This happens an awful lot at this location. Many drivers behave as if the cycle lane is an extension of the Give Way road markings. It is not.

Rule 172 of the Highway Code:

The approach to a junction may have a ‘Give Way’ sign or a triangle marked on the road. You MUST give way to traffic on the main road when emerging from a junction with broken white lines across the road.

Rule H3 – Rule for drivers and motorcyclists

You should not cut across cyclists, horse riders or horse drawn vehicles going ahead when you are turning into or out of a junction or changing direction or lane, just as you would not turn across the path of another motor vehicle. This applies whether they are using a cycle lane, a cycle track, or riding ahead on the road and you should give way to them.

The police considered this a lapse of judgement by the driver, so they were sent a warning letter. Any future allegations may result in prosecution if the manner of their driving does not improve.

The problem is that lapses in judgement kill people when they involve two tons of metal.
