The vehicle was put through its MOT 5 days after this incident, so the Police did not prosecute. The driver was driving around without an MOT for three months; they were lucky to get just a warning letter. As with warning letters, any future allegations may result in prosecution if the manner of their driving does not improve.

This kind of driving happens an awful lot at this location. Some drivers behave as if the cycle lane is an extension of the Give Way road markings. It is not.

Rule 172 of the Highway Code:

The approach to a junction may have a ‘Give Way’ sign or a triangle marked on the road. You MUST give way to traffic on the main road when emerging from a junction with broken white lines across the road.

Rule H3 – Rule for drivers and motorcyclists

You should not cut across cyclists, horse riders or horse drawn vehicles
going ahead when you are turning into or out of a junction or changing
direction or lane, just as you would not turn across the path of another
motor vehicle. This applies whether they are using a cycle lane,
a cycle track, or riding ahead on the road and you should give way to them.
