie in there so you know I for one if you would like to contact someone to explain it I would be happy to hear from you and your Council knows how to get in touch with me um do you have do either you or your Council have an idea of how many um Scooters or I’m sorry devices would be uh commercially licensed in the uh Daytona Beach area at this time respectively as of now sir um we currently have um roughly 150 scooters deployed in in in between Daytona Beach Daytona Beach Shores and Orman Beach so it’s not such such a huge amount of scooters um we can um we can definitely L um I’m sorry could you repeat your question sir no that that was my question how many scooters you thought would be licensed um commercially in the next you know next week or so like what how many commercials how many commercial devices were in use in the Daytona Beach area you said about 150 between the shores here and Orman so um you know that that’s a perfectly accept I me that’s an answer as far as I was concerned yes sir um adding on that sorry to interrupt um that is obviously um a fleet we currently have um as we’re moving closer to the slower Seasons um as we get closer into the um the more popular and and and spring and summer seasons we would we would like to increase those licenses to anywhere between 20 two to 150 to 500 if needed but obviously this um this number would uh fluctuate depending on um on season depending on events and obviously we can work with the city on I I know that of the police uh chief of police mentioned that he had some issues with um scooters being um located located in clusters um when when you had events like the past weekend on Labor Day weekend we can actually work with the city um in advance on those weekends and actually plan with you guys together and work out a way through technology as you mentioned commissioner to make sure that scooters are not clustered and left all in one area can I ask a question so are you saying that during your peak times your busy times that you would actually reduce the number of of scooters because we have so many more pedestrians are you saying you would increase them because we have so many pedestrians we would increase them but we would increase also um regulations as far as our technology um we don’t want to we don’t want to obviously flood this the the streets with scooters where you have three or four scooters laying on every side of every every corner of the sidewalk um we want to work with you guys to obviously figure out what’s the optimal number to have in the high Seasons I mean 500 is just a number I just gave um I would definitely like to work with you guys understand um what you guys think and what your infrastructure would also allow this is the first time we’re meeting but we’ve had many many conversations the last conversation we had I asked you why you chose Daytona Beach do you recall what you said why you chose Daytona Beach to come here because we have many other cities and you’ve been in other cities why did you choose us well off the bat commissioner I can tell you there’s nowhere else in the United States at least I’m aware of where you can ride um any kind of vehicle on the beach and I haven’t tried that anywhere in my life before coming to Daytona and there was nothing that actually um matched that so I think that itself provides a huge um value to the amount of tourists that come over here specifically for the beach um and I guess that is a huge reason as to why you guys being a beach beach area and you guys being able to allow scooters on on beach that was part of your response the part that put me off was when you said it was because we had no regulation and that it was a completely open market and I said to you I asked you other cities that you’ve gone to you’ve benchmarked this what were some of the things that did not work and that you had to improve on and you told me things like helmets and goo fencing and things like driver’s license and age restrictions and time of day and I asked you given the fact that you knew that why did you not come here with the best possible package that you could give us um so commissioner um one thing I think you did not mention uh in this meeting is that I did actually reach out to you personally many times as you’re probably aware and I provided you with a safe riding plan um that me and which I forwarded to the City attorney immediately got it and um so I I we tried first um obviously it it might have been a bit later than what we actually started I do agree with you um but I did reach out to commissioner May personally and knowing that she was the district on beach side and that was our main our main uh main business area practically um so I did try to come up with a saf writing plan and uh I’m I’m I hope that everyone else did receive it as well and we haven’t started implementing them um this was just some of the ideas we were open to start easily implementing um some of them is requesting driver’s licenses even geofencing and I mentioned this to commissioner may even geofencing sidewalks we can limit speeds as as uh as people get onto sidewalks we can Li limit speeds to 2 to three miles an hour it might take a bit of work on our engineering end but this is also a possibility that we are able to do but you could do it before and you chose not to do it that’s number one number two is this you know I did not appreciate the whole Facebook situation and then emailing that to the rest of the Commissioners I don’t know what that was about I didn’t appreciate the email that you sent that you later apologized for and I thought to myself here I am trying to help them now to point out that I am trying to help your company and try to help you did I or did I not get you a business on the mainland who I thought would be ideal locationally right off Beach Street access to the park in order to help your company did I do that you did okay so I’m not against you but what I did did not appreciate was the relationship that you failed to build that part really put me off from a business position that’s all um commissioner May um in the room I want to I was standing outside I’m the founder and CEO of goex um first and foremost I would like to apologize to you commissioner I’m really sorry that we failed in the end of the day the buck stops on me and so it is my responsibility and we failed you and for that I apologize I apologize if we did not meet your expectations I approached the people who were complaining about scooters and asked them like please tell me more and I was listening to these concerns and it was the first time I’ve had this conversation with them personally and for that I sincerely apologize and if you whatever that we save I just want to make absolutely positively sure that this is not going to hurt us in the long run because we went through the pandemic so I want Jim to be honest because he’s leaving it really doesn’t matter you can be honest if he thinks that the next Comm uh next manager can do the following year on this budget I’m fine because he just talked about lowering it even further I prefer a small increase every year than a 27% tax increase I’d rather do a half a percent than 27% so if I understand you all are looking at the pandemic and all the problems Etc but I don’t want to tie the hands that we cannot function fully so Jim can we function fully with this budget this manager can okay thank you good answer that was my only speaker on this item and Fred how much uh are we looking at in new construction uh tax revenue we have more money the one number I didn’t memorize um I think somewhere in the neighborhood of 1 milon1 a half million somewhere in that neighborhood of new construction it’s the most it’s ever been since I’ve you know we’ve been having a nice growth you know but that’s one of the reasons why it’s manageable to go even though it’s slightly below rollback below rollback because we have all that all the the the new tax base so and and therefore it’s important to understand that’s why you have to have some measure of growth in a year like this and what we’ve been able to do over the last several years uh and to John’s point we have been you know doing just what He suggests but now is a time when you know we’re in unprecedented times and we have to be considerate of of our residents and be grateful that we’re still experiencing growth other places are not experiencing uh you know positive growth in this way Mr and there’s a study that’s been done that when you have ponderance of Dollar Generals ringing a community they will not in fact come in because they cannot compete with the um price items in those stores I’m happy to bring that research into you I’m just putting it out there as a FYI didn’t Palm coas or somebody just put a moratorium on dollar stores yes no and isn’t there there’s one at Derbyshire in Mason Dollar Tree I think no it’s not Dollar Tree just like either Family Dollar or Family Dollar but it’s the same concept yeah and there there but there’s one at Derbyshire and LPGA yeah but they’re surrounding the community and this is not necessarily a good thing if we’re trying to bring in grocery store just putting it out there well I agree with you and I think that’s actually a good uh point and one that we should maybe take consideration of because it’s not healthy it doesn’t you know it benefits them but it doesn’t really benefit the neighborhood in the community so I I’m I’m open to a conversation and looking at the research and then considering if we want to consider what Palm Coast did Mr that’s a I’m sorry a dollar what is this one a General Dollar General Dollar General is that one at the corner of um Mason Mason and um Derby yes andwood Mason and brenwood and Mason and Nova right there in that Plaza Mason Mission this 7 right we know where it is okay I’m sorry I didn’t think you did I’m sorry yes sir we just trying to see how many more we we’re close can you hear me I’m sorry I was talking to Mr Mars go ahead oh oh okay I was saying um there is there there seems to me to be a Dollar General within one mile of where this Dollar General is going um and I think in certain communities we’re we’re just throwing up these Dollar Generals and these Family Dollars in these dollar stores and we’re not doing it in other zones and other communities and I am 100% against another Dollar General right there in in that area you have one that’s less than a mile away you have a Family Dollar that’s less than a mile away and we’re just throwing them out there and I totally agree with commissioner May’s um perspective on this and I don’t want to see another Dollar General I’m not going to support that tonight and then there’s something at derash and um LPGA that just went up if I if I may mayor step in here so you know you have remember with regard to zoning we regulate the use not the user right and so if you’re interested in regulating and sometimes these are referred to as small boox General Stores we don’t call them do Dollar Generals as a you know a matter of regulating the industry um but for a small box General retail what other jurisdictions have done and what I presume Paul Coos is looking at is kind of a separation requirement for that category of business so if that’s something you’re interested in we could look into that and work with planning department and drafting a regulation uh which would be probably the more appropriate way of addressing the issue okay let address appropriately and Bob we’re on first reading here what’s our well of course on first reading we move these forward uh I would I would recommend approval so that the applicant can have their due process heard on second reading that would be the public hearing that’d be a public hearing right the applicant and also the public would have a chance to speak at that time now if we if we wanted to uh deny this in the future would it be best for us to have the separation rule in place that’s the proper way of addressing limiting this category of business well how do we do that before this second read or in the future you wouldn’t be able to address it for this particular use and and the zoning regulation on this would allow multiple uses not just a general store if you will but PDG it is a PDG but in the PD it allows multiple uses different types of retail guarante there’s no no guarantee and certainly gues of this no I I agree with you and you can look at the public benefit and weigh that against um underlying zoning I think is right the underlying zoning five residential five yeah they’ve got a mixed zoning on this so there may be some issues to address there as well in terms of what their available uses are under their exist look at it we can take a look at it here and if there are other things that we can do one of these box stores located on the corner of uh LPGA and derish which is right outside of our community but remember when you talk about things like trying to construct affordable housing units in certain places when you don’t have uh a grocery store within a mile you don’t have a pharmacy within a mile of certain locations MH you can’t you can’t attract affordable housing because they can’t uh take advantage of the uh various incentives that the government allows so we have to uh look at our total zoning in order to accommodate our bigger goals and that’s a much bigger goal than uh you know not have a Riverfront view there is another location in which uh if we were to locate them in built a garden apartment it would be cheaper to build uh all of those units in a garden setting with a pool a gym and all the other uh amenities that would normally go with a AAA location it would be walking distance the six restaurants a grocery store shopping centers two bus lanes and other amenities they do not equal the view the wior meley has a 7-Eleven 7-Eleven cannot compare with an Aldi when they renovate they’re going to renovate probably what $40 million to those two units to me the logical thing is to return it to private hands so the city generates 4 million bucks a year and they would save money by selling that property building on another property at even a cheaper rate than 40 million and gain the value of those two buildings it she said it cannot be happen could not Happ and she would not pursue it I understand what they’re doing I don’t know the total areas that they’re looking at but we have tons of locations that we need to fill downtown Midtown in the areas that are vacant because when you fill them with people the stores that are around them continue to stay open the more we vacate inner city the downtown those stores are struggling and they will close so I’m asking hopefully that all of these are built between Nova and Beach Street between Mason and uh bevel that is our core area that is the area that is emptying we need to fill them back in thank you this is go ahead this is in my zone this is in Midtown does he not know where Peto is um plan and mayor I have a number of speakers I didn’t know if you wanted to take them first before we sure let’s listen to the speakers first well no we have to listen to the will the speakers know the presentation I don’t know about that normally I would rather listen to the presentation okay cuz they don’t know what the presentation is okay okay mayor and commission I’m Jim Morris Deputy city manager Lorie Campbell Baker from the CVB is at the podium you have the staff report and materials from my office I would say that a number of people have withdrawn from the original submissions which is why you’ve seen steady revision of what was in your agenda there is not a staff recommendation in regard to the safety plan the biketoberfest plan has been modified some by withdraws as I mentioned already that’s noted in your agenda items and I would yield to Miss Baker and let her make the presentation to you okay thank you sir good evening mayor Commissioners and City staff you’re going to hear from a lot of very passionate business Representatives tonight um and we believe that all of the businesses um that are in the master plan and throughout the community are very much committed to the safety of a bober Fest this year as you probably know and I’ll just go through this quickly bober Fest was created by the conven in Visitors Bureau about 28 years ago patterned after Bike Week a smaller event to be sure and the dates are set well in advance bober Fest is not one event but rather a collection of events created by businesses throughout the Bela County area and Beyond and the CVB itself doesn’t create or produce or manage any of these events it just simply supports them uh the cvb’s efforts are all about economic impact our last study in 2019 said that visitors to our community spent about $6.2 billion doar um businesses employed 58,000 residents with a payroll of 770 million today we know that a lot of those same businesses the restaurants retail attractions and hotels and their Collective employees are very much struggling so biketoberfest was created as an economic generator to give locals businesses AB boost dur during what was once a a pretty soft fall season the event now um on a good year creates about $16 million in economic impact and of course these days those dollars are extremely critical just a quick reminder of how the city’s master plan process works the city itself establishes the master plan guidelines and creates the application and even sets the deadline the city staff works with us on the bike C Fest committee um in meetings with the city businesses um on their applications and then the CVB then collects those applications sends them back to City staff in Mass for review then City staff sends the master plan to City commission this year of course with covid-19 a bit different um we were asked the CVB to come back to you with the safety plan and that’s where we are tonight this safety plan um is related to the private property master plan um there is of course a separate master plan for the public property the vote um is about the applicants that are requesting approval for special uses of their private property for bober Fest this year and each has agreed to abide by a safety plan we believe that these business businesses are fully committed to doing their part to make this a safe safe safe event safety is Paramount and I can’t say that strongly enough and since this pandemic began our tourism and hospitality industry has really stepped up in a big way to keep our guests and our employees and our destination as safe as possible um so these local business owners are taking the situation very seriously and safety will be a focus as we move forward in all tourism efforts um that said the CV has not advertised by October Fest this year uh instead we are using our owned assets our social media our email database um to reach out with the idea that if people will be visiting we fully expect them to visit responsibly and that is what the safety plan is all about so I’m going to run through just the the high points of the safety plan which is in your pack um it starts with an alternative traffic plan for Main Street um instead of the two-way traffic it allows expanded pedestrian areas um limited on street bike parking and one-way traffic flow and you have that diagram in your packet um all biketoberfest master plan applicants will agree to staff and maintain controlled limited entry and exit points to their businesses they will adhere to a 50% occupancy level for their businesses and they will post appropriate signage they will ensure that all patrons entering use hand sanitizer wear face coverings and maintain social distance they will ensure a minimum of four hand sanitizer Andor hand washing stations they will require their employees to wear face coverings and before commencing work they will check their employees temperatures they will San I restrooms door handles and other frequently touched surfaces any seating will be arranged to um accommodate a minimum of six feet of social distancing they will not have live music and entertainment entertainment or DJ’s um ambient music would be allowable um and they would follow the city of Daytona Beach resolution requiring people working living visiting or doing business in the city of Daytona Beach to wear a face covering in any indoor location um they will also agree to promote the stepup volucia program which is wash up mask up backup campaign um so we have put these together in the Octoberfest 2020 master plan safety plan um that the applicants I believe there are 13 of them now um would agree to if that is your pleasure again you’ll hear from many of these businesses and what they plan to do but the whole idea was to come forward to you with a plan that ensures that you know we’re taking this very seriously Lori of the 13 how many are public and how many are are private they’re all private I think yeah the only one that’s um maybe the Ocean Center is is technically public but with a private usage Lori do you know if uh Orman has voted yet on this Orman Beach has voted and they have approved itinerate vending and concerts I don’t know the specifics though okay and that happened tonight y um well um does anyone have any questions for Miss Baker all right I just don’t know if we should do this or not I mean U stures had a surge after about 2 three weeks after their their event uh we had the truck and the Labor Day weekend this past weekend I really don’t know what we’re going to find out in two or three weeks for our residents um frankly I’m very worried my big concern is is for the safety of the residents of Daytona Beach I know this means a lot economically to a lot of people but generally you can as I said before you can recover from economics you can’t recover from Death should we hear from the speakers yeah that’s correct uh yes we should uh all right we’ll come Henry and uh Commissioners uh Mr Chisum City staff my name’s Tom guest and uh okay I I’ll remove this so you can hear me my name is Tom guest and uh I reside at 721 Garden Lane in Norman Beach uh I manage businesses at 608 through 618 Main Street in Daytona Beach and uh as one of the people that started uh by toer Fest nearly 30 years ago and as current chairman of the btoba Fest development committee I have a great deal of interest in promoting this event in a safe manner acceptable to you and residents of this community I realize these are very trying times I’ve been on Main Street since 1985 as a business owner and property manager the businesses on Main Street rely on bike week bober and bober Fest for at least half their income for the year because of this pandemic many have lost a lot of income are struggling right now and may not survive until bike week I know this because I currently manage a property and rent five stores I also realized that the safety of our residents is Paramount that is why we have prepared an in-depth safety plan which includes mandatory phase coverings well lot Lori just went through most of that with you and uh you know I thank you for allowing us to uh present this uh this plan to you I encourage you to pass the plan as I believe people that have hotel reservations are still going to attend I also believe from what I what I am hearing from people I know in various places around the country attendance will be down this year I also believe that if you approve this plan which includes closing the eastbound Lane of Main Street to vehicles and allowing pedestrian traffic uh in uh the eastbound Lane it will allow for better social distancing this will allow people to attend and have a good time bring lots of money to our area and to do it safely it would also allow the city to make some money uh by conducting parking lots on some of the side streets and uh you know we have uh well we met this year on uh June 28th to approve the master plan which has which lri has said has been modified and changed but uh we are always keep the residents we always keep the residents uh at the top of our minds to uh uh to to uh you know be respectful to all of their needs whenever we do any of this okay anybody have any questions that I might be able to answer no sir unless you all have questions thank you Tom thank you our next speaker is Robert Honeycut and on Deck is John Nicholson hello my name is Robert Honeycut um the owner of froggy SLO my wife and I recently bought it back in February um my brother passed away last year and the business was going under we stepped in took most of our retirement money and we reinvested into Froggies if you you down Main Street you’ll see how much we put into it new floors new paint everything uh and then this covid-19 came along and it it’s going to put put us in a bind but I’m not here just for that I’m here for the fact that the people that come every event they depend upon this money this is the Boost that they get to pay the rent to pay their get the car fixed for medical insurance uh a lot of things this money goes for and you you think well they can find a job someplace else they cannot because the other places bring back their own people so if Daytona put pushes us out of this uh they’re going to go to Orman Beach down new sna they’re going to go someplace where uh I mean where they can get they’re welcomed and and I hope that we can we know we’ll do whatever we can to make this a a CDC event where we can you know we’ll do the the washing the cleaning the whatever it takes uh the mass the nine yards the whole nine yards but we I I just beg you that the fact that you’re hurting a lot of people if we don’t put this V on thank you our next speaker is John Nicholson and on Deck is Patricia herd John Nicholson 413 North granv Avenue as you know I’ve been talking about Main Street for 15 20 years um it’s better but it is still a vacant street it’s busy three times a year Bike Week October Fest and New Year’s Eve other than that there are very few people Jeep we was a little up uh beat if we look at this event and other events uh we have to look at what happened in Sturgis Sturgis obviously didn’t have 400,000 people but if they did have 250,000 and 250 people got the virus that’s on10th of 1% got a virus it wasn’t drastic and Sturges secondly there are actually 12 restaurants on Main Street and there’s only one bar so technically all of Main Street is open except for Dirty Harry’s and its Adent the bank everybody else can serve there are only four places where there would be a concern Tiki Hut um bad boys what was bad boys would will not be open and Neptunes those small locations where everything is inside all the other locations have tremendous areas outside go to Full Moon Saloon go to uh Boot Hill go to Main Street Station there’s plenty of land outside to have the event where the people can stand drink and be social distanced this is not where you’re going to crowd everybody into tiny bars this is an event that can be held Outdoors basically if you’ve ever gone to uh Full Moon Saloon nobody is ever inside I don’t mean nobody five people then she has a thousand people in the patio the same thing with dirty harri’s most of these people are outside it’s in an outside event so I’m asking you to consider that when you look at this this is not an indoor where it can a spreader event this is outdoors where they can do distancing and absolutely there is a need for the city to get back into its normal function and these people need the revenue now what no are you going to say you want a close down bike week we went through that years ago our next speaker is Patricia herd and on Deck is Doug meer good evening it has been a long night Patricia herd 822 Veron Street Dayton Beach Florida I’m here to speak for myself private property I am concerned about the social distance um safety Health welfare uh economics all of those things but I am concerned about living and where I am I don’t see the social distance there we were closed in March one day uh before the big day for all of the vendors and everything that’s okay too because I think I did the right thing with my vendors by reimbursing them some of their money I also would like to say it would be nice if the mayors of all of these surrounding in cities would have come together and decided what to do because if we close down in Daytona you go two miles north north or south they’re open and we cannot stop people from riding their bikes speaking of health reasons yes we’re going to wear mask we’re going to sanitize restrooms but no one has said anything about sanitizing the portalets there are portalets out there and they will be used because I won’t be there for them to come on the inside of my place right Capri that’s right my place will be roped off and good luck to everybody but we will be closed thank you City for are working with me and I will be back soon thank you thank you our next speaker is Doug merer and on Deck is Shelley rosm good evening how’s everybody doing today hope everybody’s made it through this pandemic so well are pretty well off um I actually just want to speak on Direct numbers that were given uh straight from Governor gnome and South Dakota uh where we’re actually looking at 460,000 attendees in Sturges itself uh you actually look they in South Dakota have 124 cases tied back to Sturges itself uh now outside the state they have 11 right now the estimation is under 300 known cases tied back out of 460,000 attendees so you’re looking at that that is a such a small percentage that’s actually going to come out end up doing this now if you look at the videos there social distancing there’s only so much we can do to control such large crowds that are going to come into these things if Sturges can do it we can do it we’re going to have such a small number compared to what they have 460,000 we’re going to say what maybe 100,000 for bober Fest possibly I mean we don’t even know what’s really going to happen at the end of the day here uh so the big thing that we want to look at we want to bring back up is the CDC recommendations for outdoor events right we have in the safety plan saying that these people they cannot use their outdoor areas they got some tables put up they want to be allowed to do concerts and different things like that well we’re looking at cramming them back into the small bars our bars are not large down on Main Street they’re actually smaller uh so if we open those outdoor areas and allow for these people to open social distance because if we don’t at the end of the day uh our chief and all of his officers are going to have a really hard time along with security to try to regulate a lot of this stuff uh so so at this point the bikers are coming uh we know they are coming uh and we just need to know what we’re going to actually do and I think by closing off these outdoor areas you’re going to make it harder for the actual bars to work with this and not only that at the end of the day they’re going to make their these guys jobs a lot harder so opening it up to the outdoor events allowing this orman’s allowing concerts they just did their vote we should really consider allowing these things outdoor to allow everybody to stand here I would like to bring up in FLA itself we have 652 th000 cases with 12,114 deaths with 2.48 million people that live in this state uh so we’re looking at vucha county has a 553,000 Personnel population with 865 cases in this in vucha County right here on top of that was that me yes uh can I have 30 seconds I’m I’m done uh and on top of that we have, 166 death last year from lung cancer when we have 199 deaths from covid so I’m sorry if we’re going to compare numbers and stuff we really need to look at it at the long run so I suggest open it up allow them to do their outdoor concerts allow for it to happen because they’re coming either way and I think the safer answer is to keep them spread out out there and allow for the outdoor events thank you thank you thank you our next speaker is Shelley rosm and on Deck is Don dulo excuse me good evening Mr Mayor and City commissioners I am Shelley rosme Pepe on behalf of Daytona Harley-Davidson asking for your leadership cooperation and focus in making this decision please don’t lose focus on the fact that there are several businesses and people who work in the city who rely heavily on the motorcycle events and vendors for much needed Revenue in fact event revenue is one of the largest component of our annual revenue so this is a critical decision for us and many other businesses and workers please remain focused on the fact that we will be we will there will be numerous visitors coming to the Daytona Beach area for this short 4-day event in order to enjoy what we have to offer and we want them to keep coming back year after year and because of that you as our city leaders should want to participate in making the event as safe as possible while allowing businesses and workers to make a living it is without question that being outdoors is safer than being indoors so one way to make the event safer is to allow outdoor vendors so that people will spread out in Social distance Outdoors rather than just stay indoors the motorcycle vendors who attended the Sturgis Motorcycle Rally reported a huge financial success and a safe event also we though as you as will be a much shorter event much less attendees no outdoor concerts and with more stringent me measures we can conduct this event safer than Sturgis we should work together to conduct this event as safely as possible if the safety measures are good enough to approve outdoor concerts at the Daytona Bandell then the safety measures are absolutely good enough to allow outside vendors local numbers of emergency room Admissions and positivity rates are trending down and prove that we are not any crisis here in the city things are improving so much that the governor was in town recently urging people to travel here and throughout the state as he should the businesses in the city who are willing and able to conduct the event with approved safety measures should be allowed to do so motorcycles should be allowed to ride and park on Main Street and should have clear access to the full-time businesses regardless please focus on the fact that the business community and people who work in the city need your leadership and participation to make this event as safe as possible but also a financial and thank you okay our next speaker is John is it deula that’s right I’m working on changing that last name I’m sorry it’s D Julio John de Julio I’m director of operations and I’m here on behalf of Dirty Harry’s the bank and Full Moon Saloon um just here to speak tonight on on the master plan and the specifically on the agenda of safety and the uh alternative traffic plan um we were asking or basically that we can do this at the least restrictive as possible I know that in the safety plan it is calling for uh one-way traffic and allowing people to um um walk on the other side of the street openly to expand the um public uh area and this would I we feel is is a as a uh a movement that we would like to see um in returning to Auditorium and you know the traffic plan itself looks like it was um thought out to U keep people moving and safe distancing and also being able to keep motorcycles on Main Street it is imperative that motorcycles do get to go up and down the street it seems like Cruis on Main Street is uh part of the event itself and um I think that’s exactly what we were talking about I’m sorry everybody covered everything else that I wanted to say so I was just here to address the uh the uh traffic plan thank you thank you our next speaker is George St Pierre and on Deck is James Britton is George here there he’s right there come on George hello I’m George St Pierre owner of 1022 Main Street Daytona Beach jungle georgees I’m here to speak for the little person and most of the people here are business owners and most of the little people don’t show up up here but I do want you to understand that the actual workers that work in our bike week bike toober thing okay they are actually people in our community that are using this money to support their Christmas their Thanksgiving their Halloween their way to get through the winter because I don’t know if you know the tourist aspect of the city but it is a very seasonal business and without that extra money you are going to have a lot of kids without hukkah and Christmas you’re going to have a lot of kids without a lot of things and if they can do this for the Bandshell and separate and then I don’t know if you’ve all been there but actually going into the Bandshell it is like a cluster xord but in order to get into the Bandshell to be segregated from people you have to go through a tunnel of people and the the program they have and the fact that they’re all going to hand out mass and they’re all going to do the right thing give us this bike week it not only actually helps me and I’m on the opposite end of Main Street but this is something that it’s our Norm and we need it and the community needs it and the children need it and I don’t think anybody’s touched on that that the fact that the kids are relying on this for Christmas thank you okay our next speaker is James Brittain and on Deck is Johnny McGill is there Mr James Brittain in the lobby okay gonna move on to Johnny McGill I’m sorry your sir name sir yes ma’am this is uh Jonathan McGill or Johnny McGill I have a company called Johnny Nomad media I’m in Norman Beach I’m a photographer videographer proud member of the Daytona community and Daytona Regional Chamber um and I just wanted to take a few minutes to talk about bober fest with you guys I think it’s extremely important that we allow this event to continue as you can see our neighbors to the north have made a decision this evening that they feel the plan that was put in place was something that they could work with something that could be safe for people a few of the people before me spoke about the fact that we know they’re coming anyway and I think if we have a plan put in place if they’re going to be here that we can satisfy and service those people properly that we can do it safely one of the other things I’ll tell you I got a I got off a cruise ship on March 7th my parents are elderly they live down in the uh baton area I haven’t seen them since I got off that ship for me I feel if some reason I got sick I might be able to get over it maybe I’d be foolish in that but at the same point I’m mitigating risks I am taking the opportunity to say you know what I’m going to do what I feel I need to do to make sure that I take care of those people I would not want to be in any one of your seats this evening not one you have a very difficult decision to make on one hand you have a lot of members of the community that may feel like health is the optimum thing they have to think about and you have other members of the community that are saying we’re going to take all the necessary risks and try to mitigate it but you have that battle that you have to fight all I can say to you from a small business owner that does rely on these large events in Daytona Beach there are people out there that own these businesses that have been going through this since day one they have been forced to change they have been forced to mold themselves change their businesses and they’ve been forced to fit now into a new norm and that new Norm is taking care of people sanitizing making sure people wear masks but one thing I ask is where is the public and personal responsibility so just as you have a responsibility to look out for the public they also have a responsibility to look out for themselves and if everyone does everything the way that they can with the outdoor openness with the public spacing and the the sanitizing that we’re going to be doing I would simply ask the public to think about it and if they really feel like they’re going to be in danger or detriment it’s okay to stay home you don’t have to enjoy the bober Fest let the people that are on their motorcycles enjoy their social distancing and I think it would be a win for the whole Community it’s going to bring back a lot of not only jobs that are seasonal here but it’s going to bring a lot of people into the area the hotels need everybody on Main Street needs it I just implore you guys please make the right decision this evening let bober Fest continue safely thank you so much for your time and did Mr Brittain leave or I just want to give him another opportunity okay I have no more speakers Mr Mayor all right you Mr Mayor m m something yes sir I um I spoke with a business owner in the Main Street area who you know is a pretty um own several different businesses and they made the point that they had elected to not participate um and to kind of plan accordingly you know they didn’t want to wait for us to kind of make a decision for them but they also spoke about you know the their responsibility to their employees in the sense that you know they were worried about asking their employees to participate and to come to work in a situation where you know there was a risk of this of this disease you know I’m I’m you know I I experienced covid personally in my household you know my wife took every effort she could imagine and you know we still got covid fortunately I had no symptoms neither did my two boys but my wife was pretty sick and we were you know we’re all young and relatively healthy you know I haven’t seen my father in quite some time because I didn’t want to risk exposing him and I think that’s you know that’s the question that we have to ask ourselves is you know um there seems to be a big disconnect people seem to be of two Polar Opposites about this disease whether it’s a you know uh a deadly threat or a minor inconvenience people seem to really be polarized about it but the reality is I don’t think that we can compare by to profess to um the um concert series at the Bandshell or anything like that you’re talking about if it happens the way people are thinking it will a tremendous number of people in a in an area um you know it’s just not nothing about bike Tober Fest is conducive to social distancing or maske wearing and I think you’re going to put businesses and police officers in a very bad position of trying to enforce rules that frankly are are not going to be enforcable um or there’s going to be trouble over it you know the other the other thing is this is not um you know we’re not sending a message that we’re closing down Bike Week for good October Fest for good or anything like that I think people understand this is an unprecedented period in our history and I think if they enjoyed bike events in the past in Daytona Beach when things change they’re going to revisit it it’s not like I mean people haven’t forgotten about sports just because Sports have been changed or the seasons have been changed I mean I think that we don’t have to worry about this being the end of uh you know people coming to this area next year or things like that when we have a better handle on it I you know I hear the numbers and statistics I don’t you know I think that there’s a lot of different ways to look at the data and without the raw data in front of us I don’t really know that we have a full picture I don’t know they will have a full picture for quite some time um you know I I think there are a lot of differences between us and Sturgis and I look back at our experience with uh at the very beginning of the pandemic and how that changed plus you know to comply with the governor’s guidelines and things like that I don’t know that um it will even be uh possible I saw some of um Deputy Chief Deputy manager Capri uh Driscoll’s comments and I think a lot of what was being proposed not even be compatible with some of the current guidelines so as much as I know that it’s going to be you know an economic hardship I I can’t support um making an official Proclamation that the city thinks that uh you know this is something that we want to support I mean if people come and do things anyway well then you know they do that but at this point I I don’t see that the pros outweigh the cons this year and I think that you know this will be something that you know I think hopefully next year when we have a better handle on the situation this will just be you know a one-year disaster that didn’t happen I mean we could have an interruption from a hurricane or things like that I think people understand that you know we have setbacks we have disappointments we have inconveniences you know and while the you know while people may count on this for you know their income or may count on this for the holidays and while children may be disappointed I mean I think the risk of even one or two people dying probably outweighs the sense of disappointment I mean I would be disappointed with a bad Christmas but I’d even more disappointed if I had to bury my father or someone uh close to me and and it that death is not a hypothetical I mean we know people who have come to this commission meeting who passed away due to co it’s not a theoretical construct it’s not something that happened to someone else that we read about in the paper I mean it’s happened here so I don’t know that I would feel comfortable you know talking to someone and saying well you know I I I rolled the dice and that was the decision that I made so my my vote would be uh not in support of it at this time um thank you okay thank you commissioner Mr I’ll go with the Counterpoint to that I think more people die if we don’t adopt this there will be biketober Fest in Daytona Beach you know this is this is an opportunity for us to manage the situation to create things to allow people to social distance you know what’s going to happen all those businesses are open over there with with the exception of just a few people are still going to come here you know we it is a greater risk for us to do this and pack people into a smaller area you know where they don’t you know they aren’t obligated to abide by you know these rules this is something it’s going to happen in Orman you know we already heard that tonight and they’re they’re actually going with a fairly normal you know with entertainment and everything you know this is this is boiled down to be a barebones event you know this is an opportunity honestly reminds me a lot of what we just went through with the scooters you know the scooters we have no regulation this is an opportunity tonight we took an opportunity to put some regulation in place if we don’t adopt this then who knows what the safety plan might be over there you know the businesses will be on their own to figure out what it is that they think is best for for them and you know we’re going to have you know as commissioner dogado pointed out you know this is going to be a tough thing for the you know for the police department to to patrol to enforce um you know they the restaurants still have a 50% um you know capacity you know uh they’re going to have to figure out how to you know how to enforce that you know they’re going to be spread pretty pretty thin because we’re going to have a lot of bikers you know they they don’t this isn’t like the 70s where the bikers came here to sit in bars and drink all day you they they come here to ride you know they’re going to get up in the Destination Daytona area and cruise around they’re going to come down here and cruise around they’re going to go down to new samna you know the Harley deal dealership down there and the bars and restaurants down there they’re going to move around you know this is an opportunity for us to do something proactive to try and protect our community as opposed to sticking our head in the sand and and hoping nothing bad happens so I I think that this is something we absolutely need to adopt tonight you know if for no other reason to try and protect our community the best that we can okay I think commissioner Gillan makes a good point I mean you know we we you’re right commiss Gan like you know we we do want to protect the community I agree with you wholeheartedly I I think obviously we wouldn’t be relaxing any the existing the existing strictures but exactly what you said and maybe I shouldn’t have read the St so recently but exactly what you said is like it seems to me like that’s why this event is so potentially problematic because you’re going to have people traveling and if you have people who are sick or contagious and don’t know it and they travel from you know one destination all the way to the other that just seems to me like you know the kind of problem that would would be a problem we you know I don’t there’s no no doctors or anyone who’ve spoken to us tonight but it just seems to me like that’s the problem um that’s exactly the thing I was concerned about but I agree with you I’m I certainly would hope if with you know we want to have safeguards in place I’m not proposing that we not have safeguards I mean obviously we have the existing um rules and regulations in place um which I think are tough to enforce I mean i’ I’ve seen 7-Eleven have a hard time getting people to wear a mask or say distance so I I just think that by October best by its very nature would be an even harder event to regulate but I agree with you in the sense that you know if if you see this as you know a way of setting a ground floor that’s great I kind of see the existing rules as as being that ground floor and I just don’t know that there’s any extra steps that are feasible that are not going to be so burdensome as to just be you know prohibitive in the in because another possibility is you know the businesses come out and they don’t make any money anyway because the rules are restrictive and all that I mean I suppose that’s the choice that businesses have but I’m not proposing that we leave people unprotected or anything like that I I think we have rules in place for that I’m just I’m just concerned that this is a such a unique event that it makes it very hard to provide meaningful regulation and meaningful protection for some of the reasons we’ve talked about but I I agree with you I I S I mean that’s the goal is to protect the community I just I can’t I can’t be sure that this is the best way to do that but I mean obviously we all agree with the spirit of trying to protect the community I’m just I just feel like this is a very tall enforcement order and I’m not sure that it’s uh that it’s realistic thank you okay uh commissioner uh anyone else have any comments we vote nobody else commissioner commission re let me say something covid-19 is real we just buried someone last Saturday here in Daytona Beach that died from at her entire family had it it’s one of my sorority sisters daughter less than 60 years old her son works for us in iddle and he’s having a difficult time because the last time he saw his mother they were both being admitted to the hospital he never got a chance to say goodbye I’m not for this and I’m sorry I mean I understand what you’re saying but but um I think we need to be we need to be real about this thing if anything we should have left the other bike we open for one more day cuz it was just beginning we’re in the heart of this thing my supervisor called today her son was being quarantined I said you need to go get him tested you need to get your whole family tested because we don’t know people are as systematic and you don’t know if you’re walking around with it you know we’ really got to be conscientious of this thing and for me to say that these folks can come it’s just I don’t think we can control this and and we are comparing ourselves to Sturges we don’t know what’s going to happen here we don’t know who’s going to bring it we don’t know who’s going to take it back we don’t know who’s going to leave it covid-19 is real for me and I can name at least five people I know that have already passed from it and they weren’t even going to mass events like this they were just living their lives even commissioner Delgado saying that he was being as cautious as he was I mean he hasn’t mental commission meeting in what four months and still CAU it it’s real y’all keep playing if you want to okay commissioner uh Henry mayor um I agree with commissioner Reed I’m glad that she she brought that up um I don’t see how we can effectively uh manage this at this time uh I don’t even think our citizens in our community would want us to try to do that um reading the room I’m seeing where everyone is mostly concerned about um they’re mostly concerned about what we are allowing to happen in our city and and it hasn’t matter whether it’s our event or whether it’s a a personal event everybody thinks that we personally as a commission is responsible for whatever happens in this community um and I’m not prepared right now to to go along with with this event at this time I’m very concerned about covid in this community and and although the numbers are going down I’m I’m not assured that the numbers are not going down down because we’re doing less testing at this point so um at this point I’m I’m going to agree with uh some of my colleagues on on the bench tonight I’m I’m not I I want to take this seriously and I want to make the very best decisions for the people who are here in Daytona Beach um I’m concerned about those who would come here but I’m more concerned about those who are already here who depend on us to make good decisions well that that’s for knows so I lost but I’m I’m sticking with the point of a bike to there will be biketober Fest there will be biketober Fest a biketoberfest with a safety plan is better than a biketober Fest without a safety plan so speak up can can you can you say that again I’m sorry it the audio is so horrible would you you speak that say that again please that my position is that a biketober fest with a safety plan is better than a biketoberfest without a safety plan so I’m going to be supporting tonight I agree with you on that so I I agree with you on that I’m just I I I’m just not I just don’t think that that is something that our citizens and reading the room and and having conversations with them that that’s what they would want right now you know how either way and I think even with a plan it it it almost seems as though we’re approving it if we have a plan how can we justify not allowing things to happen in our facilities not allowing kids to play Pop Warner football not allowing our our facilities to be utilized but yet we turn around and we support something like this now first of all let me Command Staff cuz I know a lot of work went into this to try to turn around and bring this to us so thank you for all the hard work you put in and and for the for Lor Campbell Baker and everyone over there as well but you know when when you think about this thing real hard we’ we’ve got to be real about this I mean I I just can’t justify that and we say no on one hand and yes on the other hand okay commissioner did you have anything cuz I think we were at a point where this is beating just want to make sure I’ll give you an opportunity to speak okay cuz I’m going to close it out I am uh I agree with you commissioner Reed so when we first approved the Bandshell I sat back and I said now how is this going to go because we actually set a precedent and I made mention of that and tonight some of the business owners down there brought that up we said yes to something so we have actually approved something but I find interesting is as as health conscious as I am I find that I agree with um commissioner gilland the reason is that people are going to come anyway but what’s before us is whether or not we allow outside vending is that correct so is it possible for us to have the driving have the sidewalks have the parking situations as we discussed but not allow that mass of people to do the vending with that do with that serve any purpose or is it just a waste of time a waste time I do agree with you that they’re going to come anyway I’d like to if they’re going to come I don’t want to encourage it but I cannot say that it is right that we as a commission regardless of what I voted I’m on the commission we as a commission said yes to one event and now we’re going to say no to another so that is the position I’m in so what is the safest thing that we is is this the safest thing really to allow people to congregate outside because it’s outside and by the ocean or is it just okay we don’t have to embrace the vending concept you’re going to come so you come you park your bike but there’s not the vending application to it is that a possibility is that something you want to discuss there there’s no time there’s no time the applications came in in June you know this is sort of as scaled down as what the merchants could could put forth you know so to go back now and ask them to reapply with a different plan there there just isn’t time to get it done I lost this train of thought I’d like to add this to my comment we’re saying that they’re going to come regardless well this evening we’ve been presented with a plan how we’re going to be so safe in providing this so does that mean they’re not going to be safe if there’s no plan I would think if they’re still coming if they care about the people that are coming care about the citizens that are here they’re still going to provide these same Services it’s just not approved by us aren’t you going to still clean your properties aren’t you still going to wear vest AR you still going to ask them to do CDC you know regulations how far do they need us to approve this is it the roadway is it the driving is it the sidewalk is it the fact that the businesses can then have outdoor activities or events in their parking lots as a new permitted use is that what this is to me the road is the biggest part you know because there’s going to be nose to take people on the sidewalks over there you know so closing that one lane and allowing some more space for people to to get away from one another was a is a huge part of this by voting this down you’re packing everybody into the into onto the onto the sidewalks so you once i’ I’ve said my piece so MH okay um commission trer I’ve already said my piece how I feel as much as I think I would like to have it I know in my head that it is that it is not right for the residents of Daytona Beach and that is who I am most concerned about like I said you can usually recover from economic you cannot recover from Death as we know all too well was a great member of great number of our residents already have passed on to Glory so uh I was hoping maybe I could be persuaded but I can’t I I can’t have it on my conscience that I would approv something like this that is in my mind so terribly dangerous okay commissioner Henry she already spoke I was I wasn’t sure commissioner Henry went she she I have one more comment mhm we’re talking about the places that they’re going to go if we don’t let them come here they’re going to go those places anyway they ride up and down us one from Orman Beach to Daytona to Port Orange all this is going to still happen so if we’re really gen genuinely concerned about the safety and the welfare of these folks that are coming I would think that those who are willing to do this service are going to still do everything they put in this plan without our approval it’s all about being safe in CDC let let let me say this and this is a this is so challenging it’s it’s it is the most challenging uh part of of our service because I I knew when we said yes to um the Bandshell that people would say well you’re picking winners and losers and on some front that’s true we picked something but we worked very hard to create something that you know was really spaced out and really has the potential to be successful and controlled and um it was done with great deliberation I mean we didn’t and just say oh you got a good plan okay we made him come back and come back until the ninth hour until we had something that was reasonable you know from my perspective in reviewing this first of all I just got to review it today it’s not not that good of a plan you know it’s just not not even that good of a plan um and that’s not to knock the people who worked on it because how could you make a great plan for bike week to be covid responsible I don’t think it’s really very possible but the most important thing I want to say tonight is this that and this is what commissioner Reed is now saying everyone everyone in Daytona Beach everyone in Florida and Valia County everyone in the United States everyone in the world has a responsibility to try and beat Co no one should shook that responsibility and to Simply say that they will come and they’re going to do what they’re going to do doesn’t mean that we should acques what we believe we should do you control what’s in your hand you know this is in our hands as it relates to itinerate vending that’s all we have control over but the business owners the people who choose to come here and unfortunately the people who have to work in that environment they have what they have in their hands they have to control what’s in their hands and my encouragement to them is to be responsible and be good stewards of the power that they have because as a teacher and a teacher of social studies and The more I’ve been thinking about our role in Civic and society and thinking about this one person in our community who I look at and I always say that person right there that’s a citizen that person should be the citizen of the year and that’s really what you go to school for and you they teach you social studies is how to be a citizen and how to control the power that you have everybody has some measure of power well we have to control what we have this is what we have and as a society we we made we we told people they had to wear mask most of them or have a lot of them don’t want to wear them but we told them that and I don’t care what anybody says the numbers are going down maybe it’s because of mask but maybe it’s we know it’s in part because of that okay and so I want you to know that Norman Beach is not not my model and I realize that we’re not their model and I wish that we could have worked together but you know we have differences of opinion about the way that this should be handled and most importantly tonight as we notice that we’re starting as a society as a state to see the curb go down well when something’s going down just because it starts to get better doesn’t mean you wake up the next day and you say oh it’s better the light switch can go back on when you say that then you’re simply saying to all these other things that we’ve done so like she said those little pop warner kids who are truly truly truly truly brokenhearted they are Brokenhearted and many of them are angry at me a person who has done as much for them in this role as could have been done but you know we accept that but I’m just saying that all of that we can’t just give all of that up and then say because this is an economic engine in our community all of a sudden we’re going to um say yes 50% is their capacity they have to operate within a certain set of rules as it is so I say that yes they may come they will come but I said after spring break to the Spring Breakers don’t come and if they call me and ask me I would say you know I’m not taking my mother out there not taking my dad out there not even taking my 8-year-old asmatic son out there so you know it’s and realize that people have rights and they’ll make choices but we have to remember that and so in other words what I’m saying is I’m not encouraging People based on Bike Week we’ve had bike week and bike toer fest bike toober fest for 30 years Bike Week for 80 years and we’ve embraced it and so what I’ve said to the journalist today is that we embraced it in the past we will embrace it again when the time is right the time is not right so we can’t make a decision based on what someone else does in their Community we have to do what we have to do in our community and control what’s in our hand but most importantly everybody in Daytona Beach remember we all have a responsibility and so as you guys go out and you prepare and you I’m sure are shaking your heads with this decision I encourage you to still be responsible because it’s the right thing to do so I obviously uh I joined the majority tonight in opposition of um supporting in this measure and it is my hope that by Spring things will be different because I can say this a month ago it was my hope that the numbers would be where they are and I and they are where they are and I wanted the decision to be tough but I think that as we think look at Society we we need to keep our schools open we need to remember The Economic Consequences of CO as it relat to healthare it costs a lot of money for people to get sick and in order to keep our schools open and to keep our economy open we have to be responsible and so um if there’s no further comment I have a question I have a question just a practical question Mr Jagger so what does this look like so the businesses I want to understand what they can do right so the businesses can stay open and operate the way they normally would the streets operate as it normally operates sidewalks as they normally operate correct not it’s just a regular day on Main Street is that correct well we can control um our right of way so the city could take some control over the sidewalks and the flow of traffic and the parking now in terms of the businesses they would be operating on their own accord consistent with the executive orders from the state and with the city for instance Mas requirement would be applicable is there anything that we want to do with regard to traffic at all if people are going to come um just dealing with traffic flow or parking issues or anything like that that we can manage is there anything we want to do with that or just leave it as just a normal operating day or four days what are your thoughts not asking for them to do business or change their tant vending not that but just is there anything we can do or should we do anything or just leave it just exactly as it is well I don’t know and I’m thinking about safety and health here cpri police chief we have a plan already in place okay and we’ll make adjustments as we go along based on the crowds and based on what’s Happening that’s the easy part okay we we can make adjustments on a dime and change what we need to change so we’re coordinating with traffic engineering Police Department we have plenty of resources we’re planning as if it is an event but uh we’ll be ready to deal with whatever we have to deal with so I don’t anticipate any problems with the traffic so we we vote know and and but you can still manage if people are going to come you can manage safety you can manage crowds even if they come you’re still good with everything yeah absolutely absolutely we’re going to enforce the masks inside the businesses uh we’ll see how what’s going to happen who’s going to come and what you know it’s it’s a lot of and thought to some of the items that we have left on the agenda but I don’t know that that starting it at you know 10:30 after you know four and a half hours of of hard discussion is really in the best interest so I would like to make a motion to uh to reset these items if they need to have a special day so we don’t fall behind or add them on to the next agenda um so that they can get the thoughtfulness that they deserve and I would like to make sure that you know citizens have an opportunity to hear our discussion and do all that but I I know the lateness of the hour and I question pending ordinance consideration coming up under the city attorney’s office that needs to be considered you have a planning board coming with 19 items you don’t have it the planning board does but there are 19 items on that agenda a number are PDS and the action tonight will have an impact on those items I do not want to wait on 19 items from the planning board myself no sir I know that tell me what it is well this is the item was B the one on 11c 11 C 11c 11c that has to do with the amendment to the PD provisions and affordable housing with the other two are not related uh the one above it will take about three minut not even three minutes a minute and a half just to hand out papers that’s it and 11c is not a vote to approve the LDC Amendment it’s really a vote to move it forward to the planning board to start the process so it’ll come back to you in other words yes sir for later approval so you could take an action on see could take an action uh to move things forward you’ll need to take public comment of course but it’s not a final action uh because the Amendment will come back to you after the recommendation from the planning board the the action tonight would commence the course uh the the proposed amendment would be to um add as a factor for adoption of a traditional plan development approval um consideration of affordable housing so that developer would would have in the PD application an element of affordable housing built into it uh for the city commission to consider and as part of their approval process would they be able to choose as I read through it do we get to choose different like an alicart menu or is it do we pick one vehicle or can we adjust according to the developer you would have to weigh all of the factors involved um of course the size of the development would be an important factor the the number number or type of affordable housing provided uh they could provide perhaps um a proposal for an offset for a density bonus for instance or they could also perhaps propose um a contribution to a trust fund for affordable housing or to the Housing Authority there’s so many options it would certainly be a case-by case analysis and final question it was a pretty lengthy document was a quick perusal my question is who would be managing this one more function of the city this would go through the normal application process and come to you for approval I don’t want to mix up too much the document is simply a range of choices the amendment as Mr Jagger explains put it puts a tool in your box as it relates to reviewing PDS and someone’s intention to provide affordable housing in some component okay that document sets up choices they could make you would evaluate those as Mr Jagger already has explained but the pending ordinance doctor have it in place as you see PDS coming which will be coming from that 19 item planning board agenda you’ll begin to have that in place so that you can discuss those things as they come forward in other words you can start implementing this this provision you can take it into account as you move forward that’s why I was trying to get to that point and so it’s important to get this done and so is this is this something where the the one time the is it a joint kind of concept where we say hey would you consider this or is it something the Developers out of this we choose this analytically it’s the same as any PD you have seen in the past and you have and your code you have an obligation or the ability to consider the public benefit provided by the waivers requested pursuant to a PD so someone coming forward with the PD the sections that’s been proposed by the city attorney’s office says that the commission can consider the offer made to provide affordable housing in whatever format and you evaluate that to see whether or not you think that’s effective don’t let the size of the document throw you off it’s really a toolbox that’s what it is it’s not to direct anything particularly but to rather offer you an array of choices it’s very good yeah that’s the document but this gives us the capacity to say to anybody who comes and that’s the reason that I wanted it done immediately immediately so that we could begin to say this is a part of our expectation MH now we have to begin to determine what that bar and that standard is going to be okay and the document will help us moving forward to get a to tighten down what we’re doing and I will say to the commission that document’s a draft we’re working on it still but you needed it and we tried to get something here to you so thank you okay so Bob the the way this you know the the F fostering development of affordable housing is nice and Broad so the things you mentioned like maybe doing a contribution would would uh would suffice there but well you have here [Music] for n which I don’t yes so if the PD plan Amendment provides for new residential units include a description of the measures taken by the developer to create affordable housing within the planed District so that would not allow for a contribution it would require that the plan District include affordable housing within the plan District well that’s an includ including but not limited to I would say because you know this this is like the only thing in the economy that still works Daytona Beach is residential development and if we mess this up it shuts everything down no one will invest in etona Beach doing residential you know now there’s there are ways out there there’s things we can do I mentioned when we talked about this last meeting meeting before uh Mark Watts’s project over on um Clyde Morris Atlantic Housing Partnership um you know they’re the biggest affordable housing developer in the State of Florida something crazy like 40,000 units they developed you know but they’re having trouble making the making the the bottom line work out for them so they’ve come up their plan is and if I I’ll probably get the numbers a little off but there’s 88 senior affordable units and 216 you know non senior below Market units that would be scaled into different ranges so there’s you know about 300 out of 800 total units that would be affordable in this community your goal was 1,600 which is a laudable goal this is a way we could actually get 300 of those which is fairly low hanging fruit what they would like to do is if the county will get on board too is abate the property taxes for only those units that are affordable which would be about $300 per unit and cost us about 55 to $60,000 a year you know so to me that is probably somebody’s got to pay you know and in this case that’s an example of something where we’re the ones who got to bite the bullet a little bit to make sure that we tighten our belts and and don’t need that 60 Grand we’re going to collect $30 million in property taxes this year you know based on what we passed earlier you know I can eat I can eat 60 Grand if it gets me 300 affordable units in Daytona Beach you know that’s something that that I think is a model that works I don’t know that this I don’t want this to be so restrictive that it says if you’re going to build a residential in Daytona Beach you have to build affordable within the confines of your District so Bob yes we don’t have to say that it’s not saying that right but I do understand what your point to commissioner Gillan and we could perhaps revise that language to allow for a payment in Li of more expressly if that’s what you’re suggesting is that where you’re going commissioner um that would be one there might be something else yeah I we certainly want to build in flexibility the point is not to limit your options here it’s really to expand your options to provide affordable housing but this saying that they to offer it within the plan District to me is very very restrictive I didn’t get that at all actually I got that they had options and that they could choose to say we don’t want to do that in and because we don’t want to do it within our development we’re willing to put x amount of dollars somewhere else or build something else or do something else somewhere else create affordable housing within the plan District that’s pretty clear to me it it what what I think the intent there was and Mr Morris could probably speak this is we did we weren’t looking at or the planning department along with legal weren’t looking at establishing a bank of affordable housing units we really wanted to focus on the PD itself it it’s a PD approval so the units should be confined to the PD but there could be other options like the payment in Li of um and of course the increased density within the PD uh would be another option well the important thing is that the language already drafted and you’re giving us Direction tonight as to what to do is that it’s discretionary with the commission as you evaluate a PD request you’re not mandated to do anything if you elect to do something you have choices that you can make including the one you suggested for Mr watt project that’s one of the available choices in the toolbox that’s there but this is something that commission has asked for It’s Complicated there’s a lot of things to consider and the first step is what was drafted uh by legal in conjunction with planning to give you discretion but not to compel you to do anything you have the option to consider what your choices are including whether or not to approve the PD you don’t have to because ordinarily you got zoning it’s really akin to the dollar store discussion that was earlier tonight you don’t have to approve it the discretion of the commission and the willingness of the parties involved is really what’s at work nothing that says you do a b or c it’s discretionary in the scope of your evaluation of a PD and part of your standards already are that you evaluate the public benefit created by the PD by virtue of the waivers the idea being if you’re a developer getting waivers there’s an offset in public benefit that’s the theory of the document that’s the theory of the amendment keep in mind this is not the your final decision um we may want to tweak this language we we we’ll talk about this in the following days we’ll take it to planning board in some form it’ll come back to you if it needs further revision we can handle it at that time as well but I do understand your point and it certainly was not our intent to limit the possibilities uh for provision of affordable housing we want to expand those possibilities in this draft that yes so so we’ll we’ll look at this we’ll work with the planning and if there’s some revision to be made uh we’ll notify you of course and take it to planning board in that way okay but it will come back to you as my point here and I I want to make sure that we understand something CU I understand his point is that we have to get this right we are fortunate that residential builders are interested in our community um but we have to also remember that as it relates to affordable housing in the long run when we get through with this document and develop a set of procedures it’s it’s difficult for us because the law mandates that we give them enough so that they really don’t pay for it so we have to give them something so it’s going to be difficult for us to mess it up it’s almost in my mind almost impossible because we essentially have to be willing to as he describes with the tax rebates so to speak those are the sorts of things that we’re going to have to do or density bonuses or things that make it so that the developers not really paying anything as it so I don’t see it as a reason for us to be alarmed because we’re going down this affordable housing Workforce housing road we should be Full Speed Ahead because it shouldn’t discourage anyone and the last thing is we’ve developed 12,000 units 12,000 that’s a big number in the last eight years or so so you know people are interested in us that doesn’t mean we want to turn them off but by the same token it’s it’s it’s questionable in a lot of people’s minds always as to whether residential development pays for itself commercial we know residential is a much bigger question and and we don’t have to be married to this idea and I’m definitely not married to this idea that we need explosion growth got a thousand people every day moving to Florida and we have the cheapest land some of the cheapest and the best land in Florida I don’t think our demand is going to dry up anytime soon if people going to continue to move to Florida that’s doesn’t mean I’m trying to turn people off but most importantly we need to stop selling ourselves cheap as a community you know we are worth the investment that this requires you know and if we don’t make this investment no businesses are not going to want to come to Daytona Beach because nobody wants to come to a city where their workers can’t afford to live the only people who can afford to live here are people that want to move here from the from Jacksonville or get away from Orlando south Florida that’s what a lot of people that live in Margaritaville that’s where they coming that’s why they come and then we turn into that you know another Concrete Jungle so let’s let’s let’s not sell ourselves short we’re worth the investment and most importantly the people who already live here already working at Amazon already working at Trader Joe’s already working at bbr they are worth the investment in in so that’s that’s my position okay uh did we what’s our move now do we have a you’ll need to take public comment okay okay my first speaker is Mark watts and on Deck is Michael schnap Tyler good evening mayor members of the commission not recognizing the late hour I’m not going to take a whole lot of your time but I do appreciate the opportunity to say a few words and um let me start by uh just um encouraging you and congratulating you on taking a step to work towards affordable housing I think that um you know it is a a key and important issue that needs to be addressed not just in Daytona but throughout Central Florida there’s been a lot of discussion and studies on that there’s an article published in the Orlando Business Journal today about the Orange County um committee that’s been working on that and the list of recommendations that they’ve come out with and how they’re starting to implement those things really want to bring up a coule just really two key points um commissioner gilland recollected a conversation he and I had recently about a client of ours that you have already approved the PD for that one but they want to be a partner with yours or with you on affordable housing and I’d encourage us to maybe continue that conversation there’s details there that I think um you know we can provide in some follow-up conversations to tonight that I think may help understand some of the other tools um that are out there that could help uh Implement what you’re trying to do here the other point I wanted to to raise and and it relates specifically to the item that you’re you’re considering on 11c is you know there there are a number of items I think 19 items coming to the planning board next um next month and or not next month later this month and in many cases those are items that we’ve worked on for 12 or 18 months um with staff and so you know the pending ordinance Doctrine and the reason that you’re you’re considering this tonight is to start putting that requirement into those PDS as they’re coming through um the planning board process and I’d ask you to keep in mind that the time that we’ve spent working with with your staff on a lot of those projects so you know I have clients that I think can we can we can make fairly simple you know um policy statements in some of those PDS that will help satisfy the the requirements that you’re considering but others may be a little bit more of a lift and so in particular as you’re beginning to implement this with some of these first PDS that would be coming through I think you know that flexibility and that that sense of partnership is going to be a key thing for us to to all keep in mind the other thing um I I I do encourage the the change commissioner gilland the flexibility of the tool set there I think that’s going to be an important thing and I think um Michael’s going to talk to you a little bit about some comp plan implications that I think may also be important to consider but but again I I’d also encourage you last thing to engage vCard um because typically when we’ve had this type of policy this certain we we bring in the other people that are part of the regulated Community as well and I’d encourage you to do that as well happy to be involved in any works or like what Orange County did put together an advisory committee to kind of create that toolbx and make recommendations back to the city so we’re happy to to volunteer our time to do that it’s an important issue I appreciate you taking a few moments to listen to me this evening okay our final speaker is Michael schnaps Tyler good evening mayor and Commissioners Michael schnaps Tyler with cob Cole 149 South ridgwood Avenue um Echo everything that that Mark said and just want to um uh just comment briefly you know over the years I have tried to bring a couple of affordable housing projects to the city of Daytona Beach unfortunately um through the Florida Housing Finance process they weren’t successful um but I do want to remind you all as you kind of work through this and the staff knows this you know very well in your comprehensive plan there are some Provisions that require plan developments on certain properties so you have provisions of your comp plan that says a PD has to be in place and so we just you know ask that you know you you think through what those comp plan Provisions say for those properties as as you continue through this process on the specific code as well because they’re separate documents thank you would in that case uh if it’s required they would they be subject to this CU if it’s required I don’t think they should be subject to that what do we have to look at in each case is what the underlying zoning is so they have to have some opportunity to reasonably develop the properties so if the underlying zoning like for instance a an expired PD uh exist we would have to look at some of the legal ramifications of that so if you were to not deny a PD rezoning where they had no valid underlying zoning um that may create some legal issues so we’ll have to look at those on a Case by case as they come forward no doubt okay thank you okay uh we have a motion in a second no no so moved we have one motion do have have a second is this a discussion item no they had to you I believe we had to take an action take an action on 11 c yeah 11 C was an action item well it it’s listed on as discussion on the you’re not precluded from taking a vote on it yeah okay it just wasn’t advertised as an action it doesn’t have a resolution to it no well at least we had some public comments so we can defend ourselves that way there’s a motion on the floor and and once again it’s not the final word it’ll come back for formal second your motion thank you that was read and g land all right we have a motion in a second um all those in favor Let It Be noted by saying I I those opposed same sign motion carries 70 was our final item on the agenda okay uh that was our final item of the night so we will move on to uh commission comments Henry commissioner Henry are you still there yes I am okay I just wanted to just reiterate um the conversation earlier in regards to the doll General stores and I really think that we need to have better and Tighter control Dollar General stores in our communities because these types of chain stores tend to have a business model of oversaturating impoverished communities and they tend to run mom and pop stores out of business and they discourage authentic grocery stores from opening in food desert areas um and people in these communities don’t have opportunities or access to Fresh Food because of that so um I would like for um the attorney to get back with us on some things that we can do to regulate um the distances that are between these types of stores box stores as as as he calls them um and then the other thing is that they don’t they don’t tend to play even pay their employees well so uh we say that they we say that they um offer jobs or they have they they create more jobs but they only tend to create about eight to 10 jobs per store and those people are still paid minimum wage so um it I think in communities like some of the communities that we serve if we want authentic grocery stores in those communities we have to be very careful in deal dealing with these type of box stores um people cannot go in those stores and get healthy foods they can run in and grab some things but they are they do not provide the type of healthy foods that all communities need um and the other thing that I want to say is in listening to you talk about um and and commissioner Reed talk about po pop warner and not allowing Pop Warner to participate in properties owned by the city but then allowing other people to come into this city and and have their events um I for one as I know the trouble that you’ve experienced because I have a a son who who plays Pop Warner so he was one of the children that did not get to play Pop Warner and I know that constantly even him at 12 years old was getting calls saying hey go ask your mom and your uncle if we can play football this year so um I think that we want to be very careful of the message that we send to the people in our community and that is that is a United message and that is what’s not good for one group probably isn’t going to be good for another group um and I think that is the main message that we need to make sure that people are depending on us for consistency um consistency in our decisions consistency in the rules that we we we make and so I want to make sure that we are reading the room and participating [Music] um consistently and those are those are my only comments uh for tonight uh and the other thing is I just want to make sure I don’t know if the people are listening um if our constituents are listening are hearing the same very very very staticky um noises that commissioner um Delgado and I are are hearing but if so I I really want us to talk about more clarity because people that came up to the microphone to speak the Commissioners I struggled a lot tonight as you all may have noticed um just trying to get beyond the static so I want people who are listening to have a good experience when they’re trying to listen to City business um so I I think that’s something that we really need to look into and those are all my comments for tonight Mr Mayor thank you ma’am commissioner Reed you know we have these mic guidelines on how close we’re supposed to be taped to the Des 48 injes 48 so I’ll get a little closer first of all I’d like to piggyback on um commissioner Henry and thanking commissioner May for bringing that to our attention in regards to the box stores cuz when I look at that area at the corner of Mason and Clyde moris and when you think about the derish Shire area when you think about uh Cardinal Estates and SK Creek as we would call it there is no grocery store in that area there there is nothing there and if we were to add another one of these box stores what would make a developer come there cuz we’re continuing to push them out so thank you for bringing that to our attention you know even our parents growing up said no sometimes and sometimes they said yes and we’ll find ourselves doing that at this days and I don’t have a problem saying either one because I feel as if I’m On Assignment sitting in this chair to make decisions on behalf of the citizens of this city and when I lay my head on my pillow I want to go to sleep at night thinking that I did the best that I could do sitting here so as I celebrate these eight years coming up on November and you all have congratulated me on winning I just want to say it’s a pleasure working with you all because we’re making decisions up here and and changing things and hopefully making a difference in the lives of the people that we serve I celebrated 25 years with Embry Riddle on Saturday eight years with you all and I hope that when when my time is done here I can someone can say to me well done it’s a pleasure working with each and every one of you and these next four years we’re going to make a greater difference that concludes my comments amen commissioner trer good evening everyone stay healthy yes ma’am commissioner Delgado good night Beach thank you very much commissioner mate uh thank you for your energy tonight and attention everybody staff included it was a long night but thank you so much for being here good night yes ma’am sir um great news on bethon cookman getting their getting re accredited that was something I’ve been very very worried about for what a year or two now um could not have been happier when I saw that in the paper um still got a little work to do got to stay the course but uh I maybe we can do something to recognize what a great effort uh the president uh uh Dr Tri uh kite kite um you know and the rest of that team did because it really was something that was um more likely to fail than to succeed and they pulled it off that is just an extending accomplishment um what was the other thing I had oh so at our last meeting I mentioned that um the next morning we have a meeting with um uh Jared Purdue The District 5 fot secretary and George rectenwald the county manager to talk about the tamoka river bridge and i’ mentioned that you know that that you know as a even though it’s not in our technically our responsibility it is something that dramatically affects the the businesses and the residents that live in that in that area uh as commissioner Henry pointed out is it’s the gateway to zone 5 as well you know I mean there’s it’s it it really is a a key to you know what what is going on out there uh so the outcome of that meeting which I’m bringing back to you to for consideration or to think about is that they would like to see a commitment of a two of $250,000 from Daytona Beach to the pd&e which is projected to cost somewhere between two and 2 and a half million so we would be putting in you know about 10% maybe a little bit more um they have a private developer that is willing to put in the same amount uh and then the fot and the county would somehow split up the remaining costs uh if we can get that started then it it kind of forces F Dot’s hand to build it because they once you do a PDN you know they have a it’s a fairly long clock like 10 years but it has to get built so if I I think it’s a reasonable contribution from our perspective as I mentioned we we’ve done this before with other projects um the done Avenue overpass what we’ve done over on you know on East ISB you know I think it’s I think it’s money well spent and I think it’s something it’s reasonable for us to participate in because we do have such a vested interest in making sure that that bridge you know is improved uh even though it will still take a number of years to get done uh we got to we got to get started so I would hope you all would uh would agree with me on that totally and good night okay um I I agree 100% uh as I said in the uh paper I think that that is one of the five or six issues that is most pressing that we show some tremendous resolve in addressing even though it may not be our responsibility is in our city so it is our responsibility to Advocate and do what is required to make it happen um Mr what do you think about maybe having directing staff to bring back a resolution for our next meeting um describing that that is a commitment that we’re willing to make provided the other partners um you know on board to to you know to to get the PDN going I’m in favor of that because if it gets it moving we’re showing our resolve and we have to be resolved in this this area um any objection okay all right okay objection okay thank you all right I’ll try to be brief but I was prepared tonight for affordable housing and so I’ll just say this to you all and I won’t deal with it any further I’m really happy about uh moving 11c forward I think it’s important and it sends a message of uh that we are we we really mean business in this area um I I want to see us move towards inclusion area zoning uh even consider uh land value capture here and cases where we can uh clear density designations which will give us a greater uh capacity for two box um I’m interested in making certain that we uh be more intentional about protecting uh environmentally sensitive uh land in our community um and I’m going to leave it uh right there but also say we have to make sure we have clear definitions uh about what what we mean by affordable housing uh because you know means one thing to this person and another to someone else so let’s be prepared to clearly uh Define that and um push this forward now is the time and thank you guys uh Echo all of commissioner Reed’s sentiments tonight as it relates to uh the pleasure of working with each of you uh we have great work to continue to do some of us uh longer than others um and I’m I’m sincerely thankful to the residents uh for accepting my uh willingness to serve for four more years and uh uh I’m even more committed than I was eight years ago and uh even more driven so let’s do some great things do you have anything sir no mayor thank you matter all right good night Daytona Beach
